Markets regulator Sebi has ordered the attachment of bank accounts and shares and mutual fund holdings of fugitive businessman Mehul Choksi to recover dues totalling Rs 5.35 crore.
The latest decision has been taken after Choksi failed to pay the fine imposed on him in October 2022 by Sebi in a case pertaining to indulging in fraudulent trading in the shares of Gitanjali Gems Ltd.
Choksi, who was the chairman and managing director as well as part of the promoter group of Gitanjali Gems, is the maternal uncle of Nirav Modi. Both of whom are facing charges of defrauding state-owned Punjab National Bank (PNB) of more than Rs 14,000 crore.
Both Choksi and Modi fled India after the PNB scam came to light in early 2018. While Choksi is said to be in Antigua and Barbuda, Modi is lodged in a British jail and has challenged India's extradition request.
In an attachment notice on Wednesday, Sebi said the pending dues of Rs 5.35 crore include the initial fine of Rs 5 crore, interest of Rs 35 lakh and a recovery cost of Rs 1,000.
To recover the dues, Sebi asked all the banks, depositories -- CDSL and NSDL -- and mutual funds not to allow any debit from the accounts of Choksi. However, credits have been permitted. Further, Sebi has directed the banks to attach all accounts, including lockers, held by the defaulter.
Initiating the recovery proceedings, Sebi said there is sufficient reason to believe that Choksi may dispose of the amounts in the bank accounts, mutual fund folios and securities in the demat accounts held with the depositories and "realisation of the amount due under the certificate would, in consequence, be delayed or obstructed".
Before the attachment proceedings, Sebi, on May 18, had sent a demand notice to Choksi, asking him to pay Rs 5.35 crore in the case and warned of arrest and attachment of assets as well as bank accounts if he fails to make the payment within 15 days.
In October 2022, Sebi levied a fine of Rs 5 crore on him for indulging in fraudulent trading in the shares of Gitanjali Gems Ltd.
Apart from penalising, the regulator barred him from the securities market for 10 years.
The regulator had issued a common show cause notice to Choksi in May 2022 pursuant to an investigation into the alleged manipulative trading in the scrip of Gitanjali Gems. The regulator conducted an investigation into the trading activities of certain entities in the scrip of the company for the period July 2011 to January 2012.
Sebi said that Choksi had funded a set of 15 entities known as 'front entities', who were directly or indirectly connected with him and with each other and who had taken a position in the scrip of Gitanjali Gems both in the cash and derivative segments during the investigation period. He had used them as front entities for manipulation in the company's scrip.
In February 2022, Sebi prohibited Choksi from the securities markets for one year and levied a fine of Rs 1.5 crore on him for violating insider trading rules in the matter of Gitanjali Gems, and in February 2020, the regulator slapped a total fine of Rs 5 crore on Choksi, Gitanjali Gems and another individual for violating various regulations, including listing norms, in connection with the massive fraud on PNB.

In the event of non-payment of dues, the markets regulator will recover the amount by attaching and selling his moveable and immoveable property. Besides, Choksi faces attachment of his bank accounts and arrest.

It was observed that the fund transfers by the company to front entities were to the extent of Rs 77.44 crore, out of which funds to the tune of Rs 13.34 crore were used by front entities to trade in the scrip.
Choksi, through front entities, tried to corner the shares available in the market to reduce the shares available for general investors which subsequently increased after the front entities sold the shares in the market.
Further, the front entities cornered the position limits in the scrip of Gitanjali Gems by building up substantially large positions in the derivatives segment, as per the order.

&nbsp;Congress president Mallikarjun Kharge on Tuesday attacked the government for diamantaire Mehul Choksi's removal from the Interpol database of Red Notices, saying fugitives are getting respite while the ED-CBI pursue opposition leaders.
He also alleged that Prime Minister Narendra Modi's slogan of "Na khane doonga" has become another "jumla" (rhetoric).
The attack came after the name of Choksi, wanted in a Rs 13,000-crore scam in the Punjab National Bank, is understood to have been removed from the Interpol database of Red Notices on the basis of his plea to the Lyon-headquartered agency, people in the know of the development had said.
"ED-CBI for opposition leaders but release from Interpol for 'our Mehul bhai' of Modi ji. When Parliament can be stalled for 'best friend', then how can help for the 'old friend ' be denied who absconded five years ago," Kharge said in a tweet in Hindi.
"Thousands of crores of the country were lost and 'Na khaane doonga' became another 'jumla'," the Congress chief also said.
The Congress said while the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) pursue Opposition leaders with "great vigour", they allow a lifesaver to the wanted diamantaire.

A spokesperson for the diamantaire said the decision of Interpol to delete the Red Notice strengthens the claims of Choksi about his alleged kidnapping during his stay in Antigua.

While removing Choksi's name from the wanted list, the Interpol said that he might 'face the risk of not receiving a fair trial or treatment in the country.'

Notably, Choksi, wanted in $2 billion PNB fraud case had alleged that he was abducted by Indian agents from Antigua and taken to Dominica in May, 2021.

Replying to a question in the Lok Sabha on 20 December 2022, Minister of State for Finance Bhagwat Karad revealed that the list is topped by fugitive diamond merchant Mehul Choksi whose Gitanjali Gems didn't repay loans worth ₹7,848 crore.
He is followed by Era Infra with an unpaid loan of ₹5,879 crore, and Reigo Agro with a loan of ₹4,803 crore.

In a relief to fugitive fugitive businessman Mehul Choksi, who is wanted in India in the Punjab National Bank fraud case, the Dominica High Court on Monday granted him bail on medical grounds.
Choksi, had gone missing on May 23 from Antigua and Barbuda, sparking a massive manhunt. He was later captured in Dominica and is facing charges of entering the country illegally.
Choksi had filed a case in the high court of Dominica, seeking to quash the proceedings against him alleging that his arrest was "dictated" by representatives of the Indian government.
The case was filed against the Immigration Minister of the Caribbean nation, its police chief and the investigating officer of the case.

In a relief to fugitive businessman Mehul Choksi, who is wanted in India in the Punjab National Bank fraud case, the Dominica High Court on Monday granted him bail on medical grounds.
Choksi, had gone missing on May 23 from Antigua and Barbuda, sparking a massive manhunt. He was later captured in Dominica and is facing charges of entering the country illegally.
