Petitions Against Places of Worship Act Up for SC Hearing Today

The Supreme Court of India will hear petitions challenging the constitutionality of the Places of Worship (Special Provisions) Act, 1991, which prohibits altering the religious character of worship places to their pre-1947 state and bars related legal proceedings.

A special bench, consisting of Chief Justice Sanjiv Khanna and Justices PV Sanjay Kumar and KV Vishwanathan, will deliberate on the matter at 3:30 pm today.

The Supreme Court of India is scheduled to hear petitions challenging the constitutionality of the Places of Worship (Special Provisions) Act, 1991, which prohibits the alteration of the religious character of places of worship to their pre-August 15, 1947 state. This law also disallows any legal proceedings aimed at reclaiming or altering such sites.
A special bench, consisting of Chief Justice Sanjiv Khanna and Justices PV Sanjay Kumar and KV Vishwanathan, will deliberate on the matter at 3:30 pm today. The petitions argue that the Act infringes upon the rights of Hindus, Jains, Buddhists, and Sikhs, preventing them from reclaiming places of worship and pilgrimage that were destroyed or altered by invaders.
Notable individuals, including Maharaja Kumari Krishna Priya of the Kashi Royal Family, BJP leader Subramanian Swamy, former MP Chintamani Malviya, and religious leaders such as Swami Jeetendranand Saraswati, have filed petitions against the Act. They contend that it violates the principles of secularism and deprives them of their right to manage, maintain, and restore sacred sites.
The petitioners also criticize specific provisions within the law, including Sections 2, 3, and 4, which they claim restrict religious practices and the right to judicial recourse. Section 3 bars the conversion of places of worship, while Section 4 prevents the initiation of lawsuits that seek to change the religious character of any place of worship from that of August 15, 1947.
The Jamiat Ulama-i-Hind, along with other Muslim organizations such as the All India Muslim Personal Law Board, has opposed the petitions, arguing that allowing these lawsuits would lead to widespread litigation targeting mosques across the country. The Anjuman Intezamia Masjid, responsible for managing the Gyanvapi mosque, has also intervened in the case to urge the dismissal of these pleas.
One of the petitioners raised concerns about the Act's exclusion of certain religious sites, claiming inconsistency in how the law treats different religious communities. The petitions also argue that the law unjustly limits the rights of Hindu, Jain, Buddhist, and Sikh communities while allowing Muslim communities to reclaim religious properties through separate provisions, such as those in the Waqf Act.
In essence, the petitioners contend that the Places of Worship Act not only violates several fundamental rights under the Constitution, including the rights to religious freedom, cultural heritage, and judicial remedy, but it also perpetuates an arbitrary and unjust status quo that prevents religious communities from reclaiming or managing their sacred spaces.

Amid a spike in pollution levels in Delhi-NCR, the Supreme Court on Tuesday directed Punjab, Haryana, Uttar Pradesh and Rajasthan to ensure that crop residue burning was stopped "forthwith".
A bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia said Delhi can't be made to go through this year after year.
"There cannot be a political battle every time," the bench told the counsel representing the Punjab government.
The court also directed the Delhi government to ensure that municipal solid waste was not burnt in the open.
While hearing a matter pertaining to air pollution in the Delhi-NCR, the bench flagged issues like crop residue burning, vehicular pollution and burning of waste in the open.
It has posted the matter for further hearing on Friday.
Pollution levels in Delhi were recorded in the "very poor" category on Tuesday morning after five consecutive days of severe air quality.
The concentration of PM2.5 - fine particulate matter capable of penetrating deep into the respiratory system and triggering health problems - exceeded the government-prescribed safe limit of 60 micrograms per cubic metre by seven to eight times in the capital.
It was 30 to 40 times the healthy limit of 15 micrograms per cubic metre set by the World Health Organization (WHO).
Several cities in neighbouring Haryana, Rajasthan, and Uttar Pradesh have also reported hazardous air quality. Ghaziabad recorded an AQI of 338, Gurugram 364, Noida 348, Greater Noida 439 and Faridabad 382.

The Supreme Court on Monday ordered the setting up of a committee of three former women high court judges to oversee the relief and rehabilitation of victims and compensation to them besides asking former Maharashtra police chief Dattatray Padsalgikar to monitor the probe in criminal cases.
The court said the three-member panel will be submitting reports to it directly. On the investigation of cases, the court said 11 FIRs will be transferred to the CBI.
The top court said to ensure there is a sense of faith, it will direct that at least five officers, not below the rank of deputy superintendents of police, be brought into the CBI on deputation from various states to oversee the probe.
It said as per the report placed before it by Attorney General R Venkataramani and Solicitor General Tushar Mehta, appearing for the Centre and the state government, about 42 state SITs will be looking at the cases which will not be transferred to the CBI.
The bench said for each of these SITs at least one inspector from another state be brought on deputation to the Manipur Police.
It said these 42 SITs should be supervised by six DIG rank officers who will come in from outside the state of Manipur.

A bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and Manoj Misra said it will take up the issue for consideration again on Thursday, and asked the counsel for the city government and the LG to apprise Kejriwal and Saxena of today's development in the court.
&ldquo;The two constitutional functionaries have to rise above political bickering and they should give a name for the DERC chairperson,&rdquo; the bench said.
The apex court had said on July 4 that it will examine the constitutional validity of a provision of the Centre's recent ordinance governing appointments such as that of the DERC chairperson even as the Delhi government informed the court the oath taking of Justice (retd) Umesh Kumar as chief of the national capital's electricity regulatory authority stands deferred.

The Supreme Court was hearing a petition filed by the AAP government challenging the nominations by the LG to the MCD.

The Supreme Court on Wednesday observed that giving the Lieutenant Governor the power to nominate aldermen in the Municipal Corporation of Delhi would mean that he can destabilise an elected civic body.
A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala made this observation while reserving its verdict on plea of the Delhi government challenging the LG&rsquo;s power to nominate aldermen in the MCD.
"Is the nomination of 12 specialised people in MCD is of that much concern to the Centre? Actually, giving this power to the LG would effectively mean that he can destabilise the democratically elected Municipal Committees because they (aldermen) will have voting powers also", the bench observed.
On Tuesday, the top court had asked about the "source of power" of the LG under the Constitution and the law to nominate aldermen to the MCD without the aid and advice of the elected government.

The Supreme Court has rejected the bail plea of former CMD of Amrapali Group of Companies Anil Kumar Sharma, saying he cheated thousands of home buyers and did not deserve any sympathy.
"You have cheated thousands of home buyers. You siphoned off their hard-earned money and their life savings. You do not deserve any sympathy," the bench said on Thursday.
The former CMD of the real estate group and other directors of the firm were arrested on the direction of the top court after the forensic audit report revealed that a large amount of home buyers' money was siphoned off by the management.
&ldquo;Yours is not a case of simple cheating. See the plight of thousands of home buyers. You cannot have our sympathy. You better enjoy being in jail... This court is very aware of what you did. You created the mess and we are not able to find a way out of it. A large number of home buyers are suffering," the bench said.

&nbsp;The Supreme Court Collegium headed by Chief Justice DY Chandrachud has recommended the names of four district judges for appointment as judges of the Madras High Court.
The collegium, which comprises Justices Sanjay Kishan Kaul and KM Joseph, recommended the names of R Sakthivel, P Dhanabal, Chinnasamy Kumarappan, and K Rajasekar.
The resolution dated March 21 stated that the recommendation made by the High Court Collegium on August 10, 2022, for the appointment of the four judicial officers as judges of the Madras High Court has the concurrence of the chief minister and the governor of Tamil Nadu.
The file was received from the Department of Justice on January 5 this year, it said.
"In order to ascertain the fitness and suitability of the above-named judicial officers for elevation to the high court.

The Supreme Court on Tuesday commuted the death sentence of a man, who had kidnapped and killed a seven-year-old boy in Tamil Nadu in 2009, to 20-year imprisonment, saying there was "possibility of reformation" even though he has committed a ghastly crime.
Calling on the Centre to reflect and respond to the issue, the&nbsp; top court pointed out if execution of the death penalty by hanging is "humane".
As per India Today, the observation were made during the hearing on a plea seeking a ban on the punishment of death by hanging.&nbsp;
The top court said even though the crime committed by the man is unquestionably grave and unpardonable, it is not appropriate to affirm the death sentence that was awarded to him.

A Caveat application is filed by a litigant to ensure that no adverse order is passed against them without being heard.
Kavitha, who is the daughter of Telangana Chief Minister K Chandrasekhar Rao, has approached the Supreme court saying that as per norms, a woman cannot be summoned for questioning before ED in office and her questioning should take place at her residence.
On March 15, the Supreme Court agreed to hear Kavitha's plea challenging the summons of the Enforcement Directorate (ED) on March 24.

The Supreme Court on Monday referred the pleas seeking legal validation of same-sex marriages to a five-judge constitution bench for adjudication, saying the issue is of "seminal importance".
A bench headed by Chief Justice D Y Chandrachud said the submissions on the issue involve an interplay between constitutional rights on the one hand and special legislative enactments, including the Special Marriage Act, on the other.
"We are of the considered view that it would be appropriate if the issues raised are resolved by a bench of five judges with due regard to Article 145 (3) of the Constitution. Thus, we direct the matter be placed before a five-judge Constitution bench," said the bench, also comprising Justices PS Narasimha and JB Pardiwala.
The court posted the matter for arguments on April 18 and said the proceedings will be live-streamed as is done in case of hearings before the constitution benches.
Appearing for the Centre, Solicitor General Tushar Mehta, urged the court to not cut short the arguments of either side, saying the verdict will affect the society as a whole.
The Centre has opposed in the top court a batch of petitions seeking legal validation of same-sex marriages, claiming they will cause &ldquo;complete havoc&rdquo; with the delicate balance of personal laws and accepted societal values.
In an affidavit filed before the apex court, the government submitted that despite the decriminalisation of Section 377 of the Indian Penal Code, the petitioners cannot claim a fundamental right for same-sex marriage to be recognised under the laws of the country.

The Supreme Court Friday said it will set up a three-judge bench to hear a plea of Muslim girl students to sit for examinations in Karnataka government schools while wearing hijab.
&ldquo;I will create a bench,&rdquo; said a bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala when a woman lawyer sought urgent hearing of the plea saying girls are on the verge of losing another academic year as the exams are being held in government schools which are not permitting wearing of headscarf.
Initially, the CJI said the matter will be listed for hearing after Holi vacations.
The examinations are scheduled to be held after five days, the lawyer said, adding, &ldquo;They have missed one year. They will miss another year.&rdquo; On being told by the bench that the matter has been mentioned on the last day before the vacation, the lawyer said it has been mentioned twice earlier.
Without specifying the date, the bench then said it will create the bench.
The matter was last mentioned for urgent hearing by lawyer Shadan Farasat on behalf of the students.
The court had said it will take a call on listing a plea for allowing Muslim girl students to sit for examinations in Karnataka government schools while wearing hijab.
Following the apex court's split verdict on the issue of ban on sporting the Islamic headscarf in educational institutions in Karnataka, girls in hijab are not being permitted to take the exams scheduled to begin from March 9, the bench was told.
On March 15, 2022, the high court had dismissed the petitions filed by a section of Muslim students of the Government Pre-University Girls College in Karnataka's Udupi seeking permission to wear the hijab inside classrooms, ruling it is not a part of the essential religious practice in the Islamic faith.

The Supreme Court on Friday rejected a plea seeking to gag the media from reporting on the Adani-Hindenburg issue till the court pronounces its order.
The apex court had reserved its order on February 20 on a batch of PILs on the recent Adani Group shares crash triggered by Hindenburg Research's fraud allegations.
A bench headed by Chief Justice DY Chandrachud declined the plea of advocate M L Sharma who mentioned the matter.
&ldquo;We are not going to issue any injunction to the media", the bench also comprising Justices PS Narasimha and JB Pardiwala said.

The Supreme Court Wednesday refused to stay the Election Commission order recognising the Eknath Shinde-led bloc as the real Shiv Sena and issued a notice to the group headed by the Maharashtra chief minister on the plea of the rival Uddhav Thackeray camp challenging the poll panel's decision.
A bench headed by Chief Justice D Y Chandrachud took note of the submissions of senior advocate Kapil Sibal, appearing for Thackeray, and sought response of the faction led by Maharashtra Chief Minister Shinde.
The counsel for the Shinde faction told the bench, also comprising Justices P S Narasimha and J B Pardiwala, that it will not issue any whip or initiate process to disqualify the lawmakers of the Thackeray faction in the meantime. &ldquo;All right, issue notice. The counter affidavit will be filed within two weeks,&rdquo; the bench said.
While issuing notice, the bench, however, refused to stay the decision of the poll panel acknowledging the Shinde faction as the real Shiv Sena, saying it cannot be done without hearing the other side.
The top court had on Tuesday agreed to hear the plea of the Thackeray camp against the Election Commission's decision.
Besides recognising the Shinde-led bloc as the real Shiv Sena, the poll panel had also ordered the allotment of the party's original 'bow and arrow' poll symbol to it.

The Supreme Court on Friday stayed the proceedings against Delhi Chief Minister Arvind Kejriwal in a case registered against him for allegedly making objectionable remarks against the BJP and Congress in Uttar Pradesh during the 2014 general elections.
Kejriwal has moved the apex court against an order of the Lucknow bench of the Allahabad High Court which had last month declined to discharge him in the criminal case pending before a trial court at Sultanpur.
In the FIR, Kejriwal has been accused of an offence under section 125 of the Representation of the People (RP) Act, 1951, which pertains to promoting enmity between classes in connection with elections.
His plea came up for hearing before a bench of Justices K M Joseph and B V Nagarathna.
The bench, which issued notice to the state of Uttar Pradesh on the plea, also stayed further proceedings in the matter till the next date of hearing.
The top court said the plea would come up for hearing after five weeks.

Big relief for AAP in Delhi mayor polls; SC says nominated members can't vote

The Supreme Court on Friday said the nominated members of the Municipal Corporation of Delhi (MCD) cannot vote in the mayoral election.
A bench comprising Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala directed that the election of the Delhi mayor shall be conducted at the first MCD meet and once elected, the mayor shall preside over the deputy mayor's election.
"We have heard the counsel for the parties. We are unable to accept the submission on behalf of the municipal corporation. The Constitution has imposed a restriction in terms of which nominated members do not have the right to vote. The prohibition on nominated members in the exercise of the right to vote applies on the first meeting.
"The notice for the election of mayor and the first meeting of the MCD shall be issued within 24 hours and the notice shall fix the date at which the elections of mayor, deputy mayor and standing committee members shall be held," the bench said.
The top court's order came on a plea moved by the ruling Aam Aadmi Party's (AAP) mayoral candidate, Shelly Oberoi, seeking an early conduct of the election.
The apex court had, on February 8, sought the responses of the lieutenant governor's (LG) office, MCD's pro-tem presiding officer Satya Sharma and others on Oberoi's plea.

"We will not accept the sealed cover suggestion by you because we want to maintain full transparency," the bench said.

The Supreme Court on Friday refused to accept in a sealed cover the Centre's suggestion on a proposed panel of experts for strengthening regulatory measures for the stock market.
Observing that it wants to maintain full transparency in the interests of investors, a bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala said it would rather not accept the Centre's suggestion in a sealed cover.
"We will not accept the sealed cover suggestion by you because we want to maintain full transparency," the bench said.
On February 10, the top court had said the interests of Indian investors need to be protected against market volatility in the backdrop of the Adani Group stock rout and asked the Centre to consider setting up a panel of domain experts headed by a former judge to look into strengthening the regulatory mechanism.
Till now, four PILs have been filed in the top court on the issue by lawyers M L Sharma and Vishal Tiwari, Congress leader Jaya Thakur and activist Mukesh Kumar.
Adani Group stocks have taken a beating on the bourses after the Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate.
The Adani Group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.&nbsp;
