The Allahabad High Court on 26th February rejected a plea by the Anjuman Intezamia challenging permission granted to Hindus to offer prayers in the southern cellar known as 'vyas tehkhana' of the Gyanvapi mosque complex.
With this, the prayers, which began after 31 years following a Varanasi district court order, will continue.
The court said that the state government's 1993 order of stopping worship rituals inside Vyas Tehkhana was illegal.
Dismissing both the appeals, Justice Rohit Ranjan Agarwal said, "After going through the entire records of the case and considering the arguments of the parties concerned, the court did not find any ground to interfere in the judgment passed by the district judge on January 17, appointing the Varanasi district magistrate as the receiver of the property, as well as the order dated January 31 by which the district court permitted puja in the tehkhana." Justice Agarwal had reserved his verdict in the matter on February 15 after hearing the counsel for the parties.

Allahabad High Court has said a husband must pay maintenance to his estranged wife even if he has no income. It said he can work as a labourer.

The Allahabad High Court has said even if a husband has no income from a job he is duty-bound to provide maintenance to his wife as he can earn about Rs 300-400 a day as an unskilled labourer.
A bench of justice Renu Agrawal of the Lucknow bench of the High Court made the observations while dismissing a revision petition of the man against a family court order asking him to pay Rs 2,000 monthly as maintenance to his estranged wife.
Justice Agrawal directed the principal judge of the trial court to take all recourse against the husband for the recovery of the maintenance already awarded in favour of the wife.
The husband had filed the revision petition before the high court on February 21, 2023, challenging the order of the Family Court, Number 2, which had asked him to pay the maintenance under section 125 of the Code of Criminal Procedure (CrPC).
According to the case details, the couple got married in 2015. The wife lodged an FIR against the husband and in-laws over dowry demand, and left their house to live with her parents in 2016.
The husband pleaded before the HC that the principal judge failed to consider that his wife was a graduate and was earning Rs 10,000 a month from teaching. He also said he was seriously ill and was under treatment. He also pleaded he was working as a labourer and lived in a rented room and has to take care of his parents and sisters.
In the order, the High Court said the husband could not produce any document to prove the wife earns Rs 10,000 from teaching. It also did not consider the man's submission that his parents and sisters are dependent on him and that he earns a little from agriculture and by working as a labourer.
The court considered that the husband was a healthy man and was capable of earning money by physical work.
"For the sake of argument, if the court presumed that the husband had no income from his job or from a rent of Maruti van, even then he was duty-bound to provide maintenance to his wife as is held by the Supreme Court in the case of Anju Garg in 2022 as, if he engaged himself in labour work he may earn as about Rs 300 to Rs 400 per day as a minimum wages as an unskilled labour," the HC observed.&nbsp;

The Lucknow bench of Allahabad High Court has expressed hope that the Centre will take an appropriate decision to ban cow slaughter and declare it as a "protected national animal".
"We live in a secular country and must have respect for all religions. In Hinduism, the belief is that the cow is the representative of divine and natural beneficence. Therefore it should be protected and venerated," Justice Shamim Ahmad said on February 14, dismissing a plea seeking the quashing of criminal proceedings against a person under the Uttar Pradesh Prevention of Cow Slaughter Act, 1955.
The petitioner, Barabanki resident Mohammad Abdul Khaliq, had pleaded that the police booked him without any evidence and hence the proceedings pending against him in the court of additional chief judicial magistrate should be quashed. Dismissing the plea, the bench held that from the facts on record, a prima- facie case was made out against the petitioner.
"Anyone who kills cows or allows others to kill them is deemed to rot in hell for as many years as there are hairs upon his body. Likewise, the bull is depicted as a vehicle of Lord Shiva: a symbol of respect for the male cattle."

SC freezes Allahabad HC order on UP local body polls without OBC reservation

The top court permitted the state government to appoint administrators to run the affairs of the local bodies after the expiry of the tenure of the elected representatives.

The Supreme Court on Wednesday stayed the Allahabad High Court order directing the Uttar Pradesh government to hold urban local body polls without reservation for the OBCs.
A bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha took note of the submissions of Solicitor General Tushar Mehta, appearing for the state government, and directed that a panel appointed by the state government will have to decide the OBC quota related issues for the local bodies poll by March 31, 2023.
The top court permitted the state government to appoint administrators to run the affairs of the local bodies after the expiry of the tenure of the elected representatives.

It, however, said the administrators will not be empowered to take major policy decisions.
The top court had earlier agreed to hear the Uttar Pradesh government's appeal challenging the high court order quashing its draft notification on urban local body elections and directing it to hold the polls without reservation for other backward classes.
The Lucknow bench of the high court had ordered that the state government notify the polls "immediately" as the term of several municipalities would end by January 31, while annulling the December 5 draft notification.
The court had directed the state election commission to hold the elections by January 31 after transferring the OBC seats in the draft notification to the general category.
