Actor Jamie Foxx, who has been sued for allegedly sexually assaulting a woman at a bar in New York in 2015, has refuted the allegations against him.
A spokesperson for the actor told PEOPLE in a statement that ‘the alleged incident never happened.’
Jamie Foxx intends to pursue legal action against the woman who accused him.
The statement from the actor’s representative read, ‘In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter, the claims are no more viable today than they were then. We are confident they will be dismissed again. And once they are, Mr Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action (sic).;
The complainant accused Foxx of taking her to a secluded corner, rubbing her breasts and groping her under her pants against her will at the Catch restaurant rooftop in New York City.
As detailed in the lawsuit reported by Variety, the woman and her friend were seated near Jamie Foxx at a table, accompanied by bar owner Mark Birnbaum. Around 1 am, the woman's friend approached Foxx for a photo. Allegedly, the actor began praising her appearance, mentioning her ‘super-model body’ and ‘pleasant fragrance.’ According to the complaint cited by Dailymail, the accuser alleges that Foxx appeared intoxicated and compared her appearance to Gabrielle Union's.
As stated in the lawsuit, a security guard reportedly observed the groping incident but did not intervene. The woman's friend intervened to assist her when she discovered the situation, after which Foxx left the scene. The legal action further claims that the woman required medical attention due to the alleged assault. Seeking recompense for pain, emotional distress, anxiety, and humiliation, the lawsuit lists Birnbaum and Catch NYC as defendants.
