It said that the song showing a mob holding photo of Delhi Chief Minister Arvind Kejriwal in jail casts aspersions on the judiciary.

The Election Commission on April 28 asked the Aam Aadmi Party to modify its Lok Sabha campaign song 'Jail ka jawab vote se'.
The Commission said the song likely to incite violence.
It said that the song showing a mob holding photo of Delhi Chief Minister Arvind Kejriwal in jail casts aspersions on the judiciary.
The poll body said that the song contains slanderous remarks and criticism of the ruling party BJP on the basis of unverified facts.

BJP received six times more funds than Congress in 2021-22; know which party got the least 

The Representation of the People Act stipulates that parties submit an annual report of contributions of over Rs 20,000 received from individual donors and entities.

The ruling BJP received Rs 614.53 crore as contributions, more than six times the funds garnered by the opposition Congress during fiscal year 2021-22.
The Congress received funds to the tune of Rs 95.46 crore, according to Election Commission data.
The Trinamool Congress, which is in power in West Bengal, received Rs 43 lakh as contributions during the period while the CPI-M, which is in government in Kerala, received funds of Rs 10.05 crore.
The West Bengal assembly polls were held in March-April, 2021. In Kerala too, assembly election were conducted in April, 2021.
The four national parties had recently filed their latest contributions reports to the Election Commission which made the documents public on Tuesday.

Electoral trusts, including Prudent Electoral Trust, have been major contributors to the BJP's kitty.
The Aam Aadmi Party, which is in power in Delhi and Punjab and is a recognised state party in three states, has reported to the poll panel that it received Rs 44.54 crore during the financial year 2021-22.
It has shown an expenditure of Rs 30.30 crore in its latest audit report submitted to the commission in October this year. Besides Delhi and Punjab, it is a recognised state party in Goa.&nbsp;

In its letter, the EC said, "The Commission notes that the consequences of inadequate disclosures by political parties get attenuated by the fact that elections are held frequently, providing opportunities for political parties to indulge in competitive electoral promises, particularly in multi-phase elections, without having to spell out their financial implications more particularly on committed expenditure." The poll panel said it is of the considered view that with adequate disclosures on the financial implications of the promises made, the Indian electorate will be able to exercise informed poll choices.

The proposed proforma seeks details of revenue generation ways (through additional tax, if any), rationalising expenditure (cutting some schemes, if so required), impact on committed liabilities and/or raising of further debt and its impact on Fiscal Responsibility and Budget Management Act (FRBM) limits.
The model code is a document which guides the EC in ensuring level playing field for all political parties and candidates during elections.
The EC noted that as of now most political parties do not submit to the EC their poll declarations in time.
The letter said, "The choice to cast the vote ... is directly and intricately linked to access to timely and, reliable information. It is in this background that timely availability of data-points to assess financial viability of the promises made to voters in the election manifestos assumes criticality." The poll panel said it is of the considered view that with adequate disclosures on the financial implications of the promises made, the Indian electorate will be able to exercise informed poll choices.
"Although implementation of election promises could have several ramifications, the Commission proposes to confine the disclosures to only the financial implications of the promises in terms of the financial resources required...," the letter said.

They said the poll panel agrees in principle with the point of view that framing of manifestos is the right of the political parties.
Parties have been asked to send their views on the proposed changes in the poll code by October 19. It said if no response is received by then it will be presumed the party has nothing specific to say on the issue.
Drawing upon his experience with the Finance Commission, RBI, and the budget process as a Union finance secretary, CEC Kumar pushed for the electoral reform for not only bringing about a standardised disclosure proforma for guidance of political parties and candidates, but also ensuring authentic information to the voters to assess financial viability of election promises.

The Supreme Court Tuesday allowed the Election Commission to go ahead with the hearing of Maharashtra Chief Minister Eknath Shinde group's plea seeking recognition as the real Shiv Sena and allocation of the party's bow-and-arrow poll symbol to it.

The Election Commission on Sunday issued the "Certification of  Election" to NDA candidate Jagdeep Dhankhar as the 14th vice president of India.

Dhankhar won with a huge vote share of 74.36 per cent, the highest in the last six vice-presidential elections, with 528 votes against Alva's 182 votes.

The Election Commission on Sunday issued a certificate announcing the election of NDA candidate Jagdeep Dhankhar as the 14th vice president of India. Chief Election Commissioner Rajiv Kumar and Election Commissioner Anup Chandra Pandey signed the "Certification of the Election" of Dhankar.
A signed copy of the certificate was handed over to the Union Home Secretary by senior Deputy Election Commissioner Dharmendra Sharma and Narendra N Butolia, senior Principal Secretary in the EC, the poll panel said. It will be read out at the time of oath taking ceremony of the new vice president on August 11.
The term of incumbent M Venkaiah Naidu ends on August 10. Dhankhar won with a huge vote share of 74.36 per cent, the highest in the last six vice-presidential elections, with 528 votes against Alva's 182 votes.

The fresh plea has been filed in a pending petition by Subhash Desai, the general secretary of the Shiv Sena and seeks the nod of the top court to make the poll panel also a party.&nbsp; The Thackeray faction has also written to the poll panel requesting it not to go ahead with the plea of the Shinde faction in view of the pendency of a batch of petitions in the top court.&nbsp;
The plea terms the plea of the rival Shinde group to get the poll sybmol and the tag of the real Shiv Sena as an act of &ldquo;desperation&rdquo;.&nbsp;

The Thackeray group filed representation before the EC last week after the Shinde faction of the Shiv Sena had written to the Commission seeking allocation of the party's 'bow and arrow' election symbol to it, citing the recognition granted to them in the Lok Sabha and the Maharashtra Assembly.&nbsp;
The top court on July 20 had said the petitions filed by the Shiv Sena and its rebel MLAs during the recent Maharashtra political crisis raised constitutional issues including split, the merger of a political party, defection, and disqualification which may require consideration by a larger bench.&nbsp;
The bench headed by Chief Justice N V Ramana, meanwhile, had extended the operation of its July 11 order by which it had asked Assembly Speaker not to proceed with a plea seeking disqualification of MLAs of Thackeray faction as sought by the Shinde group on grounds of defying the party whip during the trust vote and the election of the speaker.&nbsp;
The bench is seized of as many as six pending pleas about the recent political crisis in Maharashtra that led to the fall of the Maha Vikas Aghadi (MVA) government in the state.&nbsp; The first one was filed by the Shinde faction during the summer vacation when some rebel Sena MLAs moved before it challenging the disqualification proceedings initiated by the deputy speaker.&nbsp;
The rest five pleas have been filed by the Thackeray faction. The Shiv Sena split last month when more than two-thirds of the party's MLAs withdrew their support from the Maharashtra government led by Uddhav Thackeray, throwing their lot with Shinde.&nbsp; Shinde was sworn in as the Maharashtra chief minister on June 30 with support of the BJP.&nbsp;

Simply put, the Model Code of Conduct is a set of directive guidelines expected to be abided by political parties, their candidates and campaigners to ensure free and fair elections

Implemented and ensured by the Election Commission, the Code goes into effect the day the polls are announced and stays into effect till the results are formally declared

Divided into 8 provisions, the Code deals with the general conduct, meetings, processions, polling day conduct, polling booths, observers, regulation of parties in power and election manifestos

For example, under the General Conduct, the Code prohibits candidates from any activity which may aggravate or cause tension between different communities. It prohibits appeal to caste or communal feelings for securing votes. It asks parties and candidates to refrain from criticism of opposing candidates’ private lives, unverified allegations or distortions. Candidates are asked not to distribute liquor or sway voters with freebies

For Meetings and Processions, the Code dictates that the parties or candidates should inform
local police authorities of the venue and time of any meeting well in time

In order to ensure that the government machinery is not exploited by the ruling government, the Code prohibits ministers from using official equipment, employees or modes of transportation to promote interests of any political party or candidate

It prohibits transfer or posting of officials directly or indirectly involved in the election's conduct

Misuse of media and advertisement at the cost of public exchequer is also prohibited

The Code says that the ruling government may not lay any new ground for projects or schemes if no work has begun on it

The goal is to prevent election malpractices and corrupt activities

The Model Code of Conduct went into effect on 8th January in Uttar Pradesh. By January 19, just 11 days, 143 cases were already filed against different candidates for violation of the code

Congress’ Nadeem Javed and Samajwadi Party’s Imran Masood were the early birds

In less than 72 hours of the Code being into effect, over 9 lakh campaign items such as posters, banners, hoardings etc were removed. 10,007 licensed arms were deposited with the police department, 9 were confiscated and 4 were cancelled

Excise department seized 6,588 litres liquor worth ₹15.58 lakh

That sounds like the Code works right?

Well…

Violation of the code in itself is not punitive

First, the Code is not enforceable by law. Certain provisions can be enforced by using other statues of the Constitution

Second, the Election Commission has no judicial capacity to penalise the violators

For example, bribing voters is both a Code violation and illegal activity under the Indian Penal Code

The Commission can only send a show-cause notice to a candidate on the charge of indulging in bribery. The candidate then has to reply to EC in writing either accepting or rebutting the charge

An FIR is more effective to cease illegal activity

The Code also does not specify the severity of punishment for different violations. 72 hour ban for a hate speech or less? 24-hours or more for a convoy without permit?

Also, once the results are out, it becomes difficult to follow prosecution for electoral offences

This arbitrary nature of the Code has always emboldened parties and individuals into violating the code without any fear of repercussions

The solution has often been touted as a legal status for the Code, i.e turning the Model Code of Conduct into law

However, the Election Commission remains reluctant - and they have a good argument. Not being under a statute gives them the advantage of ‘quick’ action. They are the judiciary and the executive - it allows minimal interference from the legislature.

But, does a moral obligation to play by the book works in the UP playground?

We repeat, an ambitious and difficult goal.

In the March of 1950, a civil servant in West Bengal is commissioned with a herculean task. Appointed as the chief election commissioner, Sukumar Sen is entrusted to orchestrate the first ballot for 176 million strong electorate of newly independent India
He succeeds. The largest electorate in the world exercises its democratic right to vote
10 years later, election officials and political parties in Kerala come together during the assembly elections and pen down a DOs and DON&rsquo;Ts list for electioneering
Add 2 more years and Chief Election Commissioner K.V.K. Sundaram circulates this brief to all parties contesting in the 1962 Lok Sabha election
This list - a moral obligatory set of rules gets consecrated as the&nbsp;&lsquo;Model Code of Conduct for Guidance of Political Parties and Candidates&rsquo;
The evolution of the Code continues. In 1979, an additional section gets added that outlines monitoring of conduct of the &lsquo;parties in power&rsquo;
But it is under the iron-handed administration of Election Commissioner T.N Seshan that cements the mould. Under Seshan&rsquo;s electoral reforms, the Code is for the first time effectively implemented in the 1991 General Elections
30 years later, we struggle with effective implementation, scrutinising the very existence of the Code
It is after all, a moral set of rules. And when the game is who-gets-the-UP-throne, rules get broken

Simply put, the Model Code of Conduct is a set of directive guidelines expected to be abided by political parties, their candidates and campaigners to ensure free and fair elections
Implemented and ensured by the Election Commission, the Code goes into effect the day the polls are announced and stays into effect till the results are formally declared
Divided into 8 provisions, the Code deals with the general conduct, meetings, processions, polling day conduct, polling booths, observers, regulation of parties in power and election manifestos

With the third wave of Covid-19 continuing in many parts of the country, the Election Commission extended the ban on physical rallies and roadshows in five poll-bound states. However, the EC added a caveat for constituencies going to polls in the first and second phases. The election watchdog has reportedly extended the rally ban till January 31. Certain relaxations have been allowed for the seats voting on February 10 and 14, as per reports. For phase 1, relaxations for public meetings have been allowed from January 28. This reportedly means that candidates will be able to do public meetings in designated open spaces with up to 500 people or 50% of the ground capacity or as per state rules. For the second phase, relaxations will be allowed from February 1. For door-to-door campaigning, the limit of 5 people has been raised to 10, excluding security personnel, as per reports.&nbsp; The move came after the EC held a meeting with the Union Health Secretary and Chief Health Secretaries of the states heading for elections.
