In a significant judicial intervention, the Supreme Court has pledged a Central Bureau of Investigation (CBI) probe into allegations highlighting a collaboration between banks and builders.
This assurance comes as a response to grievances from a group of homeowners who have petitioned the court, alleging that banks are coercing them to pay EMIs despite delays in obtaining possession of their flats.
Justice Surya Kant, presiding over a two-judge bench handling the matter, emphasized that while the court refrains from labeling any institution as inherently good or bad, there is a clear necessity for a CBI investigation.
"Thousands of people are crying. We can't wipe their tears, but we can address their issues. Something very effective has to be done in a time-bound manner," he stated. The CBI has been directed to present a plan outlining their approach to the investigation.
In a landmark decision in July 2024, the Supreme Court had ordered that no coercive actions, including EMI recoveries, should be executed against homebuyers in the National Capital Region (NCR) who have not yet received possession of their properties. However, this order remains largely unimplemented.
The homeowners further claim that banks have unlawfully released loan funds directly to builders or developers, contravening Reserve Bank of India (RBI) guidelines.
Allegedly, homebuyers were manipulated as intermediaries to secure these loans, and when they objected, banks initiated actions against them.
Justice Kant expressed skepticism regarding the operations of banks involved, stating, "We may not certify a single bank free from doubt... You see the conduct of public institutions!"
During the proceedings, when Abhishek Manu Singhvi, representing the financiers, argued against liability if a builder goes insolvent, Justice Kant retorted, "Your fault is that knowing not a brick has been laid at the site, you released 60 per cent! How can this be without quid pro quo?"
Mr. Singhvi proposed that banks could halt interest charges until possession is delivered, a suggestion the court dismissed.
Justice Kant underscored that the proposal would not resolve the systemic issues affecting countless people and that the Supreme Court consistently addresses these plights.
Expressing zero tolerance for reluctance in addressing these concerns, Justice Kant announced the appointment of an amicus curiae to assist with the extensive caseload. A follow-up hearing is scheduled in two weeks, promising further judicial examination of the matter.

CBI insiders reveal that the department had been under close watch for an extended period. Complaints suggested systemic bribery at multiple levels. Upon conducting a detailed review, the CBI found initial evidence indicating that the complaints were credible.
The agency's response involved verifying the information through detailed surveillance, confirming officials' involvement in bribery-related activities. Armed with concrete evidence, the CBI proceeded to apprehend the implicated officials.
In the backdrop of these developments, AAP faced a significant downturn in the Delhi Assembly elections, the results of which were announced on February 8. The party secured only 22 of the 70 seats, as the Bharatiya Janata Party (BJP) claimed victory with 48 seats, regaining power in Delhi.
AAP's decade-long governance in Delhi had been marred by multiple corruption scandals. High-profile leaders within the party, such as former Chief Minister Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia, became entangled in legal controversies, with several facing incarceration due to corruption charges.

Special Judge B Y Phad rejected the CBI's request for transit remand, finding the allegations against Deep &ldquo;not well-founded.&rdquo; Deep, the assistant director of the ED&rsquo;s Shimla unit, was arrested on Tuesday in Mumbai for allegedly demanding a Rs 1.1 crore bribe from Rajnish Bansal, chairman of the Himalayan group of professional institutions, in exchange for not arresting him in an ongoing money laundering probe.
The court noted that the CBI failed to produce the case diary, a critical document for transparency and procedural legitimacy. This, the judge said, undermines the prosecution's case. The court also pointed out the failure of the investigation officer to serve an arrest warrant, making the arrest &ldquo;procedurally unsound.&rdquo;
The judge found that the CBI&rsquo;s actions were marked by several fundamental lapses, including procedural violations and inconsistencies, which led to the ruling that Deep&rsquo;s detention was illegal. Deep was granted release on a personal recognizance bond of Rs 50,000.
The CBI had alleged that Deep received a bribe of Rs 60 lakh near Panchkula in Haryana on December 22, 2024, and then evaded authorities by changing his location and phone. He was eventually traced and arrested in Mumbai on Tuesday.

Speaking at the launch of 'Bharatpol at the Bharat Mandapam here, the minister underlined that the real-time interface was the most important feature of the portal developed by the Central Bureau of Investigation (CBI). It will allow central and state agencies to easily connect with the Interpol and speed up their investigations, he said.

"It is time that we use modern technology and techniques to nab and bring to justice the fugitives who absconded from India after committing a crime," Shah said.
"We have to keep an eye on global challenges and update our internal systems. Bharatpol is a step in that direction," he said.
He said the new portal will allow central and state probe agencies to share and obtain information on their cases from the 195 member nations of the Interpol.
The three new criminal laws brought by the Modi government last year will ensure that trials against fugitives and absconders are conducted in a better manner.
"I would urge the CBI to take the responsibility of training the states for capacity building regarding Bharatpol and also for the three new criminal laws," Shah said.
"We need to institutionalise these systems along with the knowledge of various kinds of Interpol notices and their procedures," he said.
PTI first reported about the setting up of the 'Bharatpol' portal.
The CBI and the National Central Bureau of India are responsible for Interpol-related affairs.

The CBI has found that Ashutosh Kumar knew that the premises was being used for providing question papers to NEET aspirants, they said.
About Manish Kumar, they said, that he allegedly struck deals with candidates who were ready to pay money for getting the question papers in advance.
He then brought these candidates to the hostel where they were provided with the paper and the answer key, they said.
The aspirants remained in the hostel till the examination and prepared for the paper held on May 5, they said.

They said the central agency has re-registered one case each from Gujarat and Bihar and three cases from Rajasthan as its own FIR, while it is also likely to take up another case from Maharashtra's Latur.
Barring the case from Bihar, the other four appear to be isolated incidents of impersonation and cheating by local officials, invigilators and candidates, the officials said.
The CBI has already registered its own FIR in connection with the case on a reference from the Union education ministry to conduct a comprehensive probe, they said.

The officials said that the CBI registered a fresh case against unidentified persons on a reference from the Union education ministry. Around 24 lakh students have taken the medical entrance test.
They said the ministry had to give in to demands of students protesting in several cities for an investigation into alleged malpractices.
"Certain cases of alleged irregularities, cheating, impersonation and malpractice have been reported in NEET-UG which was conducted on May 5," a senior education ministry official said.
"For transparency in the conduct of the examination process, it was decided after a review that the matter be handed over to the Central Bureau of Investigation (CBI) for a comprehensive investigation," the official added.&nbsp;

The CBI on Saturday conducted searches on the premises of former TMC MP Mahua Moitra in multiple locations, including Kolkata, in connection with the alleged cash-for-query case, officials said.
Teams of the central probe agency reached Moitra's residence in Kolkata and other cities early on Saturday, informed about the search proceedings and started the operation, they said.
The Central Bureau of Investigation (CBI) registered an FIR against the former Trinamool Congress (TMC) MP on Thursday on the directives of the Lokpal, which has instructed the agency to file a report within six months, they said.
Moitra was expelled from the Lok Sabha in December for "unethical conduct".
The former MP has challenged her expulsion in the Supreme Court and will again be in the hustings during the upcoming general elections as a TMC candidate from the Krishnanagar seat in West Bengal.
The Lokpal, the anti-corruption ombudsman, issued the directions to the CBI after receiving the findings of its preliminary inquiry into allegations made against Moitra by BJP MP Nishikant Dubey.
Dubey, a Lok Sabha member, alleged that Moitra had asked questions in the House in exchange for cash and gifts from Dubai-based businessman Darshan Hiranandani to mount an attack on industrialist Gautam Adani and Prime Minister Narendra Modi, among others.

According to local media reports, the CBI officials raided 10 locations in seven cities that includes Delhi, Mumbai, Ambala, Chandigarh, Madurai, and Chennai in connection with the job scam.
The CBI's case also names Dubai-based Faisal Khan alias Baba, who runs the YouTube channel Baba Vlogs.&nbsp;
The CBI has registered cases against various visa consultancy firms and agents for sending young Indians to Russia in the name of lucrative jobs, the Hindustan Times reported.&nbsp;
CBI said 35 such cases have been found and certain suspects have been detained for questioning at various locations.&nbsp;
Over Rs 50 lakh, incriminating documents, electronic records like laptops, mobiles, desktops etc., have been seized.
On March 6, several reports emerged that a second Indian national died while serving with the Russian Army. The Indian embassy in Moscow confirmed the death of Indian national Mohammed Asfan in a post on X. The 30-year-old from Hyderabad travelled to Russia late last year and reports have said he was seriously injured along with two other Indians in hostilities in a conflict zone last month. According to Asfan&rsquo;s family, he is survived by his wife and two children.
Mohd Asfan&rsquo;s elder brother Mohammad Imran said he went to Russia on a flight from Chennai via Sharjah in November 2023.
&ldquo;We have learnt about the tragic death of an Indian national Shri Mohammed Asfan. We are in touch with the family and Russian authorities. Mission will make efforts to send his mortal remains to India,&rdquo; the Indian embassy posted on X.
Earlier on February 27, 23-year-old Hemal Ashwinbhai Mangukiya, a resident of Surat in Gujarat, lost his life in a Ukrainian air strike while serving as a &ldquo;security helper&rdquo; with the Russian Army at Donetsk, a part of Ukraine occupied by Russia. Mangukiya travelled to Russia last December.

The CBI conducted searches at the residences of senior West Bengal minister Firhad Hakim and TMC MLA Madan Mitra in Kolkata on Sunday morning in connection with its investigation into the alleged irregularities in recruitments made by the civic bodies in the state, officials said.
Hakim, the minister of urban development and municipal affairs, is also the mayor of Kolkata. He is a senior leader of the TMC and has significant sway in the party's organisation.
A team of CBI officers reached his residence in south Kolkata's Chetla area along with a large contingent of central forces, officials said.
"Two CBI officers are questioning him," a senior official told PTI.
As the searches began, Hakim's supporters gathered outside his house, and began a protest.
A CBI team also searched the residence of Mitra, a former minister and the MLA of Kamarhati in North 24 Parganas district, in the Bhabanipur area, around 3 km from Hakim's residence in Chetla.

It is alleged by the central investigating agencies that around 1,500 people were illegally recruited by different civic bodies in the state, between 2014 and 2018, against monetary considerations.&nbsp;

The CBI has approached the seeking cancellation of Prasad's bail in the Doranda treasury case in which he has been sentenced to five years in prison.
Additional Solicitor General S V Raju, appearing for the CBI, submitted that the Jharkhand High court order granting bail to the Rashtriya Janata Dal (RJD) leader was "bad in law" and "erroneous".
Senior advocate Kapil Sibal, representing Prasad, opposed the CBI's application on account of the former union minister having gone a kidney transplant surgery.
Sibal told the bench that Prasad has already served 42 months behind bars in the case.
"He is playing badminton. He has been granted bail after conviction in the case. I will demonstrate that the high court order is bad in toto. There's a short question of law. The bail has been granted on erroneous assumption that he has spent more than 3.5 years considering that sentences are concurrent and not consecutive," Raju told the court.
Prasad has so far been sentenced in five cases of the Rs 950 crore fodder scam, which took place between 1992 and 1995 when he was the Bihar chief minister and held the finance and animal husbandry portfolios.
Huge money was withdrawn from different treasuries in Bihar and the present-day Jharkhand on the basis of fake and forged bills and vouchers related to fodder, medicines and artificial insemination.
A bench of Justices AS Bopanna and M M Sundresh adjourned the matter to October 17.
In his reply to the CBI's appeal seeking cancellation of his bail, Prasad has cited poor health and said no purpose would be served by keeping him in custody.
The Jharkhand High Court had granted bail to Prasad, 75, on April 22, 2022 in the Doranda treasury embezzlement case.
The former Bihar chief minister was sentenced to five years in prison and slapped with a fine of Rs 60 lakh by a special CBI court in Ranchi in February 2022 in connection with the fifth fodder scam case involving embezzlement of more than Rs 139 crore from the Doranda treasury.&nbsp;

The CBI will probe the case of sexual assault on two women who were stripped and paraded by a mob in Manipur and the government will seek its trial outside the state, officials said on Thursday.
The trial would be sought to be held in a court in neighbouring Assam, they said.
The officials also said the Union Home Ministry is in touch with both Meitei and Kuki groups and talks are in an advanced stage to restore normalcy in Manipur.
The nearly three-month-long ethnic violence in Manipur has claimed over 160 lives. A video of the May 4 incident involving the two women went viral over social media earlier this month, sparking nationwide outrage.
The opposition seized the opportunity to corner the Modi government over the issue which has rocked the Monsoon session of Parliament since it began on July 20.&nbsp;

sleuths Saturday raided the houses of TMC lawmakers Jibankrishna Saha and Bibhas Adhikari in Murshidabad and Birbhum districts of West Bengal respectively in connection with the school job recruitment scandal.
A CBI official said a team accompanied by CRPF personnel raided Saha's residence at Burwan in Murshidabad district and seized a bag full of documents suspected to be linked to the scam.
The bag was found from a jungle near Saha's house, the official said.
The central investigative agency also raided Adhikari's locked flat at Amherst Street in the city and the residence at Nalhati in Birbhum. The search lasted for more than four hours and papers and documents were confiscated from there too, he said.
Adhikari was present at his house in Nalhati town during the raid and was interrogated by the investigators.
Another CBI team also raided an ashram at Nalhati with which Adhikari is associated, the CBI official said.

In response, CBI counsel said the probe agency has 60 days' time to file the chargesheet and investigation will be seriously compromised if Sisodia is granted bail, NDTV reported.
Meanwhile, the court on Tuesday sought the Enforcement Directorate's response on a bail plea of former deputy chief minister Manish Sisodia in the money laundering case.
On March 17, the court extended the ED custody of the AAP leader by five days till March 22.
The ED arrested Sisodia on March 9 in the Tihar Jail, where he was lodged in connection with a Central Bureau of Investigation (CBI) case about alleged corruption in the formulation and implementation of the now-scrapped Delhi excise policy for 2021-22. The CBI arrested Sisodia on February 26.

The Central Bureau of Investigation (CBI) arrested a director of the Pearl Group on the intervening night of March 6 and 7 from New Delhi after he was deported from Fiji.&nbsp; The accused Harchand Singh Gill was deported from Fiji in connection with a multi-crore ponzi scam allegedly orchestrated by his company, according to officials.
He was deported from the island country under 'Operation Trishul', a program launched by the CBI to bring back Indian fugitives residing abroad, officials added.&nbsp;
The arrested accused will be produced on Tuesday before the Designated Court at Rouse Avenue District Courts, Delhi.
The agency started the investigation against the Pearls Group and its founder Nirmal Singh Bhangoo on February 19, 2014, on the allegations of cheating crores of gullible investors by offering them land in return for their investments.
