Chief Minister Arvind Kejriwal has contended before the Delhi High Court that he is a victim of "witch-hunt" by the ED and that cancellation of his bail granted by a trial court in the excise policy-linked money laundering case would tantamount to "grave miscarriage of justice".
Opposing the Enforcement Directorate's plea challenging his bail in the case, the embattled chief minister said discretionary orders of bail cannot be set aside merely on "perceptions and fanciful imagination" of the prosecution.
&ldquo;The order passed by the special judge granting bail was not only well reasoned but prima facie showed a due application of mind in considering as well as faithfully recording and dealing with &lsquo;relevant arguments and contentions raised on behalf of both the parties&rsquo;.
"Therefore, to cancel the order would tantamount to grave miscarriage of justice,&rdquo; Kejriwal said in his reply filed to the ED&rsquo;s petition.
The Aam Aadmi Party (AAP) national convener urged the high court to dismiss ED&rsquo;s petition and to vacate the June 25 interim order by which the trial court&rsquo;s June 20 decision granting him bail was stayed.
On Wednesday, Justice Neena Bansal Krishna, who was scheduled to hear the ED&rsquo;s plea, was informed by the counsel for the probe agency that they were served with Kejriwal&rsquo;s reply to their petition only late Tuesday night and the agency required some time to file a rejoinder.
While the probe agency&rsquo;s lawyer submitted that the copy of the reply was served to them at 11 pm on Tuesday, Kejriwal&rsquo;s counsel maintained that it was served to the investigating officer (IO) of the case at 1 pm.
Senior advocate Abhishek Singhvi, representing Kejriwal, mentioned the matter before the court, saying a specific time be fixed for the hearing as there is extreme urgency in the case.
However, Additional Solicitor General S V Raju, appearing for the ED, submitted that the agency was served with the reply copy of Kejriwal only on Tuesday night and they need some time to go through the response and file their rejoinder to it.
He contended that the documents are supposed to be served to the advocate appearing in the case and not the IO.
The court said it is not disputed that the ED was served with the reply copy on Tuesday and the agency was entitled to file a rejoinder to it. The court granted time to the ED to file its rejoinder and listed the matter for hearing on July 15.
Kejriwal, in his reply, contended that the arrest was "illegally made to harass and humiliate" a political opponent and there was no material in possession of ED on the basis of which further incarceration can be justified.
&ldquo;ED has implicated the respondent (Kejriwal) in a false and concocted story, no case is made out against the respondent and the arrest in the instant matter is absolutely illegal,&rdquo; the reply claimed.
It further said, &ldquo;The respondent is victim of witch-hunt and standard modus operandi adopted by ED to implicate its given targets wherein the ED uses illegal measures of pressurising the other co-accused and inducing them to make incriminating statement in lieu of &lsquo;no-objection&rsquo; by ED to the grant of bail of such co-accused&rdquo;.
Countering the ED&rsquo;s contention that it was not given adequate opportunity by the trial court to argue its case, Kejriwal said merely because the court had regulated and controlled the manner of proceedings or asked the ED&rsquo;s counsel to be brief can by no stretch of imagination be construed as curtailment of an opportunity.
&ldquo;All the submissions made by ED are not only untenable in law but also reflect their apathy, insensitivity and overbearing as well as overreaching attitude towards courts of law,&rdquo; the reply said.
The Delhi CM contended that no offence of money laundering was made out against him and his life and liberty must be protected from "unwarranted and unjustified violation" at the hands of the ED on the basis of a "false, malicious and motivated case".
"There exists no proof or material demonstrating that the AAP received funds or advanced kickbacks from the South group, let alone utilising them in the Goa election campaign. Not a single rupee was traced back to the AAP, and the allegations put forth in this regard are devoid of any tangible evidence, rendering them vague, baseless without any corroboration," the reply said.
It added there was no link established by the ED to claim that Rs 45 crore was transferred by the South group as advanced kickback which was then allegedly utilised by AAP in Goa elections.
On June 20, Kejriwal was granted bail by a trial court here on a personal bond of Rs 1 lakh.
The ED moved the high court the next day and contended that the trial court's order was "perverse", "one-sided" and "wrong-sided" and that the findings were based on irrelevant facts.
The high court, on June 21, imposed an interim stay on the trial court&rsquo;s bail order till passing of an order on ED&rsquo;s application for interim relief. It had issued notice and asked Kejriwal to file a reply to ED&rsquo;s petition.
On June 25, the high court passed a detailed order staying the trial court order.
Kejriwal was arrested by the ED and the CBI on March 21 and June 26 respectively in the money laundering and corruption cases.
The excise policy was scrapped in 2022 after the Delhi lieutenant governor ordered a CBI probe into alleged irregularities and corruption involving its formulation and execution.
According to the CBI and the ED, irregularities were committed while modifying the excise policy and undue favours extended to licence holders.

Judge Amitabh Rawat of the Delhi Rouse Avenue Court passed the order after hearing both the CBI and Kejriwal at length, reports the Bar and Bench outlet.

The CBI will produce Kejriwal before the concerned trial court on Wednesday, following which the Delhi CM may be arrested. This comes ahead of the Supreme Court&rsquo;s hearing on his bail in the ED&rsquo;s money laundering case.
Earlier, the Delhi High Court stayed the trial court&rsquo;s bail order for Kejriwal in the money laundering case linked to the alleged scam.
While pronouncing the order, the trial court held that the lower court did not "appropriately appreciate" the material placed before it by the Enforcement Directorate.
A vacation bench of Justice Sudhir Kumar Jain said the ED's contentions assailing the bail order required serious consideration.
"The Vacation (trial) Judge while passing the Impugned Order did not appropriately appreciate the material/documents submitted on record and pleas taken by ED and the averments/grounds as raised in the petition under section 439(2) of the Code require serious consideration," it said.
"Accordingly, the present application is allowed and the operation of the Impugned Order is stayed," the court said.
The trial court, presided over by vacation judge Niyay Bindu, had granted bail to Kejriwal on June 20 and ordered his release on a personal bond of Rs 1 lakh.

The Delhi High Court will pronounce on Tuesday its verdict on a plea by the Enforcement Directorate seeking a stay on the trial court order granting bail to Chief Minister Arvind Kejriwal in the money laundering case stemming from the alleged excise scam.
The order is scheduled to be pronounced at 2:30 p.m.
In his written submission filed on Monday, the AAP leader defended the bail order and asserted that no prejudice would be caused to the ED if he is released at this stage as he could be sent back to custody in case the high court subsequently decides to set aside the order.
Staying the operation of "the well-reasoned bail order" would amount to virtually allowing the petition for cancellation of the bail, Kejriwal argued.
A vacation bench of Justice Sudhir Kumar Jain had reserved the order on June 21 after the agency challenged the trial court's decision and put it in abeyance until the pronouncement.
The AAP national convenor, who was arrested on March 21 by the Enforcement Directorate (ED), could have walked out of Tihar jail had the high court not granted the interim relief to the central anti-money laundering agency.
The trial court granted bail to Kejriwal on June 20 and ordered his release on a personal bond of Rs 1 lakh, and imposed certain conditions, including that he will not try to hamper the investigation or influence the witnesses.
The ED has contended that the trial court&rsquo;s order was &ldquo;perverse&rdquo;, &ldquo;one-sided&rdquo; and &ldquo;wrong-sided&rdquo; and that the findings were based on irrelevant facts.
In a note filed on Monday in relation to the plea to stay the bail order, the ED said the decision did not consider the material demonstrating the AAP leader's "neck deep involvement" in the offence of money laundering linked to the alleged excise scam.
Kejriwal, in his written submissions, said the assertions of the ED are "palpably wrong, misleading and tantamount to subterfuge and misrepresentation".
"The repeated contention of the ED that it was not given a proper opportunity of hearing and/or all its contentions have not been dealt with warrant to be rejected at the outset. As stated, the order granting bail not only deals with all the relevant contentions of both the sides but also the reasons for grant of bail duly reflect a due and proper application of mind by the Learned Court on each and every aspect," he said.
It is not a case of perversity which is apparent on the face of the record, he submitted, adding the fact that he is a political figure who is opposed to the dispensation at the Centre, cannot be the ground for "cooking up" a false case against him and to deny him the due process of law.
"Respondent (Kejriwal) is gravely aggrieved by the stay order on his bail order which has rendered justice to be a casualty and the same ought not to be continued even for a moment any further," he said.
"The order passed by the Special Judge granting bail was not only well reasoned but prima facie showed a due application of mind in considering as well as faithfully recording and dealing with &lsquo;relevant arguments and contentions raised on behalf of both the parties&rsquo;. Therefore, to stay the order would tantamount to virtually allowing the petition at the threshold," he said.
On June 20, Special Judge Niyay Bindu, who sat as the vacation judge, granted bail to Kejriwal in the money laundering case, saying the Enforcement Directorate (ED) failed to furnish direct evidence linking him to the proceeds of crime in the money laundering case.
On June 21, the high court had put in abeyance the operation of the bail order till the pronouncement on the issue of stay and asked the parties to file written submissions by June 24.
Kejriwal has approached the Supreme Court against the interim stay on his bail.
On Monday, the top court fixed June 26 for hearing his plea, saying it would like to wait for the pronouncement of the high court order on the issue.

The Aam Aadmi Party (AAP) national convener, who was arrested by the Enforcement Directorate (ED) on March 21, could have walked out of Tihar jail on Friday had the high court not granted the interim stay relief to the federal anti-money laundering agency.
"Till the pronouncement of this order, the operation of the impugned order shall remain stayed," a vacation bench of the high court had said and asked the parties to file written submissions by June 24.
The high court had listed the plea for hearing on July 10.
The court had said it was reserving the order for two-three days as it wanted to go through the entire case records.
It also issued a notice to Kejriwal seeking his response to the ED's plea challenging the trial court's June 20 order by which he was granted bail.
Additional Solicitor General (ASG) S V Raju, appearing for the ED in the high court, had contended that the trial court&rsquo;s order was &ldquo;perverse&rdquo;, &ldquo;one-sided&rdquo; and &ldquo;wrong-sided&rdquo; and that the findings were based on irrelevant facts. The relevant facts, he claimed, were not considered by the special judge.
Seeking a stay on the trial court&rsquo;s order, Raju had contended that the ED was not given adequate opportunity to argue its case.
The ED&rsquo;s application for stay was vehemently opposed by senior advocates Abhishek Singhvi and Vikram Chaudhari, representing Kejriwal. They had submitted that Article 21 (protection of life and personal liberty) of the Constitution does not exist for the ED for which the liberty of a person figured low in priority.
Section 45 of the Prevention of Money Laundering Act (PMLA) says an opportunity must be granted to the public prosecutor to present his case but that opportunity was not granted to me, Raju had contended.
He had said the trial court did not even look at his reply on the ground that it was bulky and claimed that the trial court came to a conclusion that there was malafide on ED&rsquo;s part after considering wrong facts and wrong dates.
Singhvi had submitted that the ED argued for three hours and 45 minutes before the trial judge.
In its bail order, the trial court had held that prima facie, Kejriwal's guilt was yet to be established and that the ED had failed to furnish direct evidence linking him to the proceeds of crime in the money laundering case.

The judge ordered Kejriwal's release on a personal bond of Rs 1 lakh but imposed certain conditions before granting him the relief, including that he will not try to hamper the investigation or influence the witnesses.
The judge also directed Kejriwal to appear before the court whenever required and to cooperate with the investigation.
The judge had reserved the order earlier during the day after hearing the Enforcement Directorate (ED), which sought to link Kejriwal to the alleged proceeds of crime and co-accused, and the defence that claimed the prosecution has no evidence to nail the AAP leader.
Kejriwal's lawyers are likely to submit the bail bond before the court tomorrow, after which he would be released from Tihar jail.
One the other hand, the ED is also likely to challenge the bail order before a higher court in the coming days.
However, the grant of regular bail to the AAP national convenor will give his Aam Aadmi Party and its allies a stick to beat the Modi government with as, according to Section 45 of the stringent Prevention of Money Laundering Act (PMLA), bail can be granted only if the judge is prima facie satisfied that the accused has not committed the offence and that he is unlikely to commit any offence while on bail.
A detailed order, however, is awaited.
The ED had arrested Kejriwal on March 21, shortly after the Delhi High Court refused to grant him protection from arrest on his petition challenging summonses issued to him.
On May 10, the Supreme Court had granted interim bail to Kejriwal till June 1 to campaign in the Lok Sabha elections, saying he will have to surrender and go back to jail on June 2. Kejriwal had surrendered before Tihar jail authorities on June 2 and has been there since then.
The trial court had on June 5 denied him interim bail which he sought citing several ailments.&nbsp;

Meanwhile, &nbsp;Atishi on Sunday wrote to Police Commissioner Sanjay Arora requesting the deployment of personnel for patrolling and protecting major pipelines for the next 15 days, as the national capital grapples with a water crisis.
In her letter, the minister said Delhi is reeling under a severe heat wave and a water crisis.
"Due to shortage of water being received in the Yamuna, water production has fallen by around 70 MGD and many parts of Delhi are experiencing water shortage. In this situation, every drop of water becomes precious," the letter said.
The Delhi Jal Board has deployed patrol teams for the main water distribution network that carries raw water to the Water Treatment Plants (WTPs) and then from them to the main underground reservoirs in different parts of the city, Atishi said in the letter. "In addition, we have deployed teams under the supervision of ADMs to support in this work." The minister said that on Saturday the DJB's ground patrolling team reported a major leakage in its south Delhi Rising Mains -- the main water pipeline that carries water from Sonia Vihar WTP to south Delhi.
"This was near the DTL sub station in Garhi Medhu. Our patrolling team found that several large 375 mm bolts and one 12 inch bolt had been cut from the pipeline causing the leakage. The fact that several large bolts had been cut seems to indicate foul play and sabotage," the letter read.
Atishi requested Arora for deployment of police patrol and protect the city's major pipelines for the next 15 days and prevent "miscreants or people with ulterior motives" from tampering with water pipelines.
"At this juncture any foul play and sabotage will worsen the already difficult water shortage being faced by the people of Delhi," she wrote.
About the pipeline that was damaged, she said a maintenance team worked for six hours in one stretch and repaired the leak.

The Delhi High Court on Saturday ordered removal of a video recording of court proceedings related to Chief Minister Arvind Kejriwal in the excise policy case from social media platforms.
In the video, Arvind Kejriwal, the Aam Aadmi Party (AAP) national convenor, is seen addressing a trial court.
A bench of justices Neena Bansal Krishna and Amit Sharma issued notices to six people, including Sunita Kejriwal, and social media intermediaries X (formerly known as Twitter), Meta and YouTube on a petition alleging violation of the video conferencing (VC) rules of the Delhi High Court.
&ldquo;Prima facie it is observed that the court proceeding recording is violative of Rule 3(vi) of Delhi High Court Video Conferencing Rules, 2021 and cannot be permitted to remain in public domain,&rdquo; the bench said in its 6-page order.
The high court directed the social media intermediaries to forthwith take down the audio or video recording from their respective platforms.
During the hearing, the bench asked the respondents, including the six individuals, to take down the content from social media platforms.
However, the order uploaded on the court website said, &ldquo;The social media platforms namely X (formerly &lsquo;Twitter&rsquo;), Meta (formerly &lsquo;Facebook&rsquo;), Instagram and YouTube are hereby directed to remove forthwith the audio/ video recording from their respective platforms&rdquo;.
The court also mentioned the list of URLs to be removed and said it should be ensured that the audio/ video is not re-uploaded on their platforms till further orders.
The court passed an ex-parte ad-interim order and listed the matter for further hearing on July 9.
"Notice of the petition be issued to other respondent no.1 to 7, to be served through ordinary post and electronic mode, returnable for the next date of hearing. The order be communicated within 48 hours to the respondent (s)," the bench said.
The high court was hearing the petition filed by lawyer Vaibhav Singh.
In his petition, Singh claimed that when Arvind Kejriwal was produced before a trial court on March 28 after his arrest in the Delhi excise policy case, he chose to address the court in-person, and the video recording of the proceedings was posted on social media platforms which is prohibited under the High Court of Delhi Rules for Video Conferencing for Courts, 2021.
According to the Rules, there shall be no unauthorised recording of the proceedings by any person or entity.
The video was allegedly re-posted by Sunita Kejriwal and the others.
The petitioner told the court that YouTube had sent an e-mail saying that it had deleted the content on its platform.
In the public interest litigation (PIL), the petitioner sought the formation of an SIT to investigate and register an FIR against the alleged conspiracy of recording and sharing the audio and video of the court proceedings and putting the life of the trial court judge at high risk.
"Several members of the Aam Aadmi Party, including members of various other opposition parties, have intentionally and deliberately and with wilful intention to malign and manipulate the court proceedings done the audio and video recording of the court proceedings and circulated on social media platforms," the plea said.
It also sought a direction to conduct a thorough investigation to identify the individuals responsible for recording and sharing audio and video recordings of the court proceedings.
The plea sought to "punish the alleged contemnor as per the provisions of the Contempt of Courts Act, 1971, and impose strict penalties on the individuals found guilty of violation of VC Rules 2021 of this Hon'ble court, as per the provisions specified in law".
The petition urged the court to issue appropriate directives to social media platforms to prevent the recurrence of such unauthorised recordings and their subsequent dissemination and impose penalties for non-compliance of directions on any individual or entity.
Arvind Kejriwal was arrested in the money laundering case stemming from the Delhi excise policy 'scam' on March 21 and has been lodged in Tihar jail under judicial custody.&nbsp;

Senior BJP leader Vijay Goel on Saturday sent an ambulance to take Delhi Chief Minister Arvind Kejriwal to hospital for medical tests after the AAP leader claimed he might be suffering from some serious ailments.
Kejriwal moved the Supreme Court on May 26 seeking an extension of his interim bail by seven days on grounds that he has to undergo some medical tests, including a PET-CT scan. He claimed in his plea that he lost seven kgs in jail and that his ketone levels were "too high", a possible indicator of a serious ailment.
The police, however, stopped the ambulance and Goel en route to the chief minister's official residence in Civil Lines here.
The top court had on May 10 granted 21-day interim bail to Kejriwal, who was arrested in a money laundering case linked to the excise policy scam, to enable him to campaign for the Lok Sabha polls.
It had directed that Kejriwal, who is also the AAP national convenor, shall surrender on June 2, a day after the last phase of the seven-phase poll is over.
Goel alleged that Kejriwal was "creating drama" by citing health issues to gain people's sympathy.
"This ambulance was to take Kejriwal to any hospital where all his tests can be done within two to hours," he told reporters.
The former Union minister said the chief minister should stop "drama" and go with him for tests if he was concerned about his health.
Previously, AAP leader and minister Atishi in a press conference had claimed that Kejriwal lost 7 kgs of weight and his ketone level was also high and doctors said it could be a symptom of problem with his kidneys or even cancer.
A Delhi court is likely to hear later in the day an application moved by the chief minister seeking interim bail.
The Supreme Court registry on Wednesday refused the urgent listing of his plea seeking an extension of his interim bail by seven days for undergoing the medical tests, saying since Kejriwal was given liberty to move the trial court for regular bail, the plea was not maintainable.
The chief minister had sought an extension of his interim bail to undergo a host of medical tests, including a PET-CT scan, in view of "sudden and unexplained weight loss coupled with high ketone levels", which are indicative of kidney, serious cardiac ailments and even cancer.
