The Uniform Civil Code will be implemented in Uttarakhand from January, Chief Minister Pushkar Singh Dhami said on Wednesday.
During a meeting of the Uttarakhand Investment and Infrastructure Development Board (UIIDB) in Dehradun, Dhami said that the state government has completed its "homework" and the UCC will be implemented across the state from January 2025.
With this, Uttarakhand will become the first state in the country to implement the Uniform Civil Code after independence.
On the last day of campaigning for the 2022 assembly elections, the chief minister had promised the people of Uttarakhand that if the BJP retained power, the UCC would be implemented in the state.
Dhami said that after the formation of the new government in Uttarakhand in March 2022, it was decided in the first meeting of the cabinet to form an expert committee to implement UCC in the state.
He said that a five-member expert committee was formed under the chairmanship of retired judge Ranjana Prakash Desai. On the basis of its report, the Uniform Civil Code, Uttarakhand, 2024 Bill was passed in the state assembly on February 7, 2024.
Dhami said that the Act was notified on 12 March 2024 after presidential assent.
He said that now the rules of the Uniform Civil Code Act have also been prepared and Uttarakhand is fully prepared to implement the UCC from January.
"The Uniform Civil Code Act of Uttarakhand will give a new direction to the society by following the basic spirit of 'Sabka Saath, Sabka Vikas, Sabka Vishwas. This law will open new doors of empowerment, especially for women and children of Devbhoomi," Dhami said.
Speaking in Rajya Sabha on Tuesday, Union Home Minister Amit Shah had said that UCC will be implemented in all BJP-ruled states.
Dhami instructed the officials to provide proper training and facilities to the personnel for the implementation of the provisions of UCC.
The chief minister said that keeping in mind the convenience of the common people, a portal and a mobile app have also been prepared so that facilities including registration and appeal can be made available online.

The Uniform Civil Code Bill, passed by the Uttarakhand Assembly on February 7, has become a law with President Droupadi Murmu giving her assent to it.
Uttarakhand is the first state in the country after Independence to adopt the UCC.
"It is a moment of great joy and pride for people of the state that the Uniform Civil Code Bill passed by our government in the Uttarakhand Assembly has been approved by the Honorable President Smt Droupadi Murmu," Chief Minister Pushkar Singh Dhami said in a post on X.
The President gave her assent to the Uniform Civil Code, Uttarakhand, 2024 under Article 201 of the Constitution of India on March 11, a gazette notification by the government of Uttarakhand said.
"With the implementation of the Uniform Civil Code law in the state alongside providing equal rights to all citizens, the oppression of women will also be curbed," Dhami said.
"#UniformCivilCode will play an important role in promoting harmony by proving the importance of social equality," he said.
The state government is determined to protect the interests of citizens and maintain the essential character of Uttarakhand in accordance with the vision of Prime Minister Narendra Modi, he added.
State BJP president Mahendra Bhatt also expressed happiness over the President's approval to the UCC.
"It will give equal rights to all citizens," he said.
Uttarakhand BJP media in-charge Manveer Chauhan said it is the fulfilment of a major commitment made by the party to the people of the state ahead of 2022 state assembly polls.

The Uniform Civil Code Bill tabled in the Uttarakhand Assembly on Tuesday mandates registration of &lsquo;live-in relationships,&rsquo; a failure of which would incur a jail term of up to 6 months.
Individuals in, or planning to enter, live-in relationships will have to register themselves with district officials once the UCC is implemented. Anyone in a live-in relationship for more than a month without making the declaration could face a jail term of up to three months, a fine of ₹ 10,000, or both. The maximum sentence for unregistered live-in couples is of six months or a fine of up to ₹25,000, or both.&nbsp;
Parental consent would be required for individuals below the age of 21 who wish to be in a live-in relationship. The relationship would not be registered if one partner is married or in another relationship or if one partner is a minor. Relationships that the Code deems to "against public policy and morality" will also not be registered.
The mandatory registration extends to residents of Uttarakhand who may be in a live-in relationship outside the State.
The UCC also lists down a procedure for legal "termination" of the registered relationship. It requires a written statement in a "prescribed format" and can invite police investigation if the reasons for ending the relationship deem "suspicious". Parents or guardians of those under 21 will also be informed in case of termination of a relationship.
On the flip side, the newly introduced Civil Code also ensures that children born out of live-in relationships be considered "legitimate".

Uttarakhand Assembly passed the Uniform Civil Code Bill on February 7, becoming the first Indian state to approve such legislation. As the bill now moves to the Governor for final approval, Uttarakhand CM Pushkar Singh Dhami celebrated the Assembly&rsquo;s decision.
The passing of the UCC bill, which refers to a common set of laws for all Indian citizens, is likely to push other BJP-ruled states to adopt similar legislation.
&ldquo;This law is of equality, uniformity and equal rights. There were many doubts regarding this but the two-day discussion in the assembly clarified everything. This law is not against anyone,&rdquo; CM Dhami said in a press conference after the bill was cleared by the Assembly.
Once the Bill gets the governor's consent, Uttarakhand will become the first state after independence to get a common law on marriage, divorce, land, property and inheritance for all citizens, irrespective of their religion.
Speaking on the Bill before its passage, Chief Minister Pushkar Singh Dhami said &ldquo;it is not an ordinary legislation. The Uniform Civil Code (UCC) will create equal laws for men and women across all faiths and will help create a non-partisan and non-discriminatory society,&rdquo; he said.
&ldquo;It will especially protect the rights of women and put an end to their exploitation. It fulfills a commitment we had made to the people of the state in the run-up to the 2022 assembly polls," the chief minister added.

Policy experts and women's rights activists hoped that marriageable age for men and women would be brought at par with each other at 21 years. The government, however, chose to retain the current norm of a lower marriageable age for women at 18 years.

Tribal populations will continue to be allowed to engage in outlawed practices like polygamy and child marriage, even as the bill claims to foster gender equality. Right to inherit land and property, irrespective of gender, will also remain alien to Scheduled Tribes.
All India United Democratic Front (AIUDF) leader Aminul Islam questioned a uniform code that excludes some sections of the society. "If Adivasis and Dalits are not included under this law then how is it going to be universalised,&rdquo; he asked.
Tribals like Tharu, Bhotiyas, and Jaunsari form 2.9% of Uttarakhand&rsquo;s population and are natives of border districts of Chamoli and Pithoragarh. They have been excluded from the UCC after the ruling BJP government faced backlash over fears that customs integral to the Tribal identity would be banned.

Opposition Congress MLAs on Monday walked out of a meeting of the Business Advisory Committee of Uttarakhand Assembly in protest against its decision to waive the Question Hour in the special assembly session to table a bill on the UCC.
Asked about the protest by the opposition members, Speaker Ritu Khanduri said, "UCC is a going to be a very important law, not just for Uttarakhand but for the whole country. The Question Hour is important too but sometimes things are so significant that take precedence over routine procedures of the House," Khanduri said.
Later in the day, a delegation led by Leader of Opposition in Uttarakhand Assembly Yashpal Arya met the governor and handed over a memorandum letter signed by all 19 Congress MLAs, including him, to register their protest and sought his intervention in the matter.

The Uttarakhand Cabinet cleared the Uniform Civil Code draft report during a meeting held at Chief Minister Pushkar Singh Dhami's official residence on February 4.
The bill will now be placed before the state legislative assembly on February 6. A special four-day session will begin on February 5.
Once implemented, Uttarakhand will become the first country in India to adopt a UCC law after independence. Goa is the only state where the uniform law has been in operation for many decades. It was introduced by the Portuguese in 1867 when it occupied the state.&nbsp;
The final draft of the UCC running into 740 pages in four volumes was submitted to Dhami here on Friday by a five-member panel headed by retired judge of the Supreme Court Ranjana Prakash Desai.
With the passage of the UCC bill, the BJP will be fulfilling a major poll promise made in the run-up to the 2022 Assembly polls, which saw the saffron party storm to power with a landslide victory for the second consecutive term - a feat achieved for the first time by any political party in the state which came into being in 2000.

After a nod from the state Cabinet, the draft will likely be tabled in the form of a bill before the assembly on February 6.
The details of the draft accessed by Indian Express show that it has excluded tribal populations from the purview of the law, because of their special status. Here's what the bill has suggested.

The Law Commission on Friday cautioned people against fraudulent WhatsApp messages and calls in its name pertaining to the Uniform Civil Code (UCC).
It urged people to "exercise caution" and rely on official sources, including its website, for accurate information.
In its disclaimer, the law panel referred to "certain WhatsApp texts, calls, and messages" being circulated pertaining to the UCC.
"It has come to notice that certain phone numbers are rotating among the individuals, falsely associating them with the Law Commission of India. It is clarified that the Law Commission has no involvement or connection with these texts, calls, or messages, and disclaims any responsibility or endorsement thereof," it said.
The Law Commission said it communicates through official channels, including its website and the Press Information Bureau.
"Individuals are encouraged to visit the official website of the Law Commission of India to access the public notice (seeking views on UCC) issued in this regard," it said.
The panel till recently had received 19 lakh responses on its public notice issued on June 14. People can send responses till July 13.

Uniform civil code has link with advancing ‘Hindu Rashtra' idea: Amartya Sen

The Law Commission had on June 14 initiated a fresh consultation process on UCC by seeking views from stakeholders, including public and recognised religious organisations, on the politically sensitive issue.&nbsp;

Nobel Laureate Amartya Sen has said the concept of the Uniform Civil Code, though not a new one, is a &ldquo;difficult issue&rdquo;.
The 90-year-old economist also said the UCC surely has a link with advancing the idea of &lsquo;Hindu Rashtra&rsquo;.
&ldquo;The Uniform Civil Code is a difficult and old issue. There are differences among us. There are differences of religions, there are differences in rules and customs. We need to remove those differences and be united.
&ldquo;I read in the newspaper that there should not be any more delay in implementing the Uniform Civil Code. No idea from where such a nonsense concept has come,&rdquo; Sen told reporters at his home here on Wednesday.
To a question, if the UCC has links with the idea of Hindu Rashtra, he said it surely has.
&ldquo;But Hindu Rashtra is not the only way for progress Hinduism is being misused,&rdquo; said the Bharat Ratna awardee.
The UCC refers to a common set of laws on marriage, divorce and inheritance that would be applicable to all Indian citizens irrespective of religion, tribe or other local customs.

According to the petitioners, their marriage was solemnized on June 8, 2022, as per Muslim rites and ceremonies. The High Court bench stated that the law is clear that the marriage of a Muslim girl is governed by the Muslim Personal Law.

UCC will be an important step in realising the dreams of the framers of Indian Constitution. It will give shape to the Constitution's aims. It will also be an effective step towards Article 44 of the Constitution which envisions uniform civil code for all citizens. On many occasions, Supreme Court has stressed on implementing UCC, and also expressed anger on lack of action on this front," he said.
Dhami reportedly said that the UCC would provide equal rights for all, enhance social harmony, and ensure gender justice.

The Allahabad High Court has called upon the Central government to initiate the process for of the Uniform Civil Code. The court stated that the Uniform Civil Code &ldquo;is a necessity and mandatorily required today&rdquo;.
Justice Suneet Kumar on November 18 said that the UCC &ldquo;cannot be made &lsquo;purely voluntary&rsquo; as was observed by Dr. B.R Ambedkar 75 years back.
The court directed the Centre to consider the constitution of a committee or commission for implementing the mandate of Article 44, as directed by the Supreme Court.
The court further added that a common civil code "will help the cause of national integration by removing disparate loyalties to laws which have conflicting ideologies".
"No community is likely to bell the cat by making gratuitous concessions on this issue. It is the State which is charged with the duty of securing a uniform civil code for the citizens of the country and, unquestionably, it has the legislative competence to do so,&rdquo; the court observed.
Justice Kumar made the observations while hearing a bunch of 17 petitions filed by inter-faith couples. The petitioners apprehended threat to their life and liberty at the hands of their parents, relatives and other family members in connivance of the State machinery.
