Weeks after naming Aam Aadmi Party as accused in the Delhi excise policy case, the Enforcement Directorate is set to name another political party as an accused in a different money laundering case.
The ED is probing allegations of crores being siphoned at the CPI(M)-controlled Karuvannur cooperative bank in Thrissur. Multiple CPI(M) functionaries have been accused in the case.
Naming a political party in such a case is unusual. It was the first time in the history of the country's jurisprudence when AAP was made an accused in the excise case.
But how did this practice start?
In October last year, the Supreme Court had raised the question of making AAP an accused. But the court had later clarified that it was just a legal question. Moreover, the Delhi High Court recently held that a political party can be brought within the purview of the Prevention of Money Laundering Act.
If CPI(M) is named as an accused in the alleged cooperative bank scam, it will be just the second instance of such jurisprudence.

The Enforcement Directorate (ED) has attached properties worth over Rs 290 crore belonging to International Amusement Limited, as part of a money laundering investigation. Some of the attached properties are in Noida's popular GIP mall.
This company, the holding entity of International Recreation and Amusement Ltd. (IRAL), is under scrutiny for allegedly defrauding investors.
<h3>Money laundering case</h3>
International Amusement Limited is accused of collecting over Rs 400 crore from approximately 1,500 investors, promising them allotment of shops and other commercial spaces in Sector 29 and 52-A in Gurugram. However, the company failed to deliver on its promises, missing project deadlines and halting the assured monthly returns to investors.
The ED's statement alleges that the company siphoned off the investors' money, redirecting the funds to associated individuals and entities for personal use. It further claims that a back-dated agreement was executed between the promoter directors and the buying entity, EOD, to remove the business advance from IRAL's balance sheet. This maneuver allegedly allowed the departing directors to evade their responsibilities towards IRAL.
The directors and promoters of IRAL are accused of deliberately misappropriating over Rs 400 crore from the Gurugram project investors, with the intention of parking these funds in related entities. They then allegedly sold the company at low valuations to avoid investor liabilities.
Assets worth Rs 291.18 crore have been attached under the Prevention of Money-laundering Act. These assets include unsold commercial space measuring 3,93,737.28 sq ft at the Great India Place Mall (GIP) in Noida, commercial space of 45,966 sq ft held in the name of Adventure Island Limited in Rohini, and leasehold rights over 218 acres of land at Daulatpur village, Tehsil in Jaipur, held by International Amusement and Infrastructure Limited.
This attachment order was issued on May 28 as the investigation continues into the alleged financial misconduct and money laundering activities involving International Amusement Limited and its associated entities.

The Supreme Court Thursday held that the Enforcement Directorate (ED) cannot arrest an accused under Section 19 of the Prevention of Money Laundering Act (PMLA) after a special court has taken cognisance of the complaint of money laundering.
A bench of Justices Abhay S Oka and Ujjal Bhuyan said when an accused appears before a court in pursuance of a summons, the agency will have to apply to the court concerned to get his custody.
"If the accused appears before the special court by summons (issued by court), it cannot be treated that he is in custody," it said.
"Accused who appeared before the court pursuant to the summons not required to apply for bail, and thus twin conditions of Section 45 of PMLA not applicable," the bench said in its judgment.
The twin conditions state that when an accused in a money laundering case applies for bail, the court has to first allow the public prosecutor to be heard and only when it is satisfied that the accused is not guilty and unlikely to commit a similar offence when released, can bail be granted.
The apex court judgment was pronounced on a question of whether an accused in a money laundering case has to meet the stringent twin test for bail even in cases where the special court takes cognisance of the offence.&nbsp;

A Delhi court on Monday sent Chief Minister Arvind Kejriwal to judicial custody till April 15 in the excise policy-linked money laundering case.
Kejriwal was produced in the court of Special Judge Kaveri Baweja after his Enforcement Directorate custody came to an end.
The ED had sought 15-day judicial custody of Kejriwal, saying he was "totally uncooperative".
Speaking to reporters before entering court, the AAP leader said, "Whatever the prime minister is doing(referring to his arrest) is not good for the country".
AAP ministers Atishi, Saurabh Bhardwaj and Kejriwal's wife Sunita Kejriwal were present in court.
The federal probe agency had arrested Kejriwal on March 21 in connection with the case.
The next day, Special Judge Baweja remanded him in the custody of the ED till March 28.
Following this, the court allowed the ED's plea requesting extension of his custodial interrogation by four days till April 1.
In its remand application, the probe agency has accused the AAP leader of "being involved in the entire conspiracy of Delhi liquor scam, in drafting and implementation of the policy, for favouring and benefiting the quid pro receiving kickbacks and eventually using part of proceeds of crime generated out of the scheduled offence in the election campaign for Goa Assembly elections".

The Enforcement Directorate (ED) has filed its first chargesheet in connection with a money-laundering probe linked to alleged irregularities in the Delhi Jal Board (DJB), official sources said on Saturday.
The prosecution complaint was filed by the federal agency before a special Prevention of Money Laundering Act (PMLA) court in Delhi on March 28, the sources told PTI.
Four individuals and a company have been named as the accused in the chargesheet -- former DJB chief engineer Jagdish Kumar Arora, contractor Anil Kumar Agarwal, former NBCC general manager D K Mittal, one Tejinder Singh and NKG Infrastructure Limited.
The ED has alleged that bribe money generated from corruption in a contract issued by the DJB was "passed on" as election funds to the ruling Aam Aadmi Party (AAP) in Delhi. The agency had also summoned Chief Minister Arvind Kejriwal for questioning in the case, but he did not depose before it.
Kejriwal was arrested by the ED on March 21 in another money-laundering case linked to alleged irregularities in the excise policy for the national capital.
The agency had raided the premises of Kejriwal's personal assistant Bibhav Kumar, AAP's Rajya Sabha MP and treasurer N D Gupta, former DJB member Shalabh Kumar, chartered accountant Pankaj Mangal and some others as part of the probe in February.
An FIR lodged by the Central Bureau of Investigation (CBI), which accuses Arora of awarding a DJB contract to NKG Infrastructure Limited for a total cost of Rs 38 crore despite the fact that the company "did not meet" the technical eligibility criteria, is the basis of the ED case.
The ED arrested Arora and Agarwal in the case on January 31.
NKG Infrastructure Limited bagged the contract by submitting "forged" documents and Arora "was aware of the fact that the company does not meet the technical eligibility", the agency has claimed.
An ED statement has alleged that Arora "received" bribe in cash and in bank accounts after awarding the contract to NKG Infrastructure Limited and "passed on" the money to various people managing the DJB affairs, including "persons connected with the AAP".
"Bribe amounts were also passed on as election funds to the AAP," the federal agency has alleged.
This is the second case in which the ED has charged the AAP with taking kickbacks. It has alleged that bribe money of Rs 45 crore, out of the total of Rs 100 crore, from the scrapped excise policy of 2021-22 was used by the Kejriwal-led party for campaigning in the Goa Assembly polls.
The agency has said the DJB contract was awarded at "highly-inflated rates", so that the bribes could be collected from the contractors.
"As against the contract value of Rs 38 crore, only about Rs 17 crore were spent towards the contract and the remaining amount was siphoned off in the guise of various fake expenses.
"Such fake expenses were booked for bribes and election funds," the ED has alleged.
Delhi minister Atishi had denied the charges at a press briefing and claimed that the case was another attempt to tarnish the image of the AAP and its leaders.

The Enforcement Directorate on Tuesday said it has seized Rs 2.54 crore "unexplained" cash, including a part of it hidden in a washing machine, during searches in various cities linked to a case of alleged violation of the foreign exchange law.
The premises of companies like Capricornian Shipping and Logistics Pvt Ltd and its directors Vijay Kumar Shukla and Sanjay Goswami and associated entities Laxmiton Maritime, Hindustan International, Rajnandini Metals Limited, Stawart Alloys India Pvt Ltd, Bhagyanagar Limited, Vinayak Steels Limited, Vashishta Constructions Pvt Ltd and their directors/partners Sandeep Garg, Vinod Kedia and others were searched, it said in a statement.
The central agency did not say when these searches were executed at various locations in Delhi, Hyderabad, Mumbai, Kolkata, and Kurukshetra in Haryana.
It also did not mention where the cash kept in the washing machine was recovered.
The action was undertaken based on "credible information" that the entities were involved in sending foreign exchange outside India "on a large- scale" and made "suspicious" outward remittances amounting to Rs 1,800 crore to Galaxy Shipping and Logistics Pte Ltd. and Horizon Shipping and Logistics Pte Ltd, Singapore.
Both these overseas entities are managed by a person named Anthony De Silva, it said.
Capricornian Shipping and Logistics Pvt Ltd, Laxmiton Maritime along with its associates made outward remittances to the tune of Rs 1,800 crore to the Singapore-based entities in the garb of bogus freight services, imports and layering them through a web of complex transactions with the help of shell entities like Neha Metals, Amit Steel Traders, Triple M Metal and Alloys and HMS Metals.
During the search, unexplained cash amounting to Rs 2.54 crore, part of which was hidden in a washing machine, was found and all of this amount has been seized apart from various "incriminating" documents and digital devices.
A total of 47 bank accounts have been frozen as well, the ED said.&nbsp;

&nbsp;The Delhi High Court on Wednesday refused to interfere with the arrest of Chief Minister Arvind Kejriwal by the Enforcement Directorate in connection with a money laundering case linked to the excise policy 'scam'.
Justice Swarana Kanta Sharma issued notice on the AAP leader's petition challenging his arrest and the subsequent remand to the ED's custody, and asked the agency to file its response to it as well as his plea for interim relief of release before April 2.
The judge, in the order, clarified the matter would be taken up for final disposal on April 3 and no adjournment shall be granted.
"This Court deems it appropriate to issue notice of the main writ petition as well as application for grant of interim relief, returnable on 03.04.2024," the court said.
"The Directorate of Enforcement will ensure that replies are filed to the main petition as well as the application for interim release of the petitioner by 02.04.2024 and copies of the same are provided in digitized form as well as hard copy to the learned counsel for the petitioner," ordered the court.
Kejriwal, who was arrested on March 21 and subsequently remanded to the ED's custody till March 28 by a Delhi court, sought his immediate release on the ground that the arrest was illegal.
Senior advocate Abhishek Singhvi, appearing for Kejriwal, contended the arrest of a sitting chief minister on the cusp of elections was against the basic structure of the Constitution.
"Object of the arrest was not to find material but to disable me and my party. My prayer is, release me now," he argued.
Additional Solicitor General S V Raju, appearing for the ED, said the "bulky" petition was served upon them only on Tuesday, and time should be given to bring their stand on record.
For interim relief as well, appropriate time should be given to respond, he said.
On Friday, the trial court had remanded Kejriwal to the ED's custody till March 28 "for his detailed and sustained interrogation".
The ED arrested Kejriwal hours after the high court refused to grant him protection from coercive action by the anti-money laundering probe agency.

The AAP leader appeared before a Delhi court on March 16 and was granted bail on a bond of Rs 15,000.&nbsp;
The ED summoned Kejriwal for questioning 8 times but the Delhi chief minister did not appear before them.&nbsp;
The court of Additional Chief Metropolitan Magistrate Divya Malhotra also allowed Kejriwal to leave the courtroom.
"Offence being bailable, accused Arvind Kejriwal is admitted to bail," it said.

The Enforcement Directorate has issued a fresh summons to National Conference (NC) president Farooq Abdullah for questioning in a money laundering case pertaining to the Jammu and Kashmir Cricket Association (JKCA), official sources said Monday.
He has been asked to depose at the ED office in Srinagar Tuesday.
The 86-year-old politician was last called by the central agency in this case on January 11 but he did not appear before it.
He is not expected to appear at the Srinagar office of the central agency this time too, sources close to him said.
The ED investigation pertains to alleged financial irregularities at the Jammu and Kashmir Cricket Association.
The MP from Srinagar was charge-sheeted by the Enforcement Directorate in this case in 2022.
The case relates to siphoning off JKCA funds by way of transfer to various personal bank accounts of unrelated parties, including those of JKCA office-bearers, and by way of unexplained cash withdrawals from its bank accounts, the ED had said.
The agency's case is based on a 2018 charge-sheet filed by the Central Bureau of Investigation (CBI) against the same accused.&nbsp;

Jharkhand chief minister Hemant Soren has been arrested by the Enforcement Directorate after they questioned him at his residence on Wednesday in connection with an alleged land scam.
ED officials reached Soren's house in Ranchi on Wednesday afternoon to question him.
They had gone to his Delhi residence on Monday to question him but said he was 'untraceble'. ED also searched his Delhi house and seized Rs 36 lakh, an SUV and some "incriminating" documents.
Earlier, the ED had recorded the statement of the 48-year-old chief minister on January 20 under the Prevention of Money Laundering Act (PMLA). The investigation pertains to a "huge racket of illegal change of ownership of land by the mafia" in Jharkhand, according to the agency.
The ED has, so far, arrested 14 people in the case, including 2011-batch IAS officer Chhavi Ranjan who served as the director of the state's social welfare department and deputy commissioner of Ranchi.
Earlier on Wednesday, Hemant Soren filed a complaint against ED officials accusing them of harassment.
Soren alleged that the ED conducted the search operation at his residence in the national capital to "harass and malign him and his entire community", the officials said, quoting the FIR.
"An FIR has been lodged against some senior ED officials... we got the application from the chief minister," Ranchi Senior Superintendent of Police Chandan Kumar Sinha told PTI.
"My family members and I have suffered and experienced immense mental, psychological and emotional harm because of the acts committed...," Soren said in the FIR, according to the officials. The FIR has been lodged under sections of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act that include instituting false, malicious or vexatious suit or criminal or other legal proceedings against a member of a Scheduled Caste or a Scheduled Tribe besides intentionally insulting or intimidating "with intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe in any place within public view".
The sections also include abuse of any member of SC/ST by caste name in any place within public view or by words either written or spoken promoting feelings of enmity, hatred or ill-will against them by "whoever, not being a member of a SC or a ST".

Former Jharkhand chief minister Hemant Soren was arrested by the Enforcement Directorate after they questioned him at his residence on Wednesday in connection with an alleged land scam.
ED officials reached Soren's house in Ranchi on Wednesday afternoon to question him.
They had gone to his Delhi residence on Monday to question him but said he was 'untraceble'. ED also searched his Delhi house and seized Rs 36 lakh, an SUV and some "incriminating" documents.
Earlier, the ED had recorded the statement of the 48-year-old chief minister on January 20 under the Prevention of Money Laundering Act (PMLA). The investigation pertains to a "huge racket of illegal change of ownership of land by the mafia" in Jharkhand, according to the agency.
The ED has, so far, arrested 14 people in the case, including 2011-batch IAS officer Chhavi Ranjan who served as the director of the state's social welfare department and deputy commissioner of Ranchi.
Earlier on Wednesday, Hemant Soren filed a complaint against ED officials accusing them of harassment.
Soren alleged that the ED conducted the search operation at his residence in the national capital to "harass and malign him and his entire community", the officials said, quoting the FIR.
"An FIR has been lodged against some senior ED officials... we got the application from the chief minister," Ranchi Senior Superintendent of Police Chandan Kumar Sinha told PTI.
"My family members and I have suffered and experienced immense mental, psychological and emotional harm because of the acts committed...," Soren said in the FIR, according to the officials. The FIR has been lodged under sections of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act that include instituting false, malicious or vexatious suit or criminal or other legal proceedings against a member of a Scheduled Caste or a Scheduled Tribe besides intentionally insulting or intimidating "with intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe in any place within public view".
The sections also include abuse of any member of SC/ST by caste name in any place within public view or by words either written or spoken promoting feelings of enmity, hatred or ill-will against them by "whoever, not being a member of a SC or a ST".

The sources indicated that the visit could be linked to his fresh deposition in an alleged land fraud case in which the ED had questioned him at his official residence in Ranchi on January 20. The agency had issued fresh summons to him last week asking him to confirm his availability for questioning on either January 29 or January 31, sources had said.

Nineteen days after an Enforcement Directorate team was assaulted by a mob, ED sleuths again conducted a raid at the residence of absconding TMC leader Shahjahan Sheikh in North 24 Parganas district on Wednesday morning in connection with its probe into the alleged multi-crore ration distribution scam, an officer said.
Accompanied by over 120 personnel of the central armed police force, the ED officers broke open the collapsible gate of the residence of Sheikh in Sandeshkhali area in the presence of local police and two locals as witnesses, the officer said.
"We will search Sheikh&rsquo;s house today. We will also try to talk to the residents there", the ED officer told PTI.
After entering the house, the ED officers locked the gates from inside and started searches, he added.
On January 5, a team of ED officers were assaulted by a mob when they tried to enter the residence of the TMC leader.
Three officers were injured in the attack. The district police and Sheikh&rsquo;s family members had lodged a complaint against the ED officers.
Sheikh, however, is absconding till date.

The Enforcement Directorate said three of its officers suffered "grievous" injuries in a mob attack on its search team in West Bengal's North 24 Parganas district on Friday and their belongings such as mobile phones and wallets were robbed.
In an official statement issued late Friday, the federal agency said it has filed a complaint with the local police for registration of an FIR against the accused.
The ED team came under attack when they had gone to search the residence of Trinamool Congress (TMC) leader Sheikh Shajahan in Sandeshkhali in North 24 Parganas district in connection with a ration distribution scam.
"ED officials while discharging their duties were badly attacked by the crowd (suspected to be instigated by Sheikh Shajahan and his associates). Three officers have suffered grievous injuries as the mob marched towards the ED officials with an intention to cause death," the agency said.
The injured officials are being treated at a hospital, it said.
Other officers had to escape from the place without conducting the search to save their lives as the mob became "very violent" and even chased the officials so as to deter them from performing their official duty, it said.
"The mob also snatched, robbed, stole the personal/official belongings of the ED officials such as their mobile phones, laptop, cash, wallets, etc." "Accordingly, requisite complaint has been made to jurisdictional police for registration of FIR and necessary action against culprits," it said.
As soon as the search team arrived at the residence of Sheikh Shajahan, the door was found locked from inside and he refused to open the door.
The agency said its officers, with the assistance of CRPF personnel, were trying to get the door opened even by trying to contact the person concerned.
"His mobile location at that time indicated that he was inside this house. Thereafter, ED team was taken by surprise that within half an hour, a mob of around 800-1,000 persons started marching towards them with weapons in their hands such as lathis, stones, bricks, etc. and gheraoed the ED officials and CRPF personnel." "Suddenly, they started attacking the ED officials and CRPF personnel and started pelting stones and brick at them and attacked the officers as well as the 27 CRPF personnel with lathis and by using physical force and also raising/shouting slogans against the ED officers," it said.
The ED said the crowd also "badly" damaged vehicles that ferried the officers and security personnel.

ED officers were on Friday assaulted and their vehicles were damaged allegedly by supporters of TMC leader Sheikh Sajahan when they tried to raid his residence in West Bengal&rsquo;s North 24 Parganas district in connection with their probe into the ration distribution scam.
The ED officers are conducting raids at 15 places in the state during the day and Sajahan&rsquo;s house is one of them, an officer said.
A large number of TMC loyalists first gheraoed the ED officials and the central forces personnel who accompanied them when they reached Sheikh's residence in Sandeshkhali area in the morning and demonstrated before assaulting them and forcing them to leave the area, the officer said.
One of the officers suffered head injuries and had to be taken to a hospital, he said.
Sajahan is considered to be a close aide of state minister Jyotipriyo Mallick who was arrested in connection with the multi-crore ration distribution scam.
"This kind of attack is unprecedented. We have sent a report on Shiekh Sajahan to our Delhi office," the ED officer told PTI.
Sajahan&rsquo;s supporters attacked the officials and the central forces personnel when they tried to break the lock of the gate of his residence which was not opened by the TMC leader despite several calls made by them, he said.
Senior police officers including the SP of North 24 Parganas district did not communicate when the ED officers tried to contact them, he alleged.
The ED officers are conducting raids at 15 places in West Bengal in connection with the scam.

In a first, the Enforcement Directorate has named Congress leader Priyanka Gandhi in its charge sheet mentioning her role in purchasing an agricultural land measuring 40 kanal (five acres) in Haryana's Faridabad from a Delhi-based real estate agent HL Pahwa in 2006 and sold the same land to him in February, 2010.
According to the ED, the land was purchased in Amipur village in Faridabad from Pahwa-- the agent with whom Priyanka's husband Robert Vadra also purchased three pieces of land measuring 334 kanals (40.08 acres) in Amipur village from 2005-2006 and sold the same land to him in December, 2010.
The agent is the same person who also sold land to NRI businessman CC Thampi. The larger case involves fugitive arms dealer Sanjay Bhandari, who is under investigation by multiple agencies for money-laundering, violation of foreign exchange and black money laws, and the Official Secrets Act. He fled India for the UK in 2016. Thampi has been accused of facilitating Bhandari to hide proceeds of crime, along with Sumit Chadha, a British national.
ED has named Robert Vadra in its earlier charge sheet related to the case as an alleged close aide of Thampi.
In the fresh charge-sheet, it is mentioned that Pahwa was receiving cash out of the books for the purpose of acquisition of land. "It was also noticed that Robert Vadra did not pay the entire sale consideration to Pahwa."

The Enforcement Directorate claimed Friday it has recorded a statement of a 'cash courier' who alleged that the promoters of the Mahadev betting app have paid Rs 508 crore to Chhattisgarh Chief Minister Bhupesh Baghel till now and that it is a "subject matter of investigation".
The courier, Asim Das, has been arrested by the agency after it recovered Rs 5.39 crore from him in the poll-bound state.
The Mahadev online betting app and its promoters are being investigated by the ED under the anti-money laundering law.
"From the questioning of Asim Das, and from the forensic examination of the phone recovered from him, and examination of an email sent by Shubam Soni (one of the high-ranking accused of Mahadev network) many startling allegations have come forth, namely, that regular payments have been made in the past and so far around Rs 508 crore have been paid by Mahadev APP promoters to Bhupesh Baghel, Chief Minister of Chhattisgarh," the ED said in a statement.

Chhattisgarh goes to polls in two phases of November 7 and November 17.
