The Delhi High Court on Wednesday upheld an order of the Income Tax Appellate Tribunal (ITAT) refusing to stay a notice issued by the Income Tax department to the Congress party for recovery of outstanding tax of more than Rs 100 crore.
A bench of Justices Yashwant Varma and Purushaindra Kumar Kaurav said there was no reason to interfere with the ITAT&rsquo;s March 8 order.
The bench had reserved its order on Tuesday after hearing the submissions on behalf of the Congress and the I-T department.
The Congress approached the high court after ITAT dismissed the party's application seeking a stay on the February 13 notice of the I-T department initiating recovery proceedings against it.
The assessing officer had raised a tax demand of more than Rs 100 crore for the assessment year 2018-19 when the income was assessed to be more than Rs 199 crore.
The counsel for the Congress had urged the court to grant it some protection otherwise the party would collapse.
The I-T department&rsquo;s counsel had informed the court that the original tax demand stood at Rs 102 crore and together with interest it rose to Rs 135.06 crore. He said Rs 65.94 crore stands recovered now.
The tribunal had dismissed the stay application saying, "We do not find that the recovery notice under Section 226(3) of the Act issued by the assessing officer on February 13, 2024 is lacking in bona fides, so as to require us to intervene."&nbsp;
The party had earlier said the I-T tribunal order freezing its funds was "an attack on democracy" as it had come just ahead of the Lok Sabha elections.&nbsp;

The Delhi High Court ruled against a Central Information Commission's (CIC) order regarding the disclosure of information related to the PM CARES Fund to RTI applicant Girish Mittal.
The court ruled in favour of a petition filed by the IT department against the CIC order which directed the department to provide tax exemption details of the fund, stating that PM Cares Fund was a third party.&nbsp;
Justice Subramonium Prasad observed that the CIC does not have jurisdiction to direct furnishing of information provided for in Section 138 of the IT Act. The single-bench court further noted that the information should have been sought directly from the PM Cares fund.&nbsp;
Mittal had filed an RTI application before the IT department, seeking details of tax exemption given to PM Cares Fund between April 1, 2019, and March 31, 2020.

The court emphasized that while adults have the right to choose their relationships, they should be aware of the consequences involved.

A woman who is already married to someone else cannot claim to have been induced into a sexual relationship under the false pretext of marriage, the Delhi High Court has said while quashing a rape case against a man, also married, by his live-in partner.
Justice Swarana Kanta Sharma, in an order released on Thursday, noted the case involved two individuals who were both ineligible to lawfully marry each other but were living together pursuant to a "live-in relationship agreement", and the protection and remedies available under Section 376 (punishment for rape) of the Indian Penal Code cannot be extended to such a "victim".
The judge observed that a live-in relationship between two consenting adults, who are married to different partners, has not been made a criminal offence, and while the parties have the right to determine their own choices, both men and women should "remain conscious of the repercussions" of such a relationship.

The Delhi High Court on Friday refused to entertain a PIL seeking direction to the Centre and the Election Commission to make voting compulsory in parliament and assembly polls, saying it cannot force a person to vote.
"We are not lawmakers. We cannot pass such directions. Is there any provision in the Constitution that makes voting compulsory?&rdquo; a bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said.
The court warned the petitioner, advocate Ashwini Kumar Upadhyay, it would dismiss the petition with costs after which he withdrew it.
Upadhyay had filed the public interest litigation, saying compulsory voting will ensure every citizen has a voice, will improve the quality of democracy and secure the right to vote. The plea said low voter turnout is a persistent problem and compulsory voting can help increase the turnout, particularly among marginalised communities.

A day after shocking BJP and AAP came to blows in the MCD House over the election of civic body's standing committee, the Delhi High Court on Saturday stayed the re-election for six members of the Standing Committee of the Municipal Corporation of Delhi (MCD), which was scheduled for February 27.
Justice Gaurang Kanth, in a special hearing held on a court holiday, said prima facie it appeared that the mayor, who was also the returning officer, is conducting the re-election on Monday without declaring results of the previous poll held on February 24 which is in violation of regulations.
The high court said the regulations nowhere reflect that the Delhi mayor has authority to declare the election of Standing Committee members as null and void.

It issued a notice to the returning officer and others on two pleas challenging the decision to hold re-election without declaring the results of the earlier poll.

The Delhi High Court on Thursday reserved its order on an appeal by former Maharashtra chief minister Uddhav Thackeray challenging a single judge's decision dismissing his plea against an Election Commission interim order freezing the Shiv Sena name and election symbol.
Thackeray claimed that the single judge's November 15 order, by which it had also directed the EC to expedite the proceedings, is &ldquo;erroneous&rdquo; and liable to be set aside.
A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, after hearing arguments of counsels for both the parties, said, "We will pass appropriate orders." Senior advocate Kapil Sibal, appearing for Thackeray, submitted that the EC did not hear him while passing the freezing of symbol order.
"Never in the history of the commission, freezing order has been passed without hearing the party," he argued.
The single judge bench, in its order, had said that there was "no procedural infraction" in the EC's order freezing the Shiv Sena's name and election symbol following a "split" in the party.
It had said the commission passed the freezing order in view of urgency in respect of allotment of symbol on account of announcement of bypolls and the petitioner, who repeatedly took time to furnish necessary documents, now cannot allege violation of principles of natural justice and criticise the poll panel.
"There is a split between members of the 'Shiv Sena', a recognised political party in the state of Maharashtra. One group or faction is led by Eknathrao Sambhaji Shinde and the other by Uddhav Thackeray. Both claim to be the president of the original Shiv Sena party, and stake claim to its poll symbol of 'bow and arrow'," the single judge had noted in its order.
Thackeray, in his appeal, claimed that there was no dispute on the leadership of the party and that Maharashtra Chief Minister Eknathrao Sambhaji Shinde himself admitted that Thackeray is and continues to be the rightfully elected president of the Shiv Sena political party.
Therefore, it cannot be said that there are two rival factions of the Shiv Sena political party, he said.

A plea has been moved in the Delhi High Court seeking a transfer of investigation in the Shraddha murder case from Delhi Police to the Central Bureau of Investigation (CBI).
The plea, which has been moved by a practising lawyer of Delhi, stated that investigation by Delhi Police, in this case, cannot be efficiently carried out due to administrative/staff paucity as well as lack of sufficient technical and scientific equipment to find out the evidence and the witness as the incident had taken place about six months back.
It further stated that the minute and sensitive details of the investigation by the Delhi Police have been revealed to the public through the media. The presence of media and other public persons at the place of recoveries, court hearings etc. of any accused amounts to their interference with the evidence and witnesses in the present case.&nbsp;

The court's observation came while granting bail to a boy who married a 17-year-old girl and was subsequently apprehended under the Protection of Children from Sexual Offences (POCSO) Act.
It noted that in the present case, the girl was not coerced into the relationship with the boy, and it was clear from her statement that there was a romantic relationship between the two and the sexual act between them was consensual.

"In my opinion, the intention of POCSO was to protect children below the age of 18 years from sexual exploitation. It was never meant to criminalise consensual romantic relationships between young adults," said Justice Jasmeet Singh in the order.
"However, this has to be seen from the facts and circumstances of each case. There might be cases where the survivor of sexual offence, may under pressure or trauma be forced to settle," the judge added.
The court observed that a consensual relationship borne out of love should be of consideration while granting bail, and in the present case, it would be a travesty of justice to let the accused suffer in prison.
"Thus, this is not a case where the girl was coerced into the relationship with the boy. In fact, Ms. 'A', herself went to the applicant's house and asked him to marry her. The statement of the victim makes it clear that this is a romantic relationship between the two and that the sexual act involved between them was consensual," it said.
"Although the victim is a minor and hence, her consent does not have any legal bearing, I am of the opinion that the factum of a consensual relationship borne out of love should be of consideration while granting bail. To ignore the statement of the victim and let the accused suffer behind jail, in the present case, would otherwise amount to perversity of justice," the court added.
It directed that the accused be released on bail on a personal bond and a surety bond of Rs 10,000 each.
The court also asked the accused to join the investigation, surrender his passport and not indulge in any criminal activity.

The Delhi High Court recently dismissed a bail plea by a man accused of raping his fiance on multiple occassions, saying that merely because the parties were engaged did not mean that the accused could have sexually assaulted, beaten or threatened the victim.
Justice Swarana Kanta Sharma also pointed out that it was 'not a fit case for grant of bail as there were serious allegations of forcible abortion and sexual assault on several occasions by the petitioner accused on the pretext of their scheduled marriage.&nbsp;
An FIR was filed in July this year, after the accused petitioner and his family members refused to solemnize their marraige.&nbsp;
As per the FIR, the woman who had known the accused for a year got engaged with their families consent, and her ordeal began 4 days after the ceremony.&nbsp;
The woman has also alleged that the accused forcibly gave her pills to abort her consequent pregnancy.&nbsp;

The Delhi High Court Monday said a suit filed by several doctors' associations against Yoga guru Ramdev for allegedly spreading misinformation against allopathy amid the COVID-19 pandemic deserves consideration and cannot be &ldquo;thrown out&rdquo; at the first stage.
Justice C Hari Shankar said that the court needs &ldquo;to see if the complaint make out a case to be entertained&rsquo;
The court listed the matter on October 27 to enable the counsel for Ramdev to make his submissions.
The doctors&rsquo; association alleged that Ramdev was misleading the public at large by claiming that allopathy was responsible for the deaths of several people infected by COVID-19, and insinuating that allopathic doctors were causing the deaths of the patients.
Senior counsel Akhil Sibal, representing the associations, said that amid a pandemic, the Yog Gugu made unsubstantiated claims on Coronil being a cure for COVID-19. Sibal claimed that Ramdev's statements were not &ldquo;bonafide opinions&rdquo; but were made for marketing and commercial use and added that &lsquo;commercial speech comes with some responsibility&rsquo;
The court however observed that &lsquo;everyone has a right to commercial gain and that &lsquo;making a profit is not a public nuisance&rsquo;.

The ruling Aam Aadmi Party on Saturday claimed that the Centre has once again refused to allow the Delhi government to implement the scheme for doorstep delivery of ration on the basis of a complaint by ration shopkeepers.
AAP chief spokesperson Saurabh Bharadwaj alleged that it is a clear case of collusion between the BJP and the ration mafia.
The BJP said neither the party nor the Centre has any problem with the Delhi government scheme if it can arrange its own ration.
AAP dispensation had on Tuesday sent the file on the doorstep ration delivery scheme to Lt Governor Anil Baijal for his approval for the third time after the Delhi High Court last week allowed the government to conditionally implement it.
The Centre in a letter sent to the Delhi government's Food and Supplies Department, said that the doorstep ration scheme &lsquo;does not meet the norms of the National Food Security Act and hence the government of India does not allow it&rsquo;
Bharadwaj &nbsp;claimed the BJP-led central government is in contempt of the court as it has blocked the Delhi government's doorstep delivery of ration scheme despite clear orders of the high court allowing it.

AAP: Centre again denied permission to Delhi to implement ration delivery scheme

AAP has claimed that the Centre has once again refused to allow the Delhi government to implement the scheme for doorstep delivery of ration.

The Centre has said Delhi's doorstep ration scheme &lsquo;does not meet the norms of the National Food Security Act and hence the government of India does not allow it&rsquo;

The ruling Aam Aadmi Party on Saturday claimed that the Centre has once again refused to allow the Delhi government to implement the scheme for doorstep delivery of ration on the basis of a complaint by ration shopkeepers.
AAP chief spokesperson Saurabh Bharadwaj alleged that it is a clear case of collusion between the BJP and the ration mafia.
The BJP said neither the party nor the Centre has any problem with the Delhi government scheme if it can arrange its own ration.
AAP dispensation had on Tuesday sent the file on the doorstep ration delivery scheme to Lt Governor Anil Baijal for his approval for the third time after the Delhi High Court last week allowed the government to conditionally implement it.
The Centre in a letter sent to the Delhi government's Food and Supplies Department, said that the doorstep ration scheme &lsquo;does not meet the norms of the National Food Security Act and hence the government of India does not allow it&rsquo;
Bharadwaj&nbsp;claimed the BJP-led central government is in contempt of the court as it has blocked the Delhi government's doorstep delivery of ration scheme despite clear orders of the high court allowing it.

Delhi High Court on Friday granted bail to Preet&nbsp;Singh, accused of organising an event at Jantar&nbsp;Mantar&nbsp;last month where communal slogans were&nbsp;raised.&nbsp;
Singh&nbsp;was released on a personal bond of ₹50,000 with two sureties of the same amount.&nbsp;
As per video footage and Singh's&nbsp;phone records, the court said that&nbsp;Singh&nbsp;left the venue at around 2 PM while the communal slogans were raised at 4 PM.&nbsp;
It went on to add that right now 'it would not be appropriate' to decide whether words spoken by Singh&nbsp;will&nbsp;count as offensive under Section 153A IPC&nbsp;of hate speech.&nbsp;

The apex court bench demanded to know why the petitioners, who sought a halt on construction, singled out Central Vista when construction activities for other similar projects were also progressing.
The Court asked whether the appellants had conducted any research on other similar construction going on in the national capital.
It further observed that the project activities were proceeding in compliance with all protocols and said no interference with the Delhi High Court judgment was warranted.
