Pankaj's family alleged that the toilet was constructed using substandard material in 2016, and when their son was playing outside on Saturday noon, the wall collapsed on him and he died on the spot.

A 5-year-old boy in Uttar Pradesh's Lakhimpur Kheri was buried alive allegedly after the wall of a toilet collapsed on him. The March 11 incident took place when the boy was playing outside the government-built washroom in Chapartala village of Magalganj, India Today reported.
Pankaj's family alleged that the toilet was constructed using substandard material in 2016, and when their son was playing outside on Saturday noon, the wall collapsed on him and he died on the spot.
The family further blamed the village head and village secretary for using poor-quality materials in construction. Meanwhile, the deceased's body was sent for an autopsy. A police case was yet to be registered, India Today reported.
According to a Times of India report, the government-built toilet was constructed under Swachh Bharat scheme.

During the hearing on January 19, the top court had observed that an accused should not be incarcerated for an indefinite period unless proven guilty of an offence.

Union minister Ajay Kumar Mishra's son Ashish was granted bail by the Supreme Court on 25 January 2023. Mishra secured relief for 8 weeks but cannot live in UP or Delhi and its nearby areas, as per reports.
He is an accused in the case of deaths of 4 farmers in Uttar Pradesh's Lakhimpur Kheri on 3 October 2021. Police have said that Ashish Mishra was present in the car which allegedly mowed down 4 farmers during a protest. Subsequently, the driver of the car, 2 BJP workers, and a journalist were lynched allegedly by angry farmers.
On 26 July 2022, the Allahabad High Court had rejected the bail plea of Ashish Mishra. He had challenged the high court's order in the apex court.
During the hearing on January 19, the top court had observed that an accused should not be incarcerated for an indefinite period unless proven guilty of an offence. While reserving its order on the plea, the bench had said it is a case of balancing the rights of the parties.
Opposing the bail plea, Additional Advocate General for Uttar Pradesh Garima Prashad had said it was a grave and heinous crime and granting bail will send a wrong signal to society. Senior advocate Dushyant Dave, appearing for those opposing the bail plea, had said enlarging Mishra on bail will send a terrible message to society.

'Will take 5 years to finish': Lakhimpur Kheri trial judge tells Supreme Court

In a report submitted to the apex court, the additional sessions judge said there are 208 witnesses, 171 documents and 27 forensic science laboratory (FSL) reports in the case.

It might take at least five years in the normal course to conclude the trial in the Lakhimpur Kheri violence case, a sessions judge conducting the trial in the case in which Union minister Ajay Kumar Mishra's son is one of the accused, informed the Supreme Court on Wednesday.
In a report submitted to the apex court, the additional sessions judge said there are 208 witnesses, 171 documents and 27 forensic science laboratory (FSL) reports in the case.
The top court had last month asked the sessions court how much time in normal course was it likely to take to conclude the trial, without compromising with the schedule of other pending or prioritised matters.
"The report says it will take at least five years. It says there are 208 witnesses, 171 documents and 27 FSL reports," said a bench of Justices Surya Kant and V Ramasubramanian while referring to the report received from the trial court judge.
"He (sessions judge) says in normal course, it may take five years," observed the bench, which is hearing a plea by Ashish Mishra seeking bail in the case of mowing down of protesting farmers in October 2021 in Lakhimpur Kheri.
During the hearing, the bench asked the counsel appearing for the Uttar Pradesh government to confirm whether the four accused in a separate case lodged over the killing of three occupants of the SUV, which allegedly mowed down four farmers in the incident, are still in custody.
At the outset, advocate Prashant Bhushan, appearing for the complainant in the case of the killing of farmers, requested the bench to post the hearing for some other day, saying senior advocate Dushyant Dave who is leading him in the matter is unwell.
The bench inquired from the state's counsel about the status of the separate case lodged over the killing of three occupants of the SUV, which allegedly mowed down farmers.
The counsel said charges have been framed against the accused in that matter.
"We just want to know if there are accused in that case who have been arrested?" the bench asked. The state's counsel said four accused were arrested in the case.
Senior advocate Mukul Rohatgi, appearing for Ashish Mishra, told the bench that the trial judge has sent a report to the apex court.
When the bench said as per the report of the additional sessions judge, it may take at least five years in the normal course to conclude the trial, Bhushan said material witnesses can be examined first.
"The problem is the report says when the case was fixed for examination of prosecution witnesses, one of the material witnesses was to be examined but he got fever and was unwell on that day...These practical difficulties may arise," the bench pointed out.
It said if the trial in the case is asked to be speeded up, it will have to be done at the cost of all other cases pending in that court.
Bhushan said day-to-day trial is needed in this case being probed by a special investigation team.

When he alleged that some witnesses were attacked and beaten up, Rohatgi shot back, saying: "This is completely false." "What we need is, how many persons were arrested in FIR no.220/2021 (separate case) and are they still in custody," the bench observed and asked the state to apprise it about the particulars of those arrested in that case.
Rohatgi said, "It is our case. Our case is that our convoy was attacked...It is a case of mob violence. People were pulled out of our vehicle and three of them were killed." The bench observed that ultimately, the larger interest and larger issue will have to be kept in mind and fixation of time sometimes can create serious prejudice to the prosecution's case.
Bhushan, while arguing that the accused in the case of mowing down of farmers are influential, suggested the apex court can ask the trial court to hold day-to-day trial and examine material witnesses first.
He said the complainant has annexed the charge sheet of the case in the counter affidavit filed in the apex court.
The bench posted the matter for further hearing on January 19.
On October 3, 2021, eight people were killed in Tikunia in Lakhimpur Kheri district during violence that erupted when farmers were protesting against the then Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya's visit to the area.
Four farmers were mowed down by an SUV in which Ashish Mishra was seated, according to the Uttar Pradesh Police FIR.
Following the incident, the driver and two BJP workers were allegedly lynched by angry farmers. A journalist also died in the violence.
On December 6 last year, the trial court had framed charges against Ashish Mishra and 12 others for the alleged offences of murder, criminal conspiracy and others in the case of death of the protesting farmers in October 2021 in Lakhimpur Kheri, paving the way for the start of the trial.
A total of 13 accused, including Ashish Mishra, have been charged under IPC sections 147 and 148 related to rioting, 149 (unlawful assembly), 302 (murder), 307 (attempt to murder), 326 (voluntarily causing grievous hurt by dangerous weapons or means), 427 (mischief) and 120B (punishment for criminal conspiracy), and section 177 of the Motor Vehicle Act.
The other 12 accused are Ankit Das, Nandan Singh Bisht, Latif Kale, Satyam alias Satya Prakash Tripathi, Shekhar Bharti, Sumit Jaiswal, Ashish Pandey, Lavkush Rana, Shishu Pal, Ullas Kumar alias Mohit Trivedi, Rinku Rana and Dharmendra Banjara.
All of them are in jail.
While hearing the matter on December 12 last year, the apex court had asked the state government, which opposed the bail plea of Ashish Mishra terming the offence as "very grave", to file an affidavit with regard to the status of the case lodged over the killing of three occupants of the SUV.

A UP court on Tuesday framed charges against Ashish Mishra and 13 others in connection with the killing of four farmers and a journalist at Tikunia in Lakhimpur Kheri district of Uttar Pradesh on October 3 last year.
Ashish Mishra Monu, son of Union Minister of State for Home Ajay Kumar Mishra, is the main accused in the case.
District government counsel (Criminal) Arvind Tripathi told PTI the court of additional district judge Sunil Kumar Verma fixed December 16 as the next date of hearing.

Six men were arrested on Thursday in connection with the alleged rape and murder of two teenage Dalit sisters who were found hanging from a tree in sugarcane field here, police said.
Police sources said the post-mortem report revealed that the girls, aged 15 and 17, were raped and then strangled. The bodies were found hanging about a kilometre away from their home on Wednesday.
The Opposition has slammed the state’s BJP-led government over law and order, with Congress leader Rahul Gandhi on Thursday saying, "Women's safety cannot be expected from those facilitating the release of rapists and welcoming them." The former Congress chief was apparently referring to the release of 11 convicts in the Bilkis Bano gangrape after the BJP-led Gujarat government allowed it under its remission policy.
Meanwhile, the girls' relatives demanded a government job for a family member, adequate compensation and the death sentence to the six accused before the victims' last rites are performed.
Lakhimpur Kheri Superintendent of Police (SP) Sanjiv Suman told reporters that according to preliminary probe the girls had left their home on Wednesday afternoon with two of the accused, Junaid and Sohail.
The girl’s mother had earlier alleged that they were abducted.
"Junaid and Sohail have confessed to strangling the girls after raping them," the SP said.
He said both were in a relationship with the two sisters, who insisted on marriage, after which they were strangled. The others arrested were identified as Hafizur Rehman, Karimuddin, Arif and Chottu.
Junaid was arrested following an encounter around 8.30 am, police said. A motorcycle, country-made pistol and ammunition were recovered from him.
Additional Director General of Police (Law and Order) Prashant Kumar said Junaid was injured in the encounter.
"The bodies have been handed over to family members, who will conduct their last rites," Kumar said.
SP Suman said clothes of the other accused have been sent for an examination.
Suman also dismissed claims that police used force to send the bodies for a post-mortem, which he said was conducted with their family's consent. A videography of the post-mortem examination was also done, the SP added.
The girls’ father, a landless labourer, expressed satisfaction over the police action in the case.
"We are satisfied with the police action in the case so far," said the sobbing father.
The victims' mother had lodged a complaint at the Nighasan Kotwali police station on Wednesday night, alleging that her daughters were raped and murdered.

The Justice Krishna Pahal bench said Ashish is politically so influential that he could influence the witnesses and affect the trial.&nbsp;

The Lucknow bench of the Allahabad High Court on Tuesday rejected the bail plea of Ashish Mishra alias Monu, son of Union minister Ajay Mishra 'Teni', in the Lakhimpur Kheri violence case which had left four farmers dead.
The Justice Krishna Pahal bench said Ashish is politically so influential that he could influence the witnesses and affect the trial.
The bench had reserved its order on July 15 after completing the hearing.
On February 10, the Lucknow bench had granted bail to Ashish but the Supreme Court cancelled it and directed the high court to decide his plea after affording adequate opportunity to the victims.

"The entire country has seen the truth of the 5,000-page chargesheet in the form of a video. Yet the Modi government is trying to save the accused. India is a witness! #Lakhimpur#Farmers", Rahul Gandhi said in a tweet in Hindi, while seeking the dismissal of Ajay Mishra.
Congress general secretary Priyanka Gandhi said, "They are in the position of protector but stand with the destroyer. In the charge sheet of the Lakhimpur Kheri massacre case, the son of the Union Minister of State for Home is the main accused in the crushing of farmers." "But due to Narendra Modiji's patronage, Minister Ajay Mishra ‘Teni’ did not even come under the scrutiny of the investigation and he remains in his post," Priyanka alleged demanding the sacking of the minister.
Samajwadi Party president Akhilesh Yadav in a tweet said the charge sheet has exposed the double-engine government of the BJP.
"Today, every supporter-worker of the BJP is embarrassed and scared of social boycott," he said.

Lakhimpur farmers' killings: The chargesheet has named Union Minister Ajay Mishra's son Ashish Mishra as the main accused. Ashish is already under arrest in the case

The Special Investigation Team probing the<a href="https://www.editorji.com/india-news/lakhimpur-farmers-killings-5-000-page-chargesheet-filed-union-minister-s-son-prime-accused-1641200404377" target="_blank"> Lakhimpur farmers' killings</a> on Monday filed a 5,000-page chargesheet in a UP court.
The chargesheet has named Union Minister Ajay Mishra's son Ashish Mishra as the main accused. Ashish Mishra is already under arrest in the case.
The SIT had recently requested a local court to add attempt to murder charge against Ashish Mishra and the 12 others accused.
Last month, the SIT had told the designated local court that the killing of the farmers and the journalist was a "planned conspiracy" with intent to commit murder and not a case of death by negligence.

Four protesting farmers and a journalist were run over, allegedly by an SUV driven by <a href="https://www.editorji.com/india-news/lakhimpur-violence-3-day-police-custody-for-ashish-mishra-1633950179329" target="_blank">Ashish Mishra</a> in Lakhimpur Kheri on October 3. In the subsequent violence that broke out, three more, including two BJP workers, were killed.
Videos from the scene showed an SUV running over farmers at full speed.
The BJP has been under attack over continuation of <a href="https://www.editorji.com/india-news/lakhimpur-sit-finings-under-fire-union-minister-ajay-mishra-loses-his-cool-on-camera-abuses-journalist-1639569887017" target="_blank">Ajay Mishra Teni</a> as a Union Minister after the farmers' killings.

Days after farm leader Rakesh Tikait threatened agitation if Union minister Ajay Mishra took part in the inauguration of two cooperative sugar mills in Lakhimpur Kheri on Wednesday, the minister skipped the event.
The Indian Express has reported that Minister of State for Home was invited as the chief guest at both the mills, but dropped out at the last minute.
Farmers' group have been demanding acting against Mishram since the last month's killings of farmers in Lakhimpur Kheri. His son, Ashish is accused of murder in the Lakhimpur Kheri incident of October 3, when a convoy of vehicles, including one owned by the minister, ploughed into a group of protesting farmers, killing four of them.
Report said that invitation cards had been sent out with Ajay Mishra as the chief guest at both the sugar mills which held events on Wednesday to mark the beginning of crushing season for 2021-22.
The Indian Express further reported that BJP Palia MLA Harvinder Kumar Sahni was also invited as &lsquo;special guest&rsquo; for the events at the two mills, but he also did not turn up.
Mishra had also skipped the final day of the annual conference of DGPs and IGs in Lucknow on Sunday.
