Bilkis Bano has challenged the remission of sentence and subsequent release of 11 convicts in the gangrape and murder case.

The Supreme Court said on 22 March 2023 that it would constitute a special bench to hear the petition filed by Bilkis Bano, who was gang-raped and whose family was murdered during the 2002 Gujarat riots.
Chief Justice of India DY Chandrachud said that he will look into constituting the bench later in the day.
Bilkis Bano has challenged the remission of sentence and subsequent release of 11 convicts in the gangrape and murder case. Besides the plea challenging the release of the convicts, the gang rape survivor had also filed a separate petition seeking a review of the apex court's May 13, 2022 order on a plea by a convict.
Seven members of Bilkis Bano's family were also killed during the 2002 Gujarat riots.
In its May 13, 2022 order, the apex court had asked the state government to consider the plea of a convict for premature release in terms of its policy of July 9, 1992 which was applicable on the date of conviction and decide it within a period of two months.

All 11 convicts were granted remission by the Gujarat government and released on August 15, last year.
Bano's review plea against the May 13, 2022 order, however, was dismissed by the top court in December last year.

The TMC MP added that Subrahmanyam had said, "Those who failed to protect innocent citizens are guilty of adharma. Rama… would have used his bow against the ‘Asura’ rulers of Gujarat.”

An editorial in the latest edition of 'Panchjanya' criticised the top court for issuing a notice to the Narendra Modi government over petitions regarding BBC's documentary on the 2002 Gujarat riots. The petitions had challenging blocking of links sharing the documentary.
The article said that the Supreme Court runs on Indian taxpayers' money for the sake of the country, but was being used as a tool by India's opponents to clear their way. The editorial also stated that all anti-national forces take advantage of the provisions of "our democracy, our generosity, and our civilisational standards," against us.
The Supreme Court last week dismissed a plea seeking the imposition of a complete ban on the BBC in India in the wake of the controversial documentary, terming the petition "entirely misconceived" and "absolutely meritless". Another set of petitions challenging the government's decision to block the documentary will be heard in April next.
On January 21, the government issued directions to block multiple YouTube videos and Twitter posts sharing links to the documentary.

The petitions have challenged a ban on the BBC documentary, after the government ordered blocking of links on YouTube and Twitter which shared the series.
A bench of justices Sanjiv Khanna and Justice M M Sundresh issued notices to the government and others on the pleas filed by veteran journalist N Ram, Trinamool Congress MP Mahua Moitra and activist lawyer Prashant Bhushan. It also issued a notice on the plea filed by lawyer M L Sharma.
The apex court also directed the Centre to produce original records relating to take down order.

A Gujarat court on 24 January 2023 acquitted 22 people in a case related to the 2002 post-Godhra riots. They had been accused of killing 17 members of a minority community, including 2 children in Delol village.
After the murder on 28 February 2002, the victims' bodies were burned to destroy evidence, as per the prosecution. Due to lack of evidence, Additional Sessions Judge Harsh Trivedi acquitted all 22 accused, 8 of whom died while the case was continuing.
Communal riots had broken out in different parts of the state a day after a bogie of the Sabarmati Express was torched by a mob near Godhra town in Panchmahal district on February 27, 2002, killing 59 passengers, most of them 'karsevaks' returning from Ayodhya.
An FIR (first information report) was lodged under Indian Penal Code sections pertaining to murder and rioting after the violence in Delol village. Another police inspector lodged a case afresh nearly two years after the incident and arrested 22 people for their alleged involvement in the riots.
The prosecution was unable to gather enough evidence against the accused persons, and even witnesses turned hostile, defence lawyer Gopalsinh Solanki said. The defence lawyer said the bodies of the victims were never found.
Police recovered bones from an isolated place on the banks of a river, but they were charred to such an extent that the identity of the victims could not be established, he said.

The two-part BBC documentary claims investigation of certain aspects relating to the 2002 Gujarat riots when Prime Minister Narendra Modi was the chief minister of the state.

Amid a raging controversy over UK broadcaster BBC's documentary on Prime Minister Narendra Modi, the show was screened at the University of Hyderabad by a group of students.
Varsity officials said on 24 January 2023 that the students did not take permission before screening the documentary, and the issue came to light after members of RSS' student wing ABVP complained, as per the news agency PTI. The documentary was screened on 22 January by a group of students under the banner 'Fraternity Movement- HCU unit'.
Hyderabad police said that no complaint has been filed so far.
On 23 January, the administration of Jawaharlal Nehru University (JNU) in Delhi told students to cancel plans of screening the documentary on campus.
The Centre had issued directions for blocking multiple YouTube videos and Twitter posts sharing links to the controversial BBC documentary "India: The Modi Question".
The two-part BBC documentary, which claims it investigated certain aspects relating to the 2002 Gujarat riots when Prime Minister Narendra Modi was the chief minister of the state, has been trashed by the Ministry of External Affairs as a "propaganda piece" that lacked objectivity and reflected a "colonial mindset".

The BBC series titled 'India: The Modi Question' claims to have investigated certain aspects of the 2002 Gujarat riots when PM Modi was the state CM. The Indian government has called the documentary a "propaganda piece" pushing a "discredited narrative".
The first of the two-part series, which aired on BBC Two last week, was categorised by the UK tax-payer-funded broadcaster as &ldquo;a look at the tensions between Indian PM Narendra Modi and India&rsquo;s Muslim minority, investigating claims about his role in 2002 riots that left over a thousand dead&rdquo;. Eleven sinister criminals - convicted in Bilkis Bano's gangrape and her family's murder case - were released from jail on 15 August 2022 under the Gujarat government's remission policy, according to news agency PTI.
In the violence following the 2002 Godhra incident, a pregnant Bilkis Bano and 4 other women members of her family had been gangraped. 14 members of Bilkis Bano's family had also been reportedly murdered.
Eleven convicts had been sentenced to life imprisonment by a special CBI court in Mumbai in January 2008. The verdict was upheld by the Bombay High Court.
After having spent over 15 years in jail, one of the convicts reportedly approached the Supreme Court for premature release. The apex court asked the Gujarat government to decide the matter, and subsequently a committee was formed.
The panel recommended remission for the 11 convicts, and the state government accepted it. On 15 August, the 11 convicts walked out of the Godhra sub-jail.

Setalvad was arrested in June 2022, a day after the Supreme Court upheld the clean chit given in riot-related cases to Narendra Modi, who was then Chief Minister of Gujarat.
