The Supreme Court on 2 March 2023 ordered an overhaul in the process of appointments to the top posts of the Election Commission of India.

The top court said that the Chief Election Commissioner and election commissioners should be selected by a committee comprising the Prime Minister, the Leader of the Opposition in the Lok Sabha, and the Chief Justice of India.

In case the Lok Sabha does not have a Leader of Opposition, then the leader of the single largest Opposition party should be included.

A 5-judge bench said that this process should continue till the Parliament makes a law on the issue.
