A court in Maharashtra&rsquo;s Thane district has convicted a 47-year-old man for kidnapping a minor girl and sentenced him to 7 years in jail.
Additional Sessions Judge (Kalyan) P R Ashturkar, however, dropped rape charges pressed against Deepak, alias Ganesh Bhanudas Bhuktar, citing lack of evidence.
A copy of the order passed on April 8 was made available on Friday.
Ambernath resident Bhuktar was booked in March 2018 after being accused of kidnapping the 13-year-old girl and taking her to Chhatrapati Sambhajinagar, then Aurangabad.
Judge Ashturkar held that the minor&rsquo;s lack of consent or resistance was irrelevant in a kidnapping case. The court also said that Bhuktar had secretly given her a phone, which was &ldquo;indicative of malicious intent&rdquo;.
The kidnapping charge has been proved beyond reasonable doubt, the court held.
However, the court found the rape allegations lacked specific and clear evidence. It said the girl and her mother failed to provide any specific details regarding the alleged sexual assault, including date, time, or place.
Furthermore, the medical evidence did not support forceful sexual assault, the court said, acquitting Bhuktar of rape charges under the Indian Penal Code (IP) and Protection of Children From Sexual Offences (POCSO) Act.
The court then convicted Bhuktar of kidnapping and sentenced him to seven years in jail and imposed a fine of Rs 3,000 on him.
Additional Public Prosecutor Sachin Kulkarni said six prosecution witnesses, including the teenager and her mother, were examined during the trial.

"Mutahida Majlis-e-Ulama Jammu &amp; Kashmir, expresses its concern regarding several provisions of the new law, which are being widely viewed by the Muslim community as affecting the established and religious character of the Waqf institution in India," the resolution reads.
The resolution was to be read out in mosques, shrines, and Imambaras across J-K during Friday prayers.
The resolution said the new legislation introduces significant changes in the management and supervision of Waqf properties, and many feel that it may diminish the role and authority of the Muslim community in overseeing its religious endowments, which have traditionally been managed in accordance with Islamic principles.
The resolution was formulated by the MMU after its meeting on the issue was not allowed on Wednesday.
The MMU said the "reduction in the powers" of Muslim-led Waqf Boards, and the greater role now assigned to government authorities and non-Muslim officials, has led to apprehensions that the core religious and charitable purpose of Waqf may not be fully understood or upheld.
"The provision allowing non-Muslims to be appointed to the Central and State Waqf Boards, and the removal of the earlier condition that the CEO of a Waqf Board must be a Muslim, has been viewed by the community as a deviation from the spiritual and religious ethos of Waqf management," it said.
The religious amalgam said the transfer of key decision-making powers to district collectors, including the authority to determine whether a property is Waqf or not, may lead to unilateral decisions and a weakening of the role of Waqf Boards.
"This is of particular concern in the context of ongoing disputes involving Waqf properties in various regions," it added.
The MMU said the removal of the concept of 'Waqf by long-standing use', which protected mosques, graveyards, and other Islamic sites used for generations without formal documentation, may result in the loss of such properties simply due to a lack of official records.
"Changes in the functioning of Waqf Tribunals, allowing for appeals in High Courts, may lead to prolonged legal proceedings and delays in the resolution of matters affecting religious endowments," it said.
The MMU said it reaffirms its full support to the All India Muslim Personal Law Board (AIMPLB) and will stand by the Board in whatever course of action it deems appropriate to address the issues arising from the new law.
It also called upon the Muslim community to remain united, aware, and engaged, and to support all peaceful and lawful efforts for the protection and proper functioning of the religious institutions and endowments.

He said that a 240-acre plot belonging to the Information and Broadcasting Ministry in Malad can be used for film production and post-production activities, he said.
Information and Broadcasting Minister Ashwini Vaishnaw had earlier said WAVES will focus on nurturing creative talent through 31 &ldquo;Create in India&rdquo; challenges, which have already shortlisted over 400 creators across fields such as gaming, music, comics, animation, visual effects and broadcasting.
The goal is to help these creators transform their ideas into market-ready products while protecting their intellectual property rights.
More than 725 creators are expected to be showcased at the summit.

`MUMBAI 1', a single card for public transportation in the Mumbai Metropolitan Region (MMR) will be launched soon, Maharashtra Chief Minister Devendra Fadnavis on Friday said here.
Speaking at a press conference with Railway Minister Ashwini Vaishnaw, he said the single card can be used for travelling by Metro, Mono Rail, suburban local trains and public transport buses.
"The architecture of the card will be ready in a month," Fadnavis added.
Vaishnaw said railway works of Rs 1,73,804 crore are underway in Maharashtra, and new works worth Rs 23,778 crore have been sanctioned this year.
As many as 238 new air conditioned trains have been sanctioned for the Mumbai suburban network and their manufacturing will start soon, the railway minister said.
Further, Rs 17,000 crore-worth projects are underway in the city, and this will transform the railway network in the country's financial capital, Vaishnaw added.
The Gondia-Ballarshah railway line in eastern Maharashtra has been approved and it will boost connectivity between Vidarbha and neighbouring Chhattisgarh and Telangana, CM Fadnavis said, adding the share of the Union government in the project will be of Rs 4,019 crore.
The `Chhatrapati Shivaji Maharaj Circuit Train Line which will take tourists through areas where forts belonging to the era of the founder of the Maratha state are located will be launched, Fadnavis announced on this occasion.

Among the projects inaugurated by Modi were schemes focused on rural development, including 130 drinking water projects, 100 new anganwadi centres, 356 libraries, a polytechnic college in Pindra, and a government degree college, Varanasi Divisional Commissioner Kaushal Raj Sharma said.
The prime minister also inaugurated a transit hostel at the police lines and police barracks in Ramnagar and four rural roads.
Earlier on his arrival, the prime minister received a detailed briefing on the alleged gang-rape of a young woman in his constituency and asked officials to take the strictest possible action against those involved, according to a state government statement.
The prime minister was briefed by the police commissioner, divisional commissioner and district magistrate on the "recent criminal rape incident in the city", the statement said.
"He instructed them to take the strictest possible action against the culprits and to implement appropriate measures to prevent such incidents in the future," it said.
The case involves the alleged gang-rape of a 19-year-old woman by 23 individuals over six days.
This was Modi's 50th visit to Varanasi after becoming prime minister in 2014, according to BJP Metropolitan President of Varanasi Pradeep Agrahari.

Dr. Kaur called for revising the current income ceiling of ₹2.5 lakh for scholarship eligibility, terming it outdated in the present economic context. She urged that raising the income limit would enable more deserving students to avail the benefits. Highlighting delays in central disbursal, she pointed out that funds for the years 2017 to 2020 are still pending, causing hardships for both students and educational institutions. She appealed to the Central Government to release the pending amount at the earliest.
She also demanded an increase in scholarship amounts for students belonging to Other Backward Classes (OBC), Economically Backward Classes (EBC), and De-notified Tribes (DNT), considering their growing educational needs. Dr. Kaur stressed the importance of covering the full course and tuition fee gap to ensure uninterrupted education for underprivileged students.
Demand for Timely Funding under the Adarsh Gram Yojana:
She informed that Punjab had identified 3,293 villages under the Adarsh Gram Yojana due to its large SC population, for which ₹684 crore was sanctioned. However, only ₹101 crore has been released so far. She urged the Central Government to release the remaining funds swiftly to enhance rural infrastructure.
Additionally, she recommended increasing the per-village grant from ₹20 lakh to ₹1 crore to ensure timely and quality development works.
Need for Transparency and Monitoring in Housing Schemes:
Appreciating the benefits of the housing scheme for the SC and economically weaker sections, Dr. Kaur raised concerns regarding a lack of transparency at the panchayat level in beneficiary selection. She demanded that the responsibility for identifying eligible beneficiaries and monitoring the scheme be assigned to the Department of Social Justice to ensure fair and effective implementation.
Punjab&rsquo;s Own Schemes and Unique Initiatives:
Dr. Kaur highlighted various welfare schemes being run by the Punjab Government. Under the "Ashirwad Scheme", a financial assistance of ₹51,000 is provided for the marriage of daughters from SC, BC, and EWS families, limited to two girls per family. This initiative, she said, plays a crucial role in strengthening the socio-economic security of families.
Talking about recent progressive steps, Dr. Kaur mentioned that the Punjab Government has waived loans worth ₹70 crore availed by SC beneficiaries, benefiting over 5,000 individuals and offering them a fresh start in life.
She further shared that Punjab has become the first state in the country to introduce sign language interpretation for live telecast of Assembly proceedings&mdash;an innovative step towards inclusivity for persons with hearing and speech impairments.
Commending the state-led "Project Jeevan Jot" launched in 2024, Dr. Kaur informed that 268 child beggars have been rescued and rehabilitated. Out of these, 19 children are currently placed in government-run homes with access to free education, nutrition, and healthcare, while the remaining have been reunited with their families through Child Welfare Committees.&nbsp;

On March 15, a woman's body was discovered wrapped in a bedsheet and weighted with a stone and a cement sack in a Delhi drain. Digging deeper, the police visited Mr. Kumar's office in Dwarka and discovered his mother-in-law's contact information in a diary. When they reached out to Ms. Singh's family, her sister Babita expressed concern, revealing that they had not been in contact with her since March 11. Despite their anxiety, Mr. Kumar had previously assured them that Ms. Singh was in Jaipur and not inclined to speak, persuading the family to delay approaching the authorities.
On April 1, the family was summoned to identify a body, which they confirmed as Ms. Singh's. The following day, her elder son corroborated the identification. The post-mortem report indicated that Ms. Singh had been strangled to death. Adding to the family's suspicions, Babita noted that only Mr. Kumar and Ms. Singh had access to the keys of their Dwarka residence.

The security agencies have expanded the scope of surveillance to the Bhaderwah area of Doda district to keep a track on terrorists potentially moving between different locations in the hilly districts of the Jammu region.
The officials said the encounter in Kishtwar broke out during an intelligence-based search-and-destroy operation launched jointly by the Army and the Jammu and Kashmir Police in the Chatru forest area of the district.
During the operation, the forces established contact with the terrorists. "The terrorists were effectively engaged, and a firefight ensued. One terrorist has been neutralized so far," the Army's White Knight Corps, or 16 Corps, said in a post on X.
"Despite hostile terrain and adverse weather, our brave soldiers continue relentless operations," it added.
Special forces braved high-snow areas and treacherous terrains to track down one terrorist, while a few others are still on the move under significant pressure from security forces, the officials quoted above said.
A brief exchange of fire with terrorists occurred in the Naidgam area of Chatru on Wednesday resulting in launch of massive combing operation.
The slain terrorist reportedly was a part of the Saifullah module of Pakistan, but it has not been officially confirmed. This is the module that ambushed an army team in Doda on July 15, 2024, resulting in the death of an officer and a rifleman.
Security forces have intensified surveillance in the high-altitude areas of the Bhaderwah area of Doda district, considering the melting snow in the higher meadows, a major factor contributing to infiltration during summer months.
Supported by helicopters and drones, troops are maintaining a high degree of surveillance in high-altitude areas connecting Kishtwar, Udhampur, and Kathua districts, they said.
There have been five encounters in the past 19 days in the mountainous terrains of Kathua-Udhampur-Kishtwar, in which three terrorists were killed. Four police personnel were also killed, while three other police personnel and a girl sustained injuries.
Search operations resumed Friday in the Jopher-Marta forests in Udhampur district, officials said.
Equipped with sniffer dogs and aerial surveillance, multiple security agencies are combing the entire forest area to track down three terrorists hiding in the area, they added.
The areas have been placed under night cordons to prevent terrorists from escaping, the officials said.
On Wednesday, during a search operation by police and other security forces, contact was established with terrorists in the Jopher-Marta belt in the Ramnagar police station area of Udhampur, leading to an encounter. "Two to three terrorists are believed to be trapped," said Senior Superintendent of Police Amod Ashok Nagpure.
While three encounters occurred in Kathua district, one took place in Udhampur district, and one in Kishtwar district.
The security was beefed up along Jammu-Srinagar national highway and people are being frisked and vehicles being checked as a part of this measure, they said.

Addressing the 17th convocation ceremony of Guru Gobind Singh Indraprastha University (GGSIPU), Saxena remarked, &ldquo;The time has passed when teachers used to give exams and teach you. Now, time itself will be your teacher. The larger share of women receiving degrees, particularly doctorate degrees, is a sheer indicator of the shifting educational landscape. It is special in the context of Delhi when we have a woman as the chief minister as well as the LoP.&rdquo; A total of 24,446 degrees were conferred at the ceremony, including 3,112 postgraduate, 21,222 undergraduate, 12 MPhil and over 100 PhD degrees.

Transshipment cargo from Bangladesh for re-export through India grew by 46 per cent between the 2023-24 and 2024-25 fiscals at the Petrapole Land Port in West Bengal's North 24 Parganas district, according to official data.
However, no truck from Bangladesh carrying transshipment cargo for third countries entered through the Petrapole border since April 9, after the Indian government revoked the facility granted to the neighbouring country in 2020, an official said.
In the 2023-24 fiscal, 3,473 trucks carrying 4,733 consignments worth Rs 2,357.27 crore entered India from Bangladesh through Petrapole, according to data provided by the Petrapole Clearing Agents' Staff Welfare Association (PCASWA).
In the 2024-25 financial year, 4,861 trucks transported 7,772 consignments worth Rs 3,446.66 crore, reflecting a 36 per cent increase in truck movement and a 46 per cent jump in cargo value over the previous fiscal, it said.
India had allowed transshipment of export cargo from Bangladesh to third countries via Indian land customs stations, and subsequently through Indian ports and airports since June 29, 2020.
However, on April 8 this year, the Indian government revoked the transshipment facility, leading to the Petrapole customs denying clearance for such third country cargo. Following the decision, Benapole port in Bangladesh returned the first set of four trucks carrying transshipment cargo on April 9.
"No trucks from Bangladesh carrying transshipment cargo for third countries have entered the Petrapole border since April 9, and the situation will remain as such until further orders. However, normal direct import-export activity with Bangladesh continues uninterrupted," Petrapole Land Port Manager Kamlesh Saini told PTI.
According to the data of the PCASWA, of the around 50-60 trucks that arrived from Bangladesh before April 9, around 15-20 carried containers with finished garments destined for Western markets such as Europe and the United States. Nearly 400 Indian trucks, on the other hand, entered the neighbouring every day through the Petrapole-Benapole border.
"Primarily, finished branded ready-made garments were entering India for air transport to Europe and the US from Delhi and Mumbai airports. Bangladeshi exporters used air freight for high-value cargo to ensure faster delivery to clients. Traditional sea freight often involves delays due to congestion," PCASWA secretary Kartik Chakraborty said.
On India revoking the transshipment facility, an official of the Clearing Agents Staff Association in Bangladesh's Benapole said, "This is not good news for exporters of Bangladesh garment at a time when the industry is reeling under huge stress due to global demand. It will impact border trade."

BJP office-bearers from across the country attended a workshop in New Delhi on Thursday where party president J P Nadda accused the opposition parties of misleading Muslims about the provisions of the amended law as part of its vote-bank politics.
Nadda said the new law, which came into effect on April 8, would help utilise Waqf properties for the welfare of poor Muslims and women, adding it would free these assets from the control of a small but influential section of people and open them for the minority community's overall benefit.
