The Delhi Police in its chargesheet has included offences amounting to sexual harassment & stalking against Brij Bhushan as well as former WFI assistant secretary Vinod Tomar.

A chargesheet was filed in the senior wrestlers' FIR against former Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh under various sections of the Indian Penal Code (IPC) on June 15, 2023.

The Delhi Police, upon completing its investigation, filed a chargesheet for offences under sections 354 (Assault or criminal force to woman with intent to outrage her modesty), 354A (making sexually coloured remarks), 354D (stalking) of IPC against accused Brij Bhushan Sharan Singh and for offences under sections 109/ 354/354A/506 IPC against accused former WFI assistant secretary Vinod Tomar.

This chargesheet pertained to one of the two FIRs registered by top wrestlers accusing the BJP MP of sexual harassment.

Meanwhile, the cops filed a 500-page closure report in the POCSO case that relates to the minor's complaint, stating there was no corroborative evidence against him.

But it is important to note that even though the police have filed a closure report in the POCSO case, it will be decided by the judiciary whether Brij Bhushan Singh will be acquitted or not.

Section 354 of IPC
(Cognisable & non-bailable)

As per Indian Code, if a person assaults or uses criminal force with the intention of outraging a woman's modesty, the person shall face a punishment of no less than a year and up to 5 years.

Section 354A of IPC
(Cognisable & bailable)

India code notes, if a person demands sexual favours, shows pornography against a woman's will, makes sexually coloured remarks, or makes any unwelcomed physical contact, the person shall face a 3-year imprisonment and a fine or both.

Section 354D of IPC
(Cognisable & bailable)

If a person stalks a woman on the internet or follows her despite a clear indication of disinterest by her, the person shall be punished for up to 3 years on the first conviction and up to 5 years on the 2nd conviction. The accused shall also have to pay a fine.
