The Bombay High Court on Wednesday said while senior citizens are entitled to reside in their own residence with peace and without any disturbance, a woman cannot be ousted from her matrimonial house and rendered homeless only to preserve the peace of mind of her elderly in-laws.
It also said that the machinery under the Senior Citizens Act cannot be used for the purpose of defeating the rights of a woman, the Bombay High Court has said refusing to evict a woman from her matrimonial home.
A single bench of Justice Sandeep Marne stayed an order passed by a tribunal directing a woman and her estranged husband to vacate from the house of his elderly parents.
The woman had filed a petition in the HC against the tribunal order and claimed that this was just a ploy to get her out of the flat.
She had earlier filed an application before the family court under the provisions of the Domestic Violence Act seeking protection from eviction from the shared household.
The court in its order of March 18 noted that the woman cannot be ousted from her matrimonial house and rendered homeless only to preserve the peace of mind of her elderly in-laws.
The bench noted that there is no doubt that senior citizens are entitled to reside in their own house with peace and without any disturbance.
"But at the same time, the machinery under the Senior Citizens Act cannot be used for the purpose of defeating the rights of a woman under the provisions of the Domestic Violence Act," the HC said.
The court said when a contest is noticed between the rights of senior citizens under the Senior Citizens Act and of a woman under the Domestic Violence Act, a balancing act needs to be done and the rights of the senior citizen cannot be decided in isolation.
The court noted that the woman has been residing in the said flat since her marriage in October 1997.
The senior citizen couple claimed that they were subjected to harassment and torture by their son and daughter-in-law and hence approached the tribunal seeking ouster of their son and daughter-in-law from the flat.
The high court said the tribunal before ordering eviction ought to have considered the fact that in the present case there are contesting claims.
The high court noted that the grievances made by the senior citizen couple could not have been considered in isolation and the petitioner woman must also be permitted to get her claim of residence in a shared household, at least at interim stage.
"The petitioner (woman) cannot be rendered homeless to ensure peace of mind of the senior citizens," the high court said.
The court noted that the woman's application filed before the family court was presently pending and said till the same is decided, the petitioner woman shall be permitted to stay in the flat.
The court suspended the tribunal's September 2023 order for a period of six months.&nbsp;

A woman has the right to choose whether to continue her pregnancy or not and the decision is hers and hers alone to make, the Bombay High Court said while allowing a married woman to terminate her 32-week pregnancy after the foetus was detected with severe abnormalities.
A division bench of Justices Gautam Patel and S G Dige, in its judgment of January 20, a copy of which was made available on Monday, refused to accept the medical board's view that even though the foetus has serious abnormalities it should not be terminated as the pregnancy is almost at its fag end.
The woman had approached HC seeking to terminate her pregnancy after a sonography revealed the foetus had severe abnormalities and that the baby would be born with physical and mental disabilities.

"Given a severe foetal abnormality, the length of the pregnancy does not matter. The petitioner has taken an informed decision. It is not an easy one. But that decision is hers, and hers alone to make. The right to choose is of the petitioner's. It is not the right of the Medical Board," the court said in its order.
Refusing termination of pregnancy only on grounds of delay would not only be condemning the foetus to a less than optimal life but would also be condemning the mother to a future that will almost certainly rob her of every positive attribute of parenthood, the HC said.
"It would be a denial of her right to dignity, and her reproductive and decisional autonomy. The mother knows today there is no possibility of having a normal healthy baby at the end of this delivery," the court said.

The Nationalist Congress Party (NCP) leader has been in jail since November last year after he was arrested by the Enforcement Directorate (ED) in a money laundering case.

The Bombay High Court on Monday granted bail to former Maharashtra home minister and NCP leader Anil Deshmukh in a corruption case being probed by the Central Bureau of Investigation (CBI).
Deshmukh, however, won't walk out of jail as the high court has kept the order in abeyance for ten days after the CBI sought time to challenge it in the Supreme Court.
A single bench of Justice M S Karnik allowed Deshmukh's bail plea after hearing arguments of both sides.
He is currently in judicial custody and lodged at the Arthur Road prison in Mumbai.
Deshmukh, 74, had approached the high court after a special CBI court rejected his bail plea last month. He sought bail both on medical grounds as well as on merits.

The Nationalist Congress Party (NCP) leader has been in jail since November last year after he was arrested by the Enforcement Directorate (ED) in a money laundering case.

He was granted bail by the high court last month in the ED case.
Deshmukh's bail plea in the corruption case was, however, rejected by the special CBI court noting that there was prima facie evidence against him.
IPS officer Param Bir Singh had in March 2021 alleged that Deshmukh, then home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars in Mumbai.
The high court in April 2021 directed the CBI to carry out a Preliminary Enquiry against Deshmukh.
The CBI subsequently registered an FIR against Deshmukh and his associates for alleged corruption and misuse of official power.&nbsp;

The court granted him bail on a surety of Rs one lakh.

The Bombay High Court on Friday granted bail to scholar-activist Anand Teltumbde, arrested in the Elgar Parishad-Maoist links case.
The high court, however, stayed its order for a week so that the National Investigation Agency (NIA), the prosecuting agency, can approach the Supreme Court. This means that Teltumbde will not be able to walk out of jail till then.
A division bench of Justices A S Gadkari and M N Jadhav allowed the bail plea filed by 73-year-old Teltumbde, who has been in jail since his arrest in the case in April 2020.
The court granted him bail on a surety of Rs one lakh.
The NIA sought the court to stay its order for one week so that it can appeal in Supreme Court. The bench accepted this and stayed its order for a week.

Teltumbde, who is presently lodged at the Taloja prison in Navi Mumbai, had moved the high court last year after a special court refused to grant him bail.
In his plea, Teltumbde had claimed that he was never present at the December 31, 2017 Elgar Parishad event held in Pune nor made any provocative speeches.
The prosecution's case is that provocative and inflammatory speeches were made at the event that was allegedly backed by banned terror outfit CPI (Maoist), which later led to violence at Koregaon Bhima village near Pune.
Teltumbde is the third accused in the case to be granted bail. Poet Varavara Rao is out on a medical bail and lawyer Sudha Bharadwaj is out on regular bail.

The Bombay High Court has said defaming husband and calling him a womaniser and alcoholic without substantiating the allegations amount to cruelty, and upheld a family court order dissolving the marriage of a Pune-based couple.
A division bench of Justices Nitin Jamdar and Sharmila Deshmukh in its order passed on October 12 dismissed an appeal filed by a 50-year-old woman, challenging a November 2005 decree passed by a family court in Pune dissolving her marriage to a retired Army official.
The man died pending hearing of the HC appeal following which the court directed for his legal heir to be added as a respondent.
The woman in her appeal claimed her husband was a womaniser and alcoholic and due to these vices she was deprived of her conjugal rights.
The bench said the wife's conduct in making unwarranted and false allegations against her husband's character results in damage to his reputation in society and this amounts to cruelty.
The HC in its order noted that apart from her own statement, the woman has not produced any evidence to substantiate her allegations.

The deceased man's lawyer told the court that the petitioner woman had caused mental agony to her husband by making false and defamatory allegations against him.
The court referred to the husband's deposition before the family court wherein he had claimed that the petitioner separated him from his children and grandchildren.
&ldquo;It is a settled position in law that 'cruelty' can broadly be defined as a conduct that inflicts upon the other party such mental pain and suffering as would make it not possible for that party to live with the other,&rdquo; the high court said.
The bench further noted that the petitioner's husband was an ex-Army man who retired as a Major, belonged to the upper strata of society and had a standing in society.
&ldquo;The conduct of the petitioner in making unwarranted, false and baseless allegations pertaining to the respondent's character and labelling him as an alcoholic and womaniser has resulted in shredding his reputation in the society,&rdquo; the HC said.
&ldquo;Considering the above, we find that the conduct of the petitioner constitutes cruelty within the meaning of Section 13 (1) (i-a) of the Hindu Marriage Act,&rdquo; the court said, adding it was a fit case for grant of divorce.

The Supreme Court has suspended the Bombay High Court order acquitting former Delhi University &nbsp;professor G N Saibaba and others in an alleged Maoist-links case.
An apex court bench of justices M R Shah and Bela M Trivedi, which sat on a non-working day to hear the matter, also rejected Saibaba's request for putting him under house arrest in view of his physical disability and health conditions.
It stayed the release of all the accused in the case, including Saibaba, from jail, as directed by the Nagpur bench of the Bombay High Court.
The bench sought responses from Saibaba and the other accused on a plea moved by the Maharashtra government against the high court order.
More than eight years after his arrest, the High Court acquitted Saibaba on Friday and ordered his release from jail, noting that the sanction order issued to prosecute the accused in the case under the stringent provisions of the Unlawful Activities (Prevention) Act was "bad in law and invalid".

The Bombay High Court on Tuesday directed the Mumbai civic body to demolish the unauthorised construction at Union minister Narayan Rane's bungalow in Juhu area here, noting it had violated the Floor Space Index (FSI) and Coastal Regulation Zone (CRZ) rules.
Floor space index (FSI) is the maximum permissible floor area that can be built on a particular plot or /piece of land.
A division bench of Justices R D Dhanuka and Kamal Khata said the Brihanmumbai Municipal Corporation (BMC) cannot be permitted to consider and allow the second application filed by a company run by the Rane family seeking regularisation of the unauthorised construction as it would "encourage wholesale construction of unauthorised structures".
The court directed the BMC to demolish the unauthorised parts of the bungalow within a period of two weeks and submit a compliance report to the court one week thereafter.
The bench also imposed a cost of Rs 10 lakh on Rane and directed for the amount to be deposited towards the Maharashtra State Legal Services Authority within two weeks.
Rane's advocate Shardul Singh sought that the court stay its order for six weeks so that he could approach the Supreme Court in appeal.
The bench, however, rejected it.
The court dismissed the petition filed by Kaalkaa Real Estates, a company owned by Rane's family, seeking directions to the BMC to decide their second application uninfluenced by orders passed by civic body earlier.
The BMC had in June this year rejected the regularisation application, noting there were violations in the construction.
The company filed a second application in July, claiming it was seeking regularisation of a smaller portion as compared to what it had sought previously, and under new provisions of the Development Control and Promotion Regulation 2034.
The high court in its order said the BMC's stand that it could consider the second application for regularisation of the construction was inconsistent with its own order rejecting the first application. The bench noted that the HC had in June this year accepted the BMC's first order.
"If the regularisation application is allowed to be heard which the BMC is bent upon allowing, then it would lead to encouragement of wholesale construction of unauthorised structures," the court said.
The petitioner (company owned by Rane) has constructed three times the permissible limit of FSI and has not obtained clearances from the BMC, the fire department and also not taken environmental clearance, the bench said.
"The application for the proposed retention will amount to encouragement of large scale violation within the city of Mumbai without any concern for the statutory provisions," the court said.
If such retention is allowed and accepted then it would encourage more such illegal constructions and other home buyers would also indulge in such violations, the HC said.
The BMC had earlier told the court that it was willing to hear the second application for regularisation of unauthorised construction at the suburban Juhu bungalow of Union minister Narayan Rane, even as the first application had been rejected.
The HC had last month while hearing arguments on the plea asked how the BMC could consider a second application when the first application for regularisation was rejected by the civic body, and the first order accepted by the HC saying the construction was prima facie illegal.

The Bombay High Court on Saturday stayed some provisions of the new Information Technology Rules for news publishers that deal with a code of ethics.
The high court bench ruled that said such compulsory adherence to code of ethics was in breach of the right to free speech guaranteed under Article 19 of the Constitution.
Legal news portal The Leaflet and journalist Nikhil Wagle had filed petitions challenging the new rules, saying they were likely to have a "chilling effect" on citizens' right to free speech.

The Bombay High Court on Saturday stayed some provisions of the new Information Technology Rules for news publishers that deal with a code of ethics.
The high court bench ruled that said such compulsory adherence to code of ethics was in breach of the right to free speech guaranteed under Article 19 of the Constitution.

Legal news portal The Leaflet and journalist Nikhil Wagle had filed petitions challenging the new rules, saying they were likely to have a "chilling effect" on citizens' right to free speech.
The court also refused the Union government's request to stay the order to enable it to file an appeal.
The court, however, refused to stay clauses of the IT Rules that deal with the constitution of an inter-ministerial committee and blocking of content in certain situations.

Bombay High Court on Saturday dismissed the bail pleas filed by actor Shilpa Shetty's husband&nbsp;Raj Kundra&nbsp;&amp; his aide Ryan Thorpe.
The court rejected their pleas&nbsp;challenging the magistrate court's remand order seeking immediate release in a case of alleged production and streaming of pornographic content on apps.
A single bench presided over by Justice A S Gadkari rejected their applications &amp; said that the duo's remand by a magistrate to police custody and the subsequent judicial custody was within the conformity of law and did not require interference.
