The Supreme Court Thursday transferred to CBI the investigation against former police commissioner of Mumbai Param Bir Singh over the allegations of misconduct and corruption.
A very murky affair is going on amid echelons of power on who should investigate the matter, a bench of Justices S K Kaul and M M Sundresh said.
The apex court said a thorough investigation is required to regain faith of people in the state police. 
The bench said: "We are unable to accept the contention that an FIR is registered by those who had complaints against the petitioner. We are of the view that state itself should have allowed CBI to carry the investigation.
"We are of the prima facie view that there is some concerted effort which needs the investigation by CBI. What is the truth, who is at fault how does such scenario come to prevail is something which investigation must get into. CBI must hold an impartial inquiry into all these aspects".
The top court said it was not commenting on merits of the allegations as it does not want the investigation to be influenced in any manner.
"We do not want the investigation to be influenced by the observation of this court. The High Court has treated this as a service dispute which it is not and thus we set aside the HC verdict. We allow the appeal and direct the probe into 5 FIRs be transferred to CBI with all records.
"Such transfer to be completed within one week and all officials to extend full cooperation to CBI to try arrive at the truth," the bench said.

The Supreme Court Tuesday directed the Maharashtra government to put “hands on hold” in the investigation against former police commissioner Param Bir Singh over the allegations of misconduct and corruption.
A bench of Justices S K Kaul and M M Sundresh said the "messy state of affairs" has "the propensity of unnecessarily shaking confidence of people in police system".
When the counsel for Maharashtra asked the apex court not to record its direction to put “hands on hold” the in order, the bench recorded his assurance in the matter.
“We have now put down the matter for final hearing, investigation being completed can pose problems. Mr Darius Khambata, senior advocate, has assured to put their hands on hold. We take the assurance on record,” the bench said.
The apex court asked the parties to file written synopsis and posted the matter for hearing on March 9.
The court expressed concern over the “messy state of affairs” in the state and said this is an unfortunate scenario.
“We have had occasion to say earlier that it is messy state of affairs. This is an unfortunate situation.
“It has the propensity of unnecessarily shaking confidence of people in police system. Process of law must be carried in a manner,” the bench observed.
Solicitor General Tushar Mehta, appearing for the CBI, submitted that it is in the interest of things that all cases herein be investigated by the central probe agency.
“Once you proceed with an investigation and record it then its not fair to stop midway. State should not do anything that makes the process difficult,” Mehta said.
The apex court had earlier allowed Mumbai Police to carry on the investigation against Singh but restrained it from filing charge sheets on the FIRs against him over the allegations of misconduct and corruption.
The state police had earlier told the apex court that Singh cannot be considered a "whistleblower" under the law as he chose to speak out against alleged corruption involving former home minister Anil Deshmukh only after his transfer.
The top court had granted a major relief to Singh on November 22 by directing the Maharashtra Police not to arrest him in criminal cases lodged against him and had wondered if he was being hounded for filing cases against police officers and extortionists, "what could happen to a common man".
Seeking dismissal of Singh's plea for a CBI probe into the entire matter and against any coercive action by the state, the Maharashtra government has filed an affidavit in the apex court and said that the ongoing probe in criminal cases against the former top cop should not be interfered with.
Prior to this, the Bombay High Court had dismissed Singh's petition seeking to quash inquiries initiated against him by the Maharashtra government, and said he can approach the Central Administrative Tribunal.
The high court had held that it was a service matter, and rejected his claim that the government's action was a consequence of his allegations of corruption against Deshmukh.
After Singh was shunted out as Mumbai police commissioner in March 2021 in the aftermath of the 'Antilia bomb scare case', in a letter to Chief Minister Uddhav Thackeray, he levelled corruption allegations against Deshmukh.
In his petition, Singh had also alleged that DGP Pande told him that the inquiries were the fall-out of his allegations against Deshmukh, an NCP leader.
Singh was transferred to the Home Guard after Mumbai police officer Sachin Waze was arrested in the case of an SUV with explosives found near industrialist Mukesh Ambani's house, 'Antilia', and the subsequent suspicious death of businessman Mansukh Hiran.

The Supreme Court Thursday asked former Mumbai police commissioner Param Bir Singh, who has sought protective orders, to disclose his location, saying "no protection, no hearing until we know where you are".
The apex court asked his lawyer to inform about Singh's whereabouts and posted the matter for hearing on November 22.
A bench headed by Justice S K Kaul took exception that his plea seeking protection has been filed through power of attorney.
"You are seeking protective orders; nobody knows where you are. Suppose you are sitting abroad and taking legal recourse through power of attorney then what happens. If that is so then you will come to India if the court rules in your favour, we don't know what you have in mind. No protection, no hearing until we know where you are," said the bench also comprising Justice M M Sundresh.
It further said: "The petition has been filed through power of attorney. Where are you. Are you in this country or outside? In some state, where are you. We will come to the remaining, first we know where you are?" A magistrate court in Bombay on Wednesday declared Singh a "proclaimed offender" in an extortion case registered against him and some other police officers in the city.
Singh had last attended his office in May this year after which he went on leave. The state police had told the Bombay High Court last month that his whereabouts were not known.
The crime branch of Mumbai Police, which is probing the extortion case, had sought the proclamation against him, saying that the IPS officer could not be traced even after the issuance of a non-bailable warrant.
Under Section 82 of the Code of Criminal Procedure, a court can publish a proclamation requiring an accused to appear if a warrant issued against him or her cannot be executed.
As per Section 83, after issuing such a proclamation the court can also order attachment of the offender's properties.
Former assistant police inspector Sachin Waze is also an accused in the case, registered at the Goregaon police station.
Besides Singh, co-accused Vinay Singh and Riyaz Bhatti were also declared proclaimed offenders by Additional Chief Metropolitan Magistrate S B Bhajipale on Wednesday.
Bimal Agrawal, a real estate developer and hotelier, had alleged that the accused extorted Rs 9 lakh from him for not conducting raids on two bars and restaurants which he ran in partnership, and also forced him to buy two smartphones worth around Rs 2.92 lakh for them.
The incidents occurred between January 2020 and March 2021, he had claimed.
Following his complaint, a case was filed under Indian Penal Code Sections 384 and 385 (both pertaining to extortion) and 34 (common intention) against six accused.
Singh is facing an extortion case in Thane too.
The IPS officer was shunted from the post of Mumbai police commissioner in March 2021 after Waze was arrested in the case of the SUV with explosives found near industrialist Mukesh Ambani's south Mumbai residence 'Antilia' and the subsequent death of Thane businessman Mansukh Hiran.
Singh was then appointed as Director General, Home Guards, following which he accused the then Maharashtra home minister Anil Deshmukh of corruption, a charge the latter denied.
Deshmukh later stepped down as minister and the CBI registered a case against him based on Singh's allegations.
Singh was last seen in public on April 7, when he appeared before the National Investigation Agency (NIA) here to record statements in the Antilia bomb scare case. The CBI also recorded &nbsp;his statement in the Deshmukh case.
He last attended office on May 4, following which he went on leave citing health issues, a senior official said.
Singh then sought an extension of leave claiming he had undergone a surgery. In August he requested one more extension.
On October 20, the police told the Bombay High Court that he was "not traceable", and therefore they can not continue an earlier assurance not to arrest him in a case under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The HC was hearing a petition filed by Singh seeking to quash the FIR in the case, registered on the complaint of harassment filed by police inspector Bhimrao Ghadge.

He reminded his twitter followers that it was the NIA that was investigating the Antilia bomb case. The NIA chargesheet clearly says that Sachin Waze was reporting to Param Bir who paid Rs 5 lakh to a cyber expert to create an alibi.
A week ago, The Hindu had reported the Maharashtra government had discussed the possibility of suspending Singh, who after being removed from the post alleged that former Home Minister Anil Deshmukh demanded ₹100 crore extortion money from hoteliers of the city.

The two-judge bench of justices Sanjay Kishan Kaul and R Subhash Reddy said that while the matter raised by the petitioner was serious but it should be raised in front of the high court and not the Supreme Court.The justice also questioned why the petitioner did not make Anil Deshmukh a party in the case even as serious allegations were leveled against him.
Senior advocate Mukul Rahtogi, appearing for Param Bir Singh, withdrew the plea and said he will raise the matter before the high court on Wednesday itself.&nbsp;In his plea, the ex-Mumbai Police commissioner had also requested a stay on his transfer from the top post, days after an explosive-laden SUV was found outside businessman Mukesh Ambani's residence Antilia in Mumbai. Param Bir Singh claimed that his transfer violated Articles 14 and 21 of the Constitution.
