The Enforcement Directorate (ED) on Thursday opposed in the Supreme Court the grant of interim bail to Delhi Chief Minister Arvind Kejriwal in a money-laundering case linked to the alleged excise policy scam, saying the right to campaign in elections is neither fundamental nor constitutional.
In a fresh affidavit filed in the top court, the ED said no political leader has ever been granted interim bail for campaigning even if he is not contesting polls.
"It is relevant to note that the right to campaign for an election is neither a fundamental right nor a constitutional right and not even a legal right," the agency said. It added that to its knowledge, "no political leader has been granted interim bail for campaigning even though he is not the contesting candidate. Even a contesting candidate is not granted interim bail if he is in custody for his own campaigning".
On Wednesday, Justice Sanjiv Khanna, who headed the bench that heard Kejriwal's petition against his arrest in the case, said, "We will pronounce the interim order (on bail) on Friday. The main matter related to the challenge to arrest will also be taken up on the same day." The Aam Aadmi Party (AAP) leader was arrested on March 21 and is currently lodged in Tihar Jail under judicial custody.
On May 7, the bench, also comprising Justice Dipankar Datta, had reserved its verdict on Kejriwal's interim bail plea.
On Tuesday, a Delhi court extended Kejriwal's judicial custody in the case till May 20.
The Delhi High Court had, on April 9, upheld the AAP leader's arrest, saying there was no illegality and the ED was left with "little option" after he skipped repeated summonses and refused to join the investigation.
The matter relates to alleged corruption and money laundering in the formulation and execution of the Delhi government's now-scrapped excise policy for 2021-22.&nbsp;

The ruling came on the same day the Supreme Court said it was willing to consider granting Kejriwal interim bail.

A Delhi court on Tuesday extended Chief Minister Arvind Kejriwal's judicial custody till May 20, in a money-laundering case linked to the alleged excise policy scam.
Special Judge for CBI and ED Kaveri Baweja extended Kejriwal's custody till May 20 after the Aam Aadmi Party (AAP) leader was produced before the court through a video-conference on the expiry of his custody granted earlier.
The judge also extended the judicial custody of co-accused Chanpreet Singh till May 20.
The custody was extended on the same day the Supreme Court said it was willing to consider an interim bail for the Aam Aadmi Party (AAP ) leader, to allow him to campaign for the ongoing Lok Sabha election.&nbsp;
The Bench noted that Kejriwal is the "elected Chief Minister" of Delhi, which will to to polls in a single phase on May 25. "There are elections... these are extraordinary circumstances and he is not a habitual offender," the apex court said.
However, the Supreme Court said the Delhi CM would not be allowed to perform official duties if released.&nbsp;
"We make it clear, we don't want you to be performing official duties if we release you... We don't want any interference in functioning of government," the court said.
The Supreme Court is yet to pronounce its decision on Kejriwal's interim bail plea.

The Supreme Court on Tuesday questioned the Enforcement Directorate on the timing of Delhi Chief Minister Arvind Kejriwal's arrest ahead of the general elections and sought a reply from the agency.
A bench of Justices Sanjiv Khanna and Dipankar Datta asked Additional Solicitor General SV Raju to reply on the question of the timing and said, &ldquo;Life and liberty are exceedingly important. You can&rsquo;t deny that.&rdquo; The bench, which asked Raju several other questions, asked the probe agency to reply on the next date of hearing of Kejriwal's plea challenging his arrest in the money laundering case related to the excise policy scam.
The matter is likely to be taken up for hearing on Friday -- from Wednesday, both judges will be sitting in different combinations.
Kejriwal is currently lodged in the Tihar jail here under judicial custody after his arrest on March 21 in the case.
The top court issued ED a notice on April 15 and sought its response to Kejriwal's plea.

Delhi Chief Minister Arvind Kejriwal moved approached the Supreme Court on Wednesday, a day after the high court junked his petition challenging his arrest in the liquor policy case.
The Aam Aadmi Party supremo's counsel will raise the matter before Chief Justice of India DY Chandrachud around 10.30 am and seek an urgent hearing. Kejriwal was arrested after he skipped several ED summons.&nbsp;
Earlier, the Delhi High Court chastised the Aam Aadmi Party (AAP) leader, who was claimed to be involved in money laundering in his "personal capacity" and in his capacity as the national convenor of the political party, for questioning the timing of his arrest and underlined that an investigation against the "classes and masses" cannot be different.
The court rebuked Kejriwal for "casting aspersions" on the judicial process with his claim about an approver making donations to the BJP through electoral bonds, saying the law relating to approvers was over 100 years old and not enacted to falsely implicate the politician.
With Kejriwal failing to get any reprieve from the high court, the AAP said he will appeal against the judgement in the Supreme Court. It said the excise policy case was the "biggest political conspiracy" to finish off the party.
Justice Swarana Kanta Sharma dismissed the AAP leader's petition and asserted that there was no contravention of legal provisions as the agency had enough material in its possession to nail him.
"Courts are concerned with constitutional morality and not political morality," she asserted.
"The material which has been encapsulated reveals that Sh. Arvind Kejriwal had allegedly conspired with other persons and was involved in the formulation of Delhi Excise Policy 2021-22, in the process of demanding kickbacks from the South Group, as well as in generation, use and concealment of proceeds of crime," said the court in its 106-page order.
The court noted there are statements of witnesses, including approvers, which "reflect" that Kejriwal was "allegedly personally involved" in formulation of the excise policy and "prima-facie in process of demanding kickbacks from the South Group in exchange of favours".
"Material has also been collected by the Directorate of Enforcement, in the form of statements of witnesses of hawala operators, one candidate of AAP and some survey workers, area managers, assembly managers, who had worked with the AAP during the Goa Election 2022, along with WhatsApp chats between several persons, and other material collected through raids of Income Tax, which reflect that the kickbacks which were received from South Group were utilised by AAP for funding Goa Elections," added the bench.
It said since there is "prima-facie material" regarding laundering of the kickbacks for Goa elections, the recovery in the year 2024 or non-recovery of any remaining amount would become clear only after the chargesheet has been filed.
The court ruled that Kejriwal's arrest was not illegal and the trial court remanded him in the custody of the agency by a well-reasoned order.
"This court holds that arrest of Kejriwal was not in contravention of sections concerned. Consequently, his remand cannot be termed as illegal," Justice Sharma concluded.
She read out the judgement for 25 minutes and also explained certain portions of her decision in Hindi.
The court clarified that it was not dealing with Kejriwal's bail plea but his writ petition challenging the arrest on certain grounds.
The court also said nothing in its order shall tantamount to an expression of opinion on the merits of the case during trial.
It emphasised that law applied equally to all and also held that the rigours of Section 70 of the Prevention of Money Laundering Act (PMLA), which deals with companies, are attracted in this case. The ED had likened AAP to a company and Kejriwal its director.
The court observed that political considerations and equations are not relevant to legal proceedings, clarifying that the present case was not a conflict between the Centre and Kejriwal but between him and the ED.
The court said the statements of approvers against the AAP national convenor would be judged during trial as it cannot hold a mini trial at this stage.
In his petition, Kejriwal had sought his release on several grounds, including that the belated statements of approvers Raghav Magunta and Sarath Reddy cannot be relied upon as the latter even donated to the BJP through electoral bonds.
Aurobindo Pharma purchased electoral bonds worth Rs 5 crore on November 15, 2022, five days after one of its directors, Reddy, was arrested in the excise case by the ED.

The Delhi High Court on Monday remarked that a plea seeking the removal of Arvind Kejriwal from the post of chief minister was filed for "publicity" and the petitioner deserved to have "heavy costs" imposed on him.
Justice Subramonium Prasad made the observation while transferring the petition filed by former AAP MLA Sandeep Kumar to the court of Acting Chief Justice Manmohan where similar petitions were heard earlier.
"This is just for publicity," Justice Prasad said.
"Since similar matters have been listed and disposed of by the Acting Chief Justice, list this petition before the bench headed by the Acting Chief Justice," he said.
After transferring the petition, Justice Prasad said, "I would have imposed heavy costs." In his petition, Kumar has said that after Kejriwal's arrest by the Enforcement Directorate (ED) in connection with the Delhi excise policy-linked money laundering case, the leader has incurred an "incapacity" to carry out the chief minister's functions under the Constitution.
The plea said the AAP leader's "unavailability" complicates the constitutional mechanism and he can never function as the chief minister from prison according to the mandate of the Constitution.
"Article 239AA(4) of the Constitution provides for the Council of Ministers with the chief minister at the head to aid and advise the lieutenant governor in the exercise of his functions in relation to matters with respect to which the legislative assembly has power to make laws.
"The aid and advice to the lieutenant governor are practically not possible without the chief minister being a free person available to render his aid and advice under the Constitution," the petition said.
"Issue a writ of quo warranto against respondent no.1, that is, Arvind Kejriwal, the incumbent chief minister of Delhi, by calling upon him to show by what authority, qualification and title he holds the office of the chief minister of Delhi under Article 239AA of the Constitution and after an inquiry, dislodge him from the office of the chief minister of Delhi with or without the retrospective effect," the petition prayed.
The matter will now be listed for hearing on April 10.
Kejriwal, who was arrested by the ED on March 21, is in judicial custody till April 15. He is currently lodged in Tihar jail.
The high court had earlier rejected two public interest litigations (PILs) seeking Kejriwal's removal from the chief minister's post.
On April 4, a bench of Acting Chief Justice Manmohan and Justice Manmeet P S Arora refused to entertain a PIL on the issue, saying it was Kejriwal's personal choice to continue as the chief minister.
Earlier, the bench had dismissed a similar PIL, observing that the petitioner had failed to show any legal bar that prohibited the arrested chief minister from holding office. It had observed that there was no scope for judicial interference in the matter and that it was for the other organs of the State to look into the issue.

Delhi Minister and Aam Aadmi Party (AAP) leader Atishi on Tuesday alleged that the Bharatiya Janata Party (BJP) reached out to her asking her to switch sides or face Enforcement Directorate (ED) action.
In a press conference in Delhi, Atishi said the BJP sent her a message through someone close to her, suggesting she switch to the saffron party to protect and enhance her career. She claims it was made clear to her that she would be arrested by next month if she chose to stay with AAP.
The Delhi Minister went on to accuse the BJP and Prime Minister Narendra Modi of setting out to finish the AAP by jailing its top leaders.
According to her, four top AAP leaders - Delhi minister Saurabh Bharadwaj, AAP MP Raghav Chadha, party MLA Durgesh Pathak and Atishi herself - have next on the radar of central investigative agencies. She said that BJP has threatened all four of them with arrest.
Soon enough, there would be raids at her own residence and that of her family members, she added.
Several AAP leaders, including Delhi Chief Minister Arvind Kejriwal and his former deputy Manish Sisodia, are already in jail in relation to a probe into the now-scrapped excise policy. &nbsp;

Informing the court, the ED said that when they asked Kejriwal how many times Vijay Nair contacted him, the AAP supremo said that Nair used to report to Aitish and Surabh, and not him.
The ED further claimed that Kejriwal kept giving false information about his party members.&nbsp;
"Arvind Kejriwal first says that ND Gupta is an active member of the party, is a member of the PAC (Political Affairs Committee) and knows the party's functioning but when confronted with the statement of N D Gupta, wherein he reveals that the National Convenor takes such decisions, Arvind Kejriwal calls the National Treasurer confused."
Nair is the former communication-in-charge of the AAP and one of the accused in the Delhi liquor scam.
Nair was part of AAP when the alleged liquor scam unfolded. &nbsp;
However, AAP leader Jasmine Shah said that Nair reporting to Atishi and Saurabh was revealed more than two years ago and questioned why the ED was bringing up the issue now.
"When Vijay Nair was arrested, he told ED that he didn't report to the Chief Minister, he reported to Atishi and Saurabh Bharadwaj. Now the question arises, why did ED bring up this statement two and a half years later, which they have in written form?,&rdquo; said AAP leader Jasmine Shah.
"Our senior leaders Atishi and Saurabh, who are ministers in the Delhi government, were named so that BJP understands that putting Arvind Kejriwal in jail won't shut down the party. Prepare for 2-3 more leaders, only then this name come up, although it was already recorded in their statements earlier,&rdquo; said Jasmine Shah. &nbsp;

The probe agency further informed the court that Kejriwal was trying to mislead the probe and even refused to share his phone password.

Additional Solicitor General SV Raju, representing the ED, further told the court on April 1 that the AAP supremo was not cooperative with the investigation and even refused to share his phone password.&nbsp;&nbsp;
The court was further informed by the ED that the AAP supremo told them that &ldquo;Vijay Nair didn't report to him but to Atishi Marlena and Saurabh Bharadwaj and his interaction with Vijay Nair was limited [sic].&rdquo;
Vijay Nair is the former communication-in-charge of the AAP and is among the accused in the liquor policy case.
The ED had sought 15-day judicial custody of Kejriwal, saying he was "totally uncooperative".
Speaking to reporters before entering court, the AAP leader said, "Whatever the prime minister is doing(referring to his arrest) is not good for the country".
AAP ministers Atishi, Saurabh Bhardwaj and Kejriwal's wife Sunita Kejriwal were present in court.
The federal probe agency had arrested Kejriwal on March 21 in connection with the case.
The next day, Special Judge Baweja remanded him in the custody of the ED till March 28.
Following this, the court allowed the ED's plea requesting extension of his custodial interrogation by four days till April 1.
In its remand application, the probe agency has accused the AAP leader of "being involved in the entire conspiracy of Delhi liquor scam, in drafting and implementation of the policy, for favouring and benefiting the quid pro receiving kickbacks and eventually using part of proceeds of crime generated out of the scheduled offence in the election campaign for Goa Assembly elections".

A man carrying a liquor bottle was detained by the Delhi Police Thursday for allegedly creating a ruckus outside the Rouse Avenue court when Chief Minister Arvind Kejriwal was produced in the excise policy case, police said.
The man, identified as Raghav Kumar Tiwari, was dressed in the attire of a lawyer and was taken to nearby police station for questioning, they said.
While the mediapersons stood outside gate number 5, Tiwari approached them staging protest against Kejriwal. He was also carrying a beer bottle, a police officer said.
He was immediately overpowered by the security personnel and shoved in the police van, the officer said.
The man was taken to the IP Estate Police station, where he revealed his identity as Raghav Kumar Tiwari and claimed he is an advocate by profession, according to the officer.
Tiwari, a resident of Ghaziabad, was detained under 65 Delhi Police Act but later allowed to go after a warning, officer said.
AAP's national convener Kejriwal was arrested by the Enforcement Directorate on March 21 in the Delhi excise policy-linked money laundering case and subsequently remanded in the agency's custody till March 28 by a court here.
He was produced in the court on Thursday as his custody was ending. The court extended his custody till April 1.&nbsp;

In a press briefing, Ministry of External Affairs Spokesperson Randhir Jaiswal asked the US to be respectful of India's sovereignty and internal affairs.
"Yesterday India lodged its strong objection and protest with the senior official from the US embassy with regard to the comments made by the US State Department. The recent remarks by the State Department are unwarranted. Any such external imputation on our electoral and legal processes is completely unacceptable."
"In India, legal processes are driven only by the rule of law. Anyone who has similar ethos, especially fellow democracies, should have no difficulty in appreciating this fact. India is proud of its independent and robust democratic institutions. We are committed to protect them from any form of undue external influences."
"Mutual respect and understanding form the foundation of international relations, and states are expected to be respectful of the sovereignty and internal affairs of others," he said.
MEA's reaction came a day after India summoned the acting US deputy chief of mission in New Delhi following a State Department comment on Monday that it was closely following reports of Kejriwal's arrest and that it encouraged a fair legal process.
"India's legal processes are based on an independent judiciary which is committed to objective and timely outcomes. Casting aspersions on that is unwarranted," the MEA said in a statement.
"In diplomacy, states are expected to be respectful of the sovereignty and internal affairs of others. This responsibility is even more so in case of fellow democracies. It could otherwise end up setting unhealthy precedents," it said.
Hours after India summoned a senior US diplomat to lodge a protest over comments on the arrest of Delhi chief minister Arvind Kejriwal, US state department spokesperson Matthew Miller on Wednesday reiterated that Washington encourages fair, transparent, timely legal processes and &ldquo;we don't think anyone should object to that".
&ldquo;We continue to follow these actions closely, including the arrest of Delhi chief minister Arvind Kejriwal,&rdquo; Matthew Miller said while responding to a question during the state department briefing over India summoning acting deputy chief of mission Gloria Berbena in New Delhi earlier in the day.
Miller also responded to a question on the freezing of the Congress party&rsquo;s bank accounts.
&ldquo;We are also aware of the Congress party's allegations that tax authorities have frozen some of their bank accounts in a manner that will make it challenging to effectively campaign in the upcoming elections. And we encourage fair, transparent and timely legal processes for each of these issues," he said.

Delhi's Rouse Avenue court has ordered the extension of ED custody of Delhi Chief Minister Arvind Kejriwal till April 1 in the liquor policy scam case. The Enforcement Directorate sought 7-day custody of the chief minister, but instead got remand for 4 days.
Special Judge Kaveri Baweja passed the order on March 28.
Earlier Kejriwal, who was produced in the court for the liquor scam case, made submissions and said a smokescreen of the AAP being corrupt is being created.&nbsp;
He also said that he is ready to remain in ED custody.
The AAP leader went over statements of witnesses in the case saying that despite the ED probing the case for 2 years, his name has appeared in just 4 statements.
"I am named by four witnesses in the excise policy case. Are 4 statements enough to arrest a sitting CM?" he added.
'Is this sufficient to arrest the sitting CM?' he asked.
"ED has two motives - to create a smokescreen to crush AAP and two, to create an extortion racket. Raghav Reddy contributed 55 crores to BJP. He bought his bail. Money trail is clearly established."
Speaking in court, Kejriwal said, 'This case has been going on for 2 years. I've been arrested. I've not been convicted by any Court. CBI has filed 31,000 pages, and over 290 witnesses have been examined. ED has filed over 20,000 pages. My name is there in just 4 statements.'
ASG SV Raju who is representing the ED said that Kejriwal's statements have been recorded, however, he gave evasive replies. &ldquo;He is deliberately not cooperating with us," ASG said, as reported by ANI.
The ED had produced him before Rouse Avenue court Special Judge Kaveri Baweja as his current custody was ending on Thursday.
The ED said in its fresh remand plea that during his custodial interrogation, his statements were recorded on five days and that he was "giving evasive replies".
It said the statements of three other persons have also been recorded during the remand.&nbsp;

After India summoned a senior US diplomat to lodge a protest over remarks on the arrest of Delhi Chief Minister Arvind Kejriwal, Washington on Wednesday stressed that it encourages fair, transparent, timely legal processes and &ldquo;we don't think anyone should object to that".

Ministry of External Affairs officials summoned the Acting Deputy Chief of Mission Gloria Berbena at its office in South Block in Delhi and lodged a strong protest against a US State Department official&rsquo;s remarks on Kejriwal&rsquo;s arrest.
The meeting lasted for more than 30 minutes.
Reports suggested that a US State Department official had said that Washington &ldquo;encouraged a fair, transparent and timely legal process for chief minister Kejriwal&rdquo;.
The Enforcement Directorate has arrested Kejriwal in a money laundering case linked to the excise policy &lsquo;scam&rsquo;.
The case pertains to alleged corruption and money laundering in formulating and executing the Delhi government&rsquo;s excise policy for 2021-22 which was later scrapped.
Earlier, the Ministry of External Affairs said Delhi takes strong objection to the remarks of the spokesperson of the US State Department about certain legal proceedings in India.

A day after Kejriwal's arrest, the US State Department had said it was monitoring the situation, and called on the Indian government to ensure "a fair, transparent, and timely legal process" for the jailed Aam Aadmi Party (AAP) leader.
Earlier, the foreign ministry had summoned the German envoy over the nation's remarks on Kejriwal's arrest, calling it a "blatant interference" in internal matters.
