The Ministry of Defence (MoD) had moved the apex court for an exemption to armed forces from the September 27, 2018 judgement striking down adultery, saying it may hinder action against officers who indulge in such actions and can cause 'instability' within the services.

The Supreme Court on Tuesday ruled that armed forces can take action against their officers for adulterous acts, as it clarified the landmark 2018 judgement that decriminalised adultery.

The top court, on a plea filed by NRI Joseph Shine, in 2018 had struck down Section 497 of the Indian Penal Code dealing with the offence of adultery, holding it unconstitutional.
The Tuesday order by the bench, also comprising justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy, and C T Ravikumar came after Additional Solicitor General Madhavi Divan, appearing for the Centre, submitted a plea seeking clarification of the 2018 judgement.
The Ministry of Defence (MoD) had moved the apex court for an exemption to armed forces from the September 27, 2018 judgement striking down adultery, saying it may hinder action against officers who indulge in such actions and can cause 'instability' within the services.
"In view of the aforesaid (2018) judgment, there will always be a concern in the minds of the army personnel who are operating far away from their families under challenging conditions about the family indulging in untoward activities," the application said.&nbsp;

The move also comes five years after the Royal Canadian Mounted Police (RCMP) announced that they're changing their "outdated recruitment process" which will allow permanent residents who have lived in Canada for 10 years to apply

The Canadian Armed Forces (CAF) have announced that permanent residents, which includes a large number of Indians, will now be allowed to enlist, as the military struggles with low recruitment levels, according to a media report.
The move also comes five years after the Royal Canadian Mounted Police (RCMP) announced that they're changing their "outdated recruitment process" which will allow permanent residents who have lived in Canada for 10 years to apply, CTV News reported.
Permanent residents were previously only eligible under the Skilled Military Foreign Applicant (SMFA) entry programme, which was "open for individuals &hellip; that would reduce training costs or fill a special need &hellip; such as a trained pilot or a doctor," according to the Royal United Services Institute of Nova Scotia, a not-for-profit association of retired and serving members of the CAF.
Right now, candidates must be citizens of Canada, over 18 years old (or 16, providing they have parental consent), and have a grade 10 or grade 12 education depending on if they plan to enlist as an officer. This will also apply to permanent residents.
The CAF sounded an alarm in September over a severe shortage of recruits to fill thousands of vacant positions, meeting about half the number of applicants it needs per month to meet the goal of adding 5,900 members this year.
While the armed forces haven't said whether the recent move was made to boost recruitment, Christian Leuprecht, a professor at the Royal Military College of Canada, says that it makes good sense.
"In the past, the CAF has had the luxury of being able to limit itself to citizens because it has had enough applicants. This is no longer the case," Leuprecht told CTVNews.ca in an email.
"The CAF had resisted opening up the ranks to permanent residents because it does create additional burdens and risks, in terms of security clearances, for instance." But recruiting non-citizens isn't by any means something new, he points out, arguing many other countries have done this for years.
"Countries such as France use military service as either a pathway to citizenship or an accelerated pathway to citizenship; but since Canadian citizenship is relatively easy for permanent residents to obtain, it&rsquo;s not clear that would offer a major incentive in the Canadian case," he said.
In March, Defence Minister Anita Anand said that the CAF needs to grow if it is to meet global demands triggered by Russia&rsquo;s ongoing unprovoked invasion of Ukraine.
&ldquo;Time is of the essence in everything we do when so much is at stake for Canada and for the world. We are facing the greatest threat to international peace and stability since the end of the Second World War,&rdquo; she said in a press conference at the time.
&ldquo;What can a country like ours, an incredible country like ours, bring to the table?&rdquo; The change comes as Canada has released the Immigration Levels Plan for 2023-2025. The plan is targeting about 500,000 new permanent residents in Canada per year by the end of 2025. This may drastically widen the pool of candidates the military has to choose from.
Nearly 1 lakh Indians became permanent residents of Canada in 2021. One in five people coming to Canada were born in India, the Statistics Canada data shows, making it the top country of birth for recent arrivals.
According to the census 2021, nearly a quarter of Canadians are or have been landed immigrants or permanent residents. Immigrants are also prime candidates for the military as they typically arrive in Canada during their younger working-age years when they are likely to be more physically active.
Opening recruitment to permanent residents will also change the demographic makeup of the military, which presently has less than 12 per cent visible minorities and 16 per cent women. The remaining three-quarters are white males.

In an interview to NDTV, Lieutenant General Anil Puri, who is the Additional Secretary in the Department of Military Affairs and one of the people behind the 'Agnipath' recruitment plan, said that the forces don't stand for arson and there is not an iota of indiscipline in the military. 
He also told the news channel that the protests could be a result of anger among a group of defence aspirants who have been preparing to join the armed forces for the past 2 years but he doesn't think the agitation is against the 'Agnipath' programme on the whole. 
There has been widespread violence in many states of the country against the govt's new defence recruitment plan that commissions aspirants in the armed forces for a period of 4 years. 
The top concerns have been the employment prospects for those who are not selected for further service at the end of the 4 years and also that initially the govt had set an upper age limit of 21 years for eligibility.

A man was shot dead in police firing in Telangana's Secunderabad, trains went up in flames, and public and private vehicles attacked, as railway stations and highways turned into battleground in many states on Friday amid burgeoning protests against Agnipath, the contentious defence recruitment scheme.
Assurances by Defence Minister Rajnath Singh, Home Minister Amit Shah and the Army chief failed to cut ice with hordes of angry youth, carrying bamboo sticks and stones, storming railway premises across cities and small towns and laying siege to highways, creating a security scare.
Over 300 trains have been affected and more than 200 cancelled so far due to the protests, the Railways said, reflecting the enormity of the agitation.
Coaches of seven trains have so far been set ablaze by protesters, officials said, adding carriages of three running trains in the East Central Railway (ECR), headquartered in Bihar's Hajipur, and one empty rake in Kulharia, also in the same zone, were damaged by protestors. One coach of a train was also damaged in the washing line at Uttar Pradesh's Ballia. So far, 64 trains were short terminated in ECR.
As the depredations against the recruitment scheme continued for the third day across large parts of India, from Uttar Pradesh to Telangana and Bihar to Madhya Pradesh, Rajnath Singh, Amit Shah and Army chief Gen Manoj Pande tried to assuage the concerns of the agitators with little success.
The Army chief said the government's Thursday night decision to raise the upper age limit to 23 years from 21 under the scheme in 2022 will provide an opportunity to youths who were preparing to join the force but couldn't in the last two years.
The Centre's decision to increase the upper age limit will benefit a large number of youth, Shah said. He added that the recruitment process in the Army had been affected for the last two years due to the Covid pandemic and Prime Minister Narendra Modi took a sensitive decision by showing concern for the youth of the country.

As protests against the Agnipath military recruitment scheme intensified, the Army, Navy and the Air Force on Friday announced that they will start the enrolment process under the new model by next week while Defence Minister Rajnath Singh appealed to the youths wanting to join the armed forces to start preparing for the induction.
Air Chief Marshal VR Chaudhari told PTI that the selection process by the Indian Air Force for recruitment under the new scheme will start from June 24 while the Army said it will begin the initial exercise within two days.
While the Indian Navy said it will start the recruitment process "very soon", a senior naval commander said the notification for the recruitment would be out within a week.
The three services are planning to deploy the first batches of recruits under the new scheme both in operational and non-operational roles by June next year, senior military officials said.
The officials also said the agitating youths are not fully aware of the benefits of the Agnipath scheme.
In an attempt to pacify the protesters, the government on Thursday night increased the upper age limit for recruitment for soldiers under the Agnipath scheme to 23 years from 21 for the year 2022.
Defence Minister Singh, on a two-day visit to Jammu and Kashmir, said the relaxation of the age limit indicates that the government cares for the youth and asserted that the model of recruitment is a "golden opportunity" for those wanting to join the country's defence system.
He said the Department of Military Affairs, the Ministry of Defence and the three services are committed to commencing the recruitment process at the earliest and invited the youths to join the Indian armed forces and "serve the nation through Agnipath".

24-year-old Damira Rakesh was allegedly killed in police firing at Secunderabad railway station in Telangana during the violent protests against the Modi govt's new defence recuitment plan. 
According to an Indian Express report, he dreamt of wearing the military uniform and had spent the past 2 years waiting for the written exams after clearing the physical and medical tests earlier. His inspiration was his elder sister who serves in the Border Security Force. 
Rakesh hailed from Warangal and was youngest of four siblings. His elder brother was left physically challenged after an accident and so the it was on him to fulfill his parent's dream of having an Army man in the family. 
The Indian Express reported that he left home on Thursday to take part in the protests at the Secunderabad railway station next morning.

The 24 year-old Rakesh, an Army aspirant who was allegedly killed in police firing during violence at Secunderabad railway station during an anti-Agnipath protest on Friday hailed from Warangal district and was the youngest of four siblings, while his father and brother are into agriculture.
The deceased, an unfortunate first casualty of the ongoing protests against the Centre's new recruitment policy for the Armed forces, hailed from Dabeerpet village in Warangal district of Telangana.
According to Raju, the village Sarpanch, the victim did his schooling in the village and was pursuing graduation.
He is survived by his father, mother, an elder brother and two elder sisters. Rakesh's father and elder brother are farmers, Raju said. A relative of Rakesh is into police service, he added.

The deceased, aged about 25, has reportedly cleared the requisite tests for selection into Army but a written test was not conducted. This led them to protest today, the sarpanch claimed.
Meanwhile, Telangana Panchayat Raj Minister Errabelli Dayakar Rao and state Sports and Youth Services Minister V Srinivas Goud expressed anguish over the demise of the youth from Warangal district.
Goud demanded that the Centre pay ex gratia to the family of Rakesh, a release said. They found fault with the 'Agnipath' scheme and alleged that the NDA government at the Centre is responsible for the situation arising due to the protests over the scheme.
Violent protests have broken parts of the country demanding the Centre to roll back 'Agnipath' scheme unveiled by the Ministry of Defence which is a pan-India merit-based recruitment scheme for enrolling soldiers, airmen and sailors. Trains were set afire, public and police vehicles attacked and personnel injured as protests over 'Agnipath' snowballed and swept across several states including Uttar Pradesh and Bihar on Thursday.
Under the scheme, young persons will be provided an opportunity to serve in the armed forces as 'Agniveer' for a period of four years, including training period.
Earlier in the day, the Railway Protection Force (RPF) resorted to firing to disperse protesters who went on a rampage at the Secunderabad Railway station where three coaches of a train were set ablaze during the agitation.
Confirming the death, a senior police official told PTI that the firing was done by Railway Protection Force (RPF).

According to reports, protestors are unhappy with the 4-year recruitment plan under the 'Agnipath' policy as the older policy provided pension and lifelong benefits. 
After completion of the four-year tenure of the recruits, the scheme provides for retaining 25 per cent of each specific batch for regular service, based on organisational requirements and policies promulgated by the armed forces from time to time..
Those who will be enrolled in regular cadre after completion of four-year period will get the ex-servicemen status.
