The Supreme Court emphasized that alimony should provide a reasonable standard of living for women, not equalize wealth between ex-spouses. It highlighted the misuse of laws as tools for harassment, and addressed financial demands in divorce settlements, ruling against indefinite support.

The court highlighted the importance of a balanced approach, considering not just the income of the husband, but also the wife&rsquo;s income, reasonable needs, and residential rights.

The Supreme Court on Thursday issued a crucial reminder that laws designed to protect women should not be misused to harass or extort husbands.
The court emphasized that alimony is meant to provide the dependent spouse with a reasonable standard of living, not to equalize financial disparities between former partners.
The judgment came in the context of a high-profile case involving tech professional Atul Subhas, who claimed that his estranged wife and her family had demanded a monthly maintenance of Rs 2 lakh, later increasing it to Rs 3 crore annually.
A bench of Justices BV Nagarathna and Pankaj Mitha, while dissolving the marriage on the grounds of irretrievable breakdown, directed the husband to pay Rs 12 crore as a full and final alimony settlement. The court stressed that maintenance should not be used as a tool for coercion or exploitation.
"The women need to be careful about the fact that these strict provisions of law in their hands are beneficial legislation for their welfare and not means to chastise, threaten, domineer or extort from their husbands," the bench remarked.
The wife had claimed her husband&rsquo;s net worth exceeded Rs 5,000 crore, with businesses and properties in both the US and India, and that he had paid his first wife at least Rs 500 crore during their separation, excluding a house in Virginia.
The court highlighted the importance of a balanced approach, considering not just the income of the husband, but also the wife&rsquo;s income, reasonable needs, and residential rights.
"We have serious reservations with the tendency of parties seeking maintenance or alimony as an equalisation of wealth with the other party. It is often seen that parties in their application for maintenance or alimony highlight the assets, status and income of their spouse, and then ask for an amount that can equal their wealth to that of the spouse," the court stated.
The bench further asked, "We wonder, would the wife be willing to seek equalisation of wealth with the husband if due to some unfortunate events post-separation, he has been rendered a pauper?"
The court also addressed concerns over the misuse of criminal complaints, noting instances where wives and their families use such complaints as leverage to pressure husbands and their families for financial demands.
The Supreme Court quashed the criminal cases filed by the wife against her estranged husband, sending a clear message about the need for fair and just use of legal provisions.

In a bizarre case, a man was allowed by a court to give Rs 55,000 in one and two rupee coins to his wife as maintenance dues for 11 months after his family brought the money filled in seven sacks to the court following his arrest for non-payment.
While the counsel for his wife objected to it, terming it &ldquo;mental harassment&rdquo;, the judge allowed the payment but asked the man to count the coins in court to make packets of Rs 1000 each and hand them over to her at the next hearing on June 26, according to lawyers from both sides. &nbsp;The couple's divorce case is being heard in a family court. The court had directed the husband, Dashrath Kumawat, to give the maintenance amount of Rs 5000 per month but he was not paying it for the last 11 months.
Dashrath, a resident of Harmada area in Jaipur, was arrested on June 17 after family court number 1 issued a recovery warrant against him for non-payment of maintenance.
&ldquo;Since the husband refused to give the amount, the police arrested him. The family court was closed due to holidays so he was produced in the link court of Additional District Judge (ADG)-number 8.
"In the court, the family members of Dashrath reached with coins worth Rs 55000 to give to his wife,&rdquo; Raman Gupta, the advocate of the husband, told PTI on Tuesday.
He said that the coins were in the denomination Re 1 and Rs 2 and were stuffed in seven sacks.
The advocate of his wife objected to this, but it was argued on behalf of the husband that these coins are legal tender and no one can refuse to accept them.
&ldquo;The court then allowed the husband to give the coins after counting them on the next hearing in the family court on June 26. Till then, the coins will remain in the custody of the court. The husband will have to count the coins and make packets of Rs 1000 each before handing them over to the wife in the court,&rdquo; he said.
Wife Seema Kumawat's advocate Ramprakash Kumawat said that giving coins to the woman was &ldquo;equal to mental harassment&rdquo;.
&ldquo;It was done in a preplanned manner just to harass the woman. However, the court has permitted him to give the coins,&rdquo; he said.&nbsp;

'They are not courts': Madras HC on 'Khula' certificates issued by private bodies like Shariat Council

"They are not courts or arbitrators of disputes. The courts have also frowned upon such practice...," the court held.

&nbsp;It is open for a Muslim woman to exercise her inalienable right to dissolve marriage by 'Khula' (divorce proceeding initiated by wife) by approaching a family court and not private bodies such as a Shariat Council, the Madras High Court has ruled.
Private bodies cannot pronounce or certify dissolution of marriage by Khula.
"They are not courts or arbitrators of disputes. The courts have also frowned upon such practice...," the court held.
Such Khula certificates issued by private entities are hence invalid. "Khula is the form of divorce conferred upon wife similar to talaq conferred upon the husband." In his judgement on a writ petition by a man who prayed for quashing the Khula certificate issued to his wife, Justice C Saravanan quashed the impugned certificate issued in 2017 by Shariat Council, Tamil Nadu Towheed Jamath
The Madras High Court granted an interim stay in Bader Sayeed Vs Union of India, 2017 and restrained bodies such as the respondents in that matter (Kazis) from issuing certificates certifying dissolution of marriage by Khula, the judgment said.

Observing that in modern social jurisprudence spouses are treated as equal partners, the Court said that the husband cannot claim any superior right over wife with respect to her body or individual status.
While marital rape is legal under the Indian Penal Code, the bench comprising of Justices A Muhamed Mustaque and Kauser Edappagath said that it was a form of cruelty and a good ground to claim divorce.
The Court was hearing a matter where the husband had challenged a family&rsquo;s court verdict in favour of his wife who had sought divorce.&nbsp; He had in turn filed a petition for restitution of conjugal rights which the court dismissed observing that he was treating his wife as money-minting machine and she was tolerating the sexual and mental harassment for the sake of marriage.
The High Court made several key observations such as-
&ldquo;Treating wife's body as something owing to husband and committing sexual act against her will is nothing but marital rape&hellip;&rdquo;
&ldquo;Marital privacy is intimately and intrinsically connected to individual autonomy and any intrusion, physically or otherwise into such space would diminish privacy&hellip;&rdquo;
