As per a Reuters report, Apple has taken action in response to a recent decision by the U.S. International Trade Commission (ITC) to impose a ban on the import and sales of certain Apple Watches in the United States. This move follows a complaint filed by medical monitoring technology company Masimo, alleging patent infringement by Apple.
The ban, initiated after Masimo accused Apple of incorporating its pulse oximetry technology into the Apple Watch and infringing on its patents, affects Apple's Series 9 and Ultra 2 smartwatch models, which include blood-oxygen level monitoring capabilities.
Despite efforts by Apple to appeal the decision, including an emergency request filed with the U.S. Court of Appeals for the Federal Circuit, the company faced setbacks as the ITC's ruling remained in place. Apple’s plea for a halt in the ban until a decision on redesigned watch versions' patent infringement was rejected.
In response to the ban, Apple temporarily ceased the sale of the affected smartwatch models in the U.S. market but clarified that its Apple Watch SE and previously sold watches remain unaffected. The company has also continued to sell the banned models through various retailers like Amazon, Best Buy, and Walmart.
This legal battle highlights the intensity of intellectual property disputes within the tech industry, with Masimo asserting that Apple recruited its employees and unlawfully integrated its technology into the Apple Watch. However, Apple has contested these claims, emphasizing its disagreement with the ITC's decision and expressing its commitment to resolving the issue to ensure the return of the affected products to customers as soon as possible, reported Reuters.
