The Speaker said the constitution of the party was relevant to decide which was the real party since it lays down the leadership structure

In 2018, Shiv Sena constitution was amended but not officially recorded, leading to reliance on older constitution that ECI recognises.

No organizational election occurred in 2018 which led to uncertainties in the leadership structure.

As per 2018 structure, Paksha Pramukh is the highest office, but as per the 1999 constitution, national executive is the supreme body.

The 1999 constitution states that the Paksha Pramukh has limited power and is required to consult with the national executive.

Speaker: Uddhav Thackeray lacked authority, based on party's constitution. He cannot remove Eknath Shinde from the post of legislature party leader.

The Uddhav faction accused Shinde faction of collaborating with the BJP, but they failed to produce any evidence to support the claim.
