Terming the order as totally perverse, Additional Solicitor General Raju argued that the trial court arrived at the decision based on wrong facts.

While objecting the to trial court's bail to Chief Minister Arvind Kejriwal, Additional Solicitor General SV Raju, representing the Enforcement Directorate, highlighted procedural irregularities before the Delhi High Court on the 21st of June.
Terming the order as perverse, Raju argued that the trial court arrived at the decision based on wrong facts.
"The trial court's order is completely flawed. The court said there was no direct proof. That's a wrong statement by the court," Raju said before the bench comprising Justices Sudhir Kumar Jain and Ravinder Dudeja, according to NDTV.
The High Court, which temporarily suspended the bail order, indicated that a thorough examination of the ED's petition would be conducted before any further decisions are made. Earlier, the high court stayed the trial court bail order for Kejriwal in the money laundering case linked to the alleged excise scam.
The Enforcement Directorate (ED) mentioned its plea challenging the trial court order for an urgent hearing before a bench of Justices Sudhir Kumar Jain and Ravinder Dudeja, which said the case file would come to it in 10-15 minutes and after that, it will hear the matter.
The high court said till then the trial court order shall not be acted upon.
The ED has challenged the trial court&rsquo;s order passed on Thursday evening.
Additional Solicitor General S V Raju, representing the ED, sought a stay on the trial court order contending that the agency was not given a proper opportunity to argue its case.
The ED had arrested Kejriwal on March 21, shortly after the Delhi High Court refused to grant him protection from arrest on his petition challenging summonses issued to him.

The Enforcement Directorate has written to the Union Home Ministry alleging the Aam Aadmi Party, which rules Delhi and Punjab, has received more than Rs 7 crore foreign funds in contravention of the FCRA, official sources said Monday.
The federal probe agency sent the communication after it recovered some documents and emails during a drugs-linked money laundering probe against former Punjab AAP MLA Sukhpal Singh Khaira and some others.
The probe was launched in 2021 and Khaira was arrested by the ED that year. He is now with the Congress party.
Official sources said the ED had sent a detailed communication to the Union Home Ministry in August last year, underlining the alleged violations by the AAP and categorising these instances as contravention of the Foreign Contribution Regulation Act (FCRA) and The Representation of the People Act.
It is understood that the ED recently shared some fresh inputs in this case with the Ministry of Home Affairs (MHA).
Sources said the ED found the AAP received overseas donations of about Rs 7.08 crore till now and they allegedly "mis-declared and manipulated" the identities and nationalities of the foreign donors apart from some other details.
The agency has also informed the MHA about the verified names of the donors, their nationalities, passport numbers, amount donated, mode of donation and bank account number of the receiver, billing name, address, phone numbers, email, time and the date of donation and payment gateway used, the sources said.
Some fundraising events held by the AAP through its overseas wing volunteers in the USA and Canada between 2015 and 2016 are reported to have been made in alleged violation of the FCRA, the agency told the ministry.
Alleging violations in a particular instance, the ED also informed the MHA that the names of some Canada-based people and their nationalities had been "concealed" in the party's financial records to "hide" the foreign donations being made to the party into its Indian bank account.
A senior official said cases of FCRA violations are probed by the Central Bureau of Investigation (CBI) and the home ministry can write to it seeking an investigation into these charges made by the ED.&nbsp;

The Enforcement Directorate on Tuesday arrested Jharkhand minister Alamgir Alam's personal secretary Sanjiv Lal and the latter's domestic help following a recovery of over Rs 32 crore cash from them.
The duo have been taken into custody under the provisions of the Prevention of Money Laundering Act (PMLA) following their overnight questioning, the sources said.
The ED on Monday had raided a 2BHK flat in the city that is allegedly occupied by Lal's domestic help Jehangir, as part of a money laundering investigation into alleged irregularities in the state rural development department, they said.
It had recovered over Rs 32 crore cash apart from Rs 3 crore from some other premises that were searched by the central agency.
The total cash recovery stands at Rs 35.23 crore, the sources said.
Jharkhand rural development minister and Congress leader Alam had denied any wrongdoing on his part.

An Enforcement Directorate (ED) team reached Delhi Chief Minister Arvind Kejriwal's residence on Thursday evening, officials said, shortly after the high court refused to grant him protection from coercive action in an excise policy-linked money laundering case.
They said the agency team went to Kejriwal's residence to serve him a summons in the case. The team also informed the staff at the chief minister's residence that it has a search warrant, they said.
The Aam Aadmi Party (AAP) chief had earlier skipped multiple summonses of the agency in the case.
Earlier in the day, a Delhi High Court bench of Justices Suresh Kumar Kait and Manoj Jain refused to grant Kejriwal any protection from coercive action in the case.
The bench listed the AAP leader's application for further consideration on April 22 when his main petition challenging the summons is fixed for hearing, and asked the Enforcement Directorate to file its response.
The case pertains to alleged corruption and money laundering in formulating and executing the Delhi government's excise policy for 2021-22, which was later scrapped.
AAP leaders Manish Sisodia and Sanjay Singh are in judicial custody in the case.
Kejriwal's name has been mentioned multiple times in the charge sheets filed by the ED. The agency has alleged that the accused were in touch with Kejriwal for formulating the excise policy that resulted in undue benefits to them in return for which they paid kickbacks to the AAP.&nbsp;

The Enforcement Directorate (ED) on Friday morning conducted raids at the residences of West Bengal Fire and Emergency Services Minister Sujit Bose, TMC MLA Tapas Roy and former North Dumdum Municipality chairman Subodh Chakraborty in connection with its probe into the irregularities in recruitments in civic bodies.
Accompanied by central forces, ED officers conducted raids at two residences of Bose in the Lake Town area in North 24 Parganas district early Friday morning.
The central agency officers also raided Tapas Roy's BB Ganguly Street residence and Chakraborty's residence in Birati.
"We are conducting search operations at the residences of three TMC leaders in connection with the recruitments in civic bodies. We are also talking to the leaders," an officer told PTI.

The Enforcement Directorate (ED) arrested Bongaon Municipality's former chairman Shankar Adhya in the early hours of Saturday in connection with the alleged ration scam in West Bengal, officials said.
Adhya, a TMC leader in the North 24 Parganas district, was arrested from his residence in Simultola in Bongaon after searches were conducted by the agency at properties linked to him and his family members. These searches went on for at least 17 hours on Friday, they said.
Following the arrest, his supporters allegedly tried to block the investigators from taking him with them, besides hurling stones at their vehicles. The CRPF personnel who were accompanying the ED team had to baton-charge the mob to bring the situation under control, they added.
"Along with the searches, Adhya was also being questioned. He was arrested as his replies were not satisfactory," an ED officer said.
"After the arrest, his supporters, led by women, tried to stop the officers from taking him along with them. The accompanying CRPF personnel brought the situation under control," he said.
This was the second attack on the agency after the one in Sandeshkhali in neighbouring South 24 Parganas district on Friday. The ED said three of its officers suffered "grievous" injuries after a mob vandalised its vehicles during a raid at the residence of TMC leader Sahajahan Sheikh. The mob also snatched their personal belongings such as mobile phones and wallets.
Adhya is considered to be close to state minister Jyotipriyo Mallick, who was arrested in connection with the alleged scam last year.
Along with properties belonging to the TMC leader, the ED had conducted searches at the residences of his in-laws, his associates and an ice cream factory linked to them.
Besides documents, the ED seized around Rs 8 lakh in cash from the residence of the in-laws, the officer said.
Soon after his arrest, Adhya told reporters, "I'll cooperate with the ED and will help them in every possible way." He was brought to the ED office in Salt Lake in the early hours itself and will be produced at a court in Kolkata later in the day.&nbsp;

The Enforcement Directorate Tuesday said it has attached assets worth Rs 751.9 crore as part of its money laundering investigation against the Congress party-promoted Young Indian that owns the National Herald newspaper.
A provisional order has been issued under the Prevention of Money Laundering Act (PMLA) against the newspaper's publisher Associated Journals Ltd. and its holding company Young Indian, the central probe agency said in a statement.
"Investigation revealed that Associated Journals Ltd. (AJL) is in possession of proceeds of crime in the form of immovable properties spread across many cities of India such as Delhi, Mumbai and Lucknow to the tune of Rs 661.69 crore and Young Indian (YI) is in possession of proceeds of crime to the tune of Rs 90.21 crore in the form of investment in equity shares of AJL," it said in a statement.
The ED had questioned and recorded the statements of Congress' first family Sonia Gandhi, her son Rahul Gandhi and that of president Mallikarjun Kharge in this case.

ED has attached the properties under the Prevention of Money Laundering Act. The agency initiated an investigation based on a prosecution complaint filed by Directorate of Revenue intelligence (DRI) u/s 135 of the Customs Act, 1962 against Munjal and others for taking foreign exchange/currency out of India illegally.
The complaint alleges that foreign currency/foreign exchange equivalent to Rs 54 crore was illegally taken out of India. ED had carried out raids against Munjal in August and his companies.
The world's largest two-wheeler manufacturer reported a net profit of Rs 1,054 crore, which is 47% increase year-on year. Its net profit was at Rs 716 crore in the year-ago period.

ED grills former minister who is campaigning for separate Jammu state

&nbsp;Former Jammu and Kashmir minister Choudhary Lal Singh was questioned by the Enforcement Directorate for over 10 hours on Monday in a case against an educational trust run by his wife and former legislator Kanta Andotra, official sources said.
Scores of Singh's supporters led by his wife Andotra assembled outside the agency office and staged a protest against the ED summons to their leader. They claimed he was being harassed at the behest of the BJP.
Singh, the chairman of the Dogra Swabhiman Sangathan Party, reached the probe agency's office in Narwal at 10 a.m. for questioning for a second time in three days, sources said.
ED sleuths had questioned him on Saturday.
After over a 10-hour-long grilling, Singh came out from the ED office and addressed his supporters, claiming that he was a victim of political vendetta.
"Our fight for the legitimate rights of the Dogras will continue but the Dogras also need to come together," Singh, who is leading a campaign for the separate state comprising the Jammu region, said.
He said politics has witnessed a decline as political rivals are being harassed. &ldquo;We are not so weak to compromise and I am ready to face jail or death." Singh said his family had set up a trust to educate the children for their better future and had done no wrong.
Last month, the Enforcement Directorate conducted searches in Jammu and its adjoining areas as part of a money laundering probe against the educational trust of Andotra and a former government official in connection with alleged irregularities in land purchase to set up the trust.
The federal agency had raided about eight premises in Jammu, Kathua and Punjab's Pathankot on October 17 in the case against RB Educational Trust, its chairperson and Ravinder S, a former revenue official.
The money laundering case stems from an October 2021 charge sheet filed by the CBI in this case which alleged criminal connivance in the issuance of land between January 4 and January 7, 2011, without mentioning details in respect of violation of the ceiling limit of 100 standard kanals imposed under Section 14 of the Jammu and Kashmir Agrarian Reforms Act, 1976, thereby giving undue pecuniary advantage to trust.
Based on this, the trust acquired multiple pieces of land of about 329 kanals vide three gift deeds executed on January 5 and January 7, 2011, the CBI charge sheet claimed.
Singh's supporters staged a dharna outside the ED office throughout the day and chanted slogans in his support and against the BJP.
A delegation of Yuva Rajput Sabha led by its former president Rajan Singh Happy and members of the Gujjar and Bakerwal communities also visited the protest sight in support of Singh.
"It is simply a political vendetta as the BJP-led central government is using federal agencies against its opponents to harass, humiliate and defame them. They have nothing to prove against us and we are not going to bow down before the BJP," Andotra said.
"We will strengthen democracy and safeguard the interests of Jammu. We will not be cowed down by such steps," she said, claiming that the BJP wants to put her husband in jail.
The Dogra Swabhiman Sangathan Party's women wing president Suman Wazir alleged that Singh was being deliberately harassed as the BJP was feeling threatened by its potential opponents ahead of the Lok Sabha elections next year.
"Our leader has a spotless political career and this is the reason for us to come on the roads," she said.
Questioning the timing of the ED action, she said they do not have any objection to an investigation by the federal agency but the problem is that the BJP is using them to silence the opposition parties.

These assets are registered under the names of different entities, including Jetair Private Limited, Jet Enterprises Private Limited, Naresh Goyal, his wife Anita, and son Nivaan.
This action comes after the ED's investigation into a money laundering case involving Jet Airways. Naresh Goyal, the founder chairman of Jet Airways, was arrested earlier this year, and the ED subsequently filed a charge sheet against him.

The FIR alleged that the bank had sanctioned credit limits and loans amounting to ₹848.86 crore to Jet Airways, of which ₹538.62 crore remained outstanding.
During their probe, the ED discovered that Goyal had created various trusts abroad to siphon off funds from India. These illicit funds were used to acquire high-value properties in Mumbai, which were later sold. The investigation also revealed a complex network of Indian companies through which Goyal accumulated numerous immovable assets.
Additionally, the ED cited an audit report indicating that the loans obtained by Jet Airways were misappropriated for purchasing items like furniture, apparel, and jewellery. Shockingly, salaries of the Goyal family's residential staff and operational expenses of a production company belonging to Goyal's daughter were paid using funds from Jet Airways' accounts.

&nbsp;The Enforcement Directorate (ED) has summoned Delhi Chief Minister Arvind Kejriwal for questioning in an excise policy-linked money-laundering case on November 2, official sources said on Monday.
Kejriwal (55) has been issued the summons under the Prevention of Money Laundering Act (PMLA) and according to the sources, the agency will record his statement once he deposes before the investigating officer of the case in Delhi.
The ED has mentioned Kejriwal's name multiple times in its chargesheets filed in the case and said the accused were in touch with the Aam Aadmi Party (AAP) leader regarding the preparation and execution of the now-scrapped Delhi Excise Policy 2021-22.
In a related development, the Supreme Court rejected two separate bail pleas of former deputy chief minister and AAP leader Manish Sisodia in corruption and money-laundering cases related to the alleged Delhi excise policy scam and said a transfer of Rs 338 crore was tentatively established in the matter.

The Enforcement Directorate has summoned Rajasthan Chief Minister Ashok Gehlot's son Vaibhav Gehlot for questioning in a case related to alleged breach of foreign exchange law, official sources said on Thursday.
Vaibhav Gehlot has been asked to depose before the federal agency's office either in Jaipur or in New Delhi on Friday, they said.
The summons are linked to the recent ED raids against Rajasthan-based hospitality group Triton Hotels &amp; Resorts Pvt. Ltd., Vardha Enterprises Pvt. Ltd. and its directors and promoters Shiv Shankar Sharma, Rattan Kant Sharma and others.
The agency had searched the group and its promoters for three days in August at locations in Jaipur, Udaipur, Mumbai and Delhi.
Rattan Kant Sharma's alleged links with Vaibhav Gehlot are allegedly under the scanner of the ED and it is expected to question and record his statement under the Foreign Exchange Management Act (FEMA).
Unaccounted cash of Rs 1.2 crore was seized by the ED after these searches.

The Enforcement Directorate on Tuesday conducted raids against Hero Motocorp executive chairperson Pawan Munjal and others as part of a money laundering investigation, official sources told PTI.
The searches were carried out at premises located in Delhi and neighbouring Gurugram in accordance with provisions of the Prevention of Money Laundering Act (PMLA).
The investigation stems from a Directorate of Revenue Intelligence (DRI) complaint against a person, allegedly close to Munjal, who was investigated on charges of carrying undeclared foreign currency.
The Income Tax Department in March last year raided Munjal and his company Hero Motorcorp, the country's largest two-wheeler automobiles manufacturer, as part of a tax evasion investigation. &nbsp;Hero MotoCorp became the world's largest two-wheeler manufacturer in 2001, in terms of unit volume sales in a calendar year, and has maintained the title for the past 20 consecutive years.
The company has presence across 40 countries spanning Asia, Africa, and South and Central America.

The Supreme Court on Thursday granted an extension of tenure to Enforcement Directorate chief Sanjay Kumar Mishra till September 15 but made it clear there will be no further extension.
The Centre was seeking an extension in Mishra&rsquo;s tenure till October 15. A bench of Justices B R Gavai, Vikram Nath and Sanjay Karol said it was granting the extension in "larger public and national interest" but that Mishra will cease to remain ED chief from the midnight of September 15.
During the hearing, the top court questioned the Centre for seeking an extension and asked if the entire department is "full of incompetent people" except the incumbent chief.
"Are we not giving a picture that there is no other person and the entire department is full of incompetent people?" the bench told Solicitor General Tushar Mehta, appearing for the Centre.
The top law officer argued that the continuity of the ED leadership is necessary in view of the Financial Action Task Force (FATF) peer review whose rating matters.
Mehta said Mishra is "not indispensable" but his presence is necessary for the entire peer review exercise.
Representing the ED, Additional Solicitor General S V Raju said, "Some neighbouring countries want India to fall into FATF's 'grey list' and therefore, the ED chief's continuity is necessary".
The bench was hearing the Centre's application seeking the continuance of Mishra's tenure till October 15.
The top court had on July 11 held as "illegal" two successive one-year extensions granted to Mishra and said the Centre's orders were in the "breach" of its mandamus in the 2021 verdict that the IRS officer should not be given further term.
It had also curtailed Mishra's extended tenure to July 31 from November.&nbsp;

A bench of Justices BR Gavai, Vikram Nath and Sanjay Karol said in view of the peer review being conducted by the Financial Action Task Force (FATF) this year and to enable a smooth transition, Mishra's tenure will be till July 31.
The 1984-batch IRS officer was otherwise to remain in office till November 18, 2023, according to the notification issued by the government.
The bench, however, affirmed the amendments of the Central Vigilance Commission Act, and the Delhi Special Police Establishment Act to extend the tenure of ED director for a maximum of five years.
On May 8, the top court had reserved its verdict on a batch of pleas challenging the third extension of service granted to the Enforcement Directorate chief which was defended by the Centre on grounds of the peer review being conducted by the FATF.
The top court had on December 12 last sought the response from the Centre and others to a plea challenging the third extension granted to Mishra.
It had issued notices to the Union of India, the Central Vigilance Commission and the ED director on a plea filed by Jaya Thakur which accused the central government of destroying the basic structure of democracy by misusing the enforcement agencies against its political opponents.
The bench gave the verdict on a batch of petitions, including those filed by Congress leaders Randeep Singh Surjewala and Thakur, and TMC's Mahua Moitra and Saket Gokhale.
Mishra, 62, was first appointed the director of the ED for two years on November 19, 2018. Later, by an order dated November 13, 2020, the central government modified the appointment letter retrospectively and his two-year term was changed to three years.
The government promulgated an ordinance last year under which the tenure of the ED and CBI chiefs could be extended by up to three years after the mandated term of two years.&nbsp;
