The Delhi High Court on Wednesday granted bail to student activist Sharjeel Imam in connection with a 2020 communal riots case involving allegations of sedition and unlawful activities.
Imam assailed a trial court order refusing to grant him bail even though he has undergone more than half of the maximum sentence that can be awarded to him in case of a conviction.
"Appeal is allowed," a bench of Justices Suresh Kumar Kait and Manoj Jain said after hearing the counsel for Imam and the Delhi Police.
According to the prosecution, Imam allegedly made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019 where he threatened to cut off Assam and the rest of the North East from the country.
Imam was booked in the case registered by Delhi Police's Special Branch, which was initially registered for the offence of sedition and Section 13 of UAPA was invoked later. He has been in custody since January 28, 2020 in the matter.
Imam had claimed before the trial court that he has been in custody for the last four years and the maximum sentence for the offence under section 13 (punishment for unlawful activities) of Unlawful Activities (Prevention) Act is 7 years, if convicted.
As per Section 436-A CrPC, a person can be released from custody if he has spent more than half of the maximum sentence prescribed for the offence.
The trial court, while refusing to grant him bail on February 17, had ruled that the accused's custody could be extended for a further period in "exceptional circumstances" after hearing the prosecution's case.
Imam is an accused in several cases arising from the communal riots of 2020, including the case concerning alleged larger conspiracy behind the violence. He is in judicial custody in the conspiracy case as well.

A Delhi court on Wednesday acquitted two people of the charge of causing grievous hurt to two police officials during the 2020 northeast Delhi riots, saying their identification was "shadowed with clouds of doubt".
Additional Sessions Judge Pulastya Pramachala was hearing a case against Abid Ali and Sheru alias Raja, who were accused of being part of a riotous mob that vandalised properties and pelted stones on the main Vijay Park Road during the communal riots on February 23, 2020.
According to the prosecution, an inspector and a head constable were injured in the incident.
"The whole process of identification of the accused persons by these two victims or injured (police) officials is shadowed with clouds of doubt," the court said, taking note of the evidence before it.
"I find merit in the argument of the defence that it could not have been a mere coincidence for both these witnesses to visit the police station without any purpose and find both the accused persons with the investigating officer (IO)," the judge said.
He said as the evidence regarding their identification was not "fool proof", it was not safe to rely on the testimonies of the two police witnesses.
"Hence, I find that both the accused persons are entitled to the benefit of the doubt," the judge said, adding, "The accused are acquitted of all the charges levelled against them in the present case." The Bhajanpura police station had registered an FIR against the duo under various penal provisions, including for unlawful assembly, voluntarily causing grievous hurt to deter a public servant from his duty and assault or criminal force on a public servant.

Delhi police on Wednesday moved Supreme Court challenging Delhi High Court's order granting bail to Pinjra Tod activists Devangana Kalita and Natasha Narwal and Jamia student Asif Iqbal Tanha, in connection with northeast Delhi violence case.
The court had on Tuesday granted bail to the trio who were in jail for a year for their alleged role in the riots.

A Delhi Court on Thursday granted bail to former JNU&nbsp;student&nbsp;Umar Khalid in a case related to the violence in Delhi on February 24, 2020 over the Citizenship Amendment Act (CAA) protests.
The court said that Khalid had been chargesheeted on insignificant material which is unwarranted, adding that there is no evidence of Khalid&rsquo;s presence at the scene of crime.
Opposing his bail, the prosecution had argued that many people related to the &lsquo;riotous mob&rsquo; are yet to be identified, but the Court said that Khalid cannot be incarcerated in jail for infinity just because others who were part of the mob have not yet been identified and arrested.
The charge sheet also accused Umar&nbsp;Khalid of &lsquo;criminal conspiracy&rsquo; in connection with former AAP counsellor&nbsp;Tahir Hussain and alleged that he had planned violence during the former US President Donald Trump's visit to Delhi. The court went on to say that it could not find any rationale in the act of the police involving Khalid in this isolated case for the offence of conspiracy.
The court, however gave him bail on several conditions - Khalid has been asked to furnish a personal bond of Rs 20,000, appear before the Court on every date of hearing, furnish his mobile number to the police upon his release from the jail and also install the &ldquo;Aarogya Setu App&rdquo;.
