A court in Maharashtra&rsquo;s Thane district has convicted a 47-year-old man for kidnapping a minor girl and sentenced him to 7 years in jail.
Additional Sessions Judge (Kalyan) P R Ashturkar, however, dropped rape charges pressed against Deepak, alias Ganesh Bhanudas Bhuktar, citing lack of evidence.
A copy of the order passed on April 8 was made available on Friday.
Ambernath resident Bhuktar was booked in March 2018 after being accused of kidnapping the 13-year-old girl and taking her to Chhatrapati Sambhajinagar, then Aurangabad.
Judge Ashturkar held that the minor&rsquo;s lack of consent or resistance was irrelevant in a kidnapping case. The court also said that Bhuktar had secretly given her a phone, which was &ldquo;indicative of malicious intent&rdquo;.
The kidnapping charge has been proved beyond reasonable doubt, the court held.
However, the court found the rape allegations lacked specific and clear evidence. It said the girl and her mother failed to provide any specific details regarding the alleged sexual assault, including date, time, or place.
Furthermore, the medical evidence did not support forceful sexual assault, the court said, acquitting Bhuktar of rape charges under the Indian Penal Code (IP) and Protection of Children From Sexual Offences (POCSO) Act.
The court then convicted Bhuktar of kidnapping and sentenced him to seven years in jail and imposed a fine of Rs 3,000 on him.
Additional Public Prosecutor Sachin Kulkarni said six prosecution witnesses, including the teenager and her mother, were examined during the trial.

A chargesheet will be filed within the next week in connection with the brutal rape, torture, and murder of a 12-year-old girl in Maharashtra&rsquo;s Thane district, a senior official confirmed on Thursday.
The accused, Vishal Gawli, allegedly abducted the girl with the assistance of his wife, Sakshi Gawli, from the Chakki Naka area of Kalyan on December 23, 2024, while she was playing outside her home. According to police reports, Vishal Gawli then raped and murdered the child. The couple subsequently transported the victim&rsquo;s body in an auto-rickshaw to Bapgaon on Kalyan-Padgha Road and dumped it there.
The girl&rsquo;s body was discovered on December 24, leading to the immediate arrest of Sakshi Gawli the same night. Vishal Gawli was apprehended the following day in Buldhana district. He is a resident of Kolsewadi in Kalyan tehsil, while his wife Sakshi, who works in a bank, is reportedly his third wife. Both accused are currently in judicial custody.
Deputy Commissioner of Police (Zone III Kalyan) Atul Zende stated that the investigation is in its final stages, with all efforts being made to ensure a strong case without any loopholes. Authorities are also consulting senior lawyer Ujjwal Nikam to reinforce the case and ensure a watertight prosecution.
Officials are working towards having the case tried in a fast-track court to expedite justice for the victim&rsquo;s family. The commitment to swift legal action aims to bring the perpetrators to justice and prevent similar crimes in the future.

A tailor was arrested on Monday for allegedly kidnapping a nine-year-old boy for ransom of Rs 23 lakh with which he wanted to build a house and murdering him in Thane district of Maharashtra, police said.
The boy, identified only as Ibadat, went missing when he was returning from a mosque in Goregaon village where he had gone for evening prayers on Sunday.
Prima facie, the accused is known to the victim. He probably lured the victim to accompany him under some pretext, a Badlapur police station official said.
Police are investigating the exact circumstances under which the boy was kidnapped.
"The kidnapper called up the family of the boy and demanded Rs 23 lakh for releasing him. He told them that he wanted money to build a house. Strangely, he disconnected the call abruptly," the official said.
Police launched a search for the boy after receiving the complaint on Sunday but failed to trace him or the kidnapper.
"On Monday afternoon, Ibadat's body was found stuffed in a sack hidden in the home of a villager," the official said.
However, it is not clear whether the arrested accused was the same villager or someone else.
Police have registered an FIR under section 364 (Kidnapping or abducting in order to murder) of the Indian Penal Code (IPC), said Badlapur police station assistant inspector Govind Patil.
He said the accused is a tailor from the same locality of Goregaon village in Badalpur of Thane district.

"The workers had finished water-proofing work and entered the lift at the 40th floor when the lift came crashing down at around 7:30 pm and landed in P3 (three levels underground in the parking area)," he said.
The building is located off the Ghodbunder Road.
Prima facie, one of the supporting cables of the construction lift snapped, leading to the incident which occurred at around 5:30 pm, he added.
After receiving the information, a team of Regional Disaster Management Cell and Fire Brigade personnel rushed to the spot and pulled out the workers from the basement parking.
"It was immediately not clear how the lift cable malfunctioned," Tadvi added.
The deceased labourers have been identified as Mahendra Choupal (32), Rupesh Kumar Das (21), Harun Sheikh (47), Mithlesh Vishwakarma (35), Kari Das (38), and Navin Vishwakarma.&nbsp;

Amid heavy rains across Maharashtra, a house collapse was reported in Palghar district and boulders fell from a hillock in Thane, according to officials. They added that no casualty was reported so far. 
Civic officials in Thane's Kalyan Town area confirmed that some heavy boulders fell from a hillock but no one was injured.  Thane city, in a span of 24 hours ending on 8:30 AM on Tuesday received 146 mm rainfall, according to regional data.  Low-lying areas in Thane's Kalyan and Bhiwandi also reported flooding leading to evacuation of several people to safer places. 
In Palghar, district adminstration said that a mud house collapsed in Wada taluka on Monday following heavy rains. Occupants of the house were removed once cracks were observed in the house and within minutes, the house collapsed.
The house was constructed last year under a government scheme for the poor, according to the district administration.
 The IMD on Tuesday issued a heavy rainfall alert for Maharashtra over the next four days, following which Chief Minister Eknath Shinde directed the state administration officials to take precautions and ensure there is no loss of life or property.
The Kundalika river in Raigad district, located near Mumbai, has crossed the danger mark, as per an official statement.

Thane Assistant Municipal Commissioner Kalpita Pimple was attacked by a vegetable vendor Amarjit Yadav during an anti-encroachment drive on Monday in the Kasarvadavali locality.
Pimple lost two fingers during the attack, and Somnath Maruti Palve, her security guard, lost one finger. Both of them were rushed to the Jupiter Hospital in Thane.

According to officials, doctors at Jupiter Hospital were carrying out procedures to stitch the chopped off fingers back on Pimple and Palve&rsquo;s hand.
Accused Yadav was arrested on the spot and further probe into the case is underway, a Kasarvadavli police station official said.

Thane Assistant Municipal Commissioner Kalpita Pimple was attacked by a vegetable vendor Amarjit Yadav during an anti-encroachment drive on Monday in the Kasarvadavali locality.
Pimple lost two fingers during the attack, and her security guard, lost one finger. Both of them were rushed to the Jupiter Hospital in Thane.
According to officials, doctors at Jupiter Hospital were carrying out procedures to stitch the chopped off fingers back on the officer and her guard's hands.
Accused Yadav was arrested on the spot and further probe into the case is underway, a Kasarvadavli police station official said.

According to officials, doctors at Jupiter Hospital were carrying out procedures to stitch the chopped off fingers back on Pimple and Palve&rsquo;s hand.
Accused Yadav was arrested on the spot and further probe into the case is underway, a Kasarvadavli police station official said.

The gas leak, which took place around 10:22 pm on Thursday, created panic as people living around the unit faced difficulty breathing and irritation in the eyes for a few hours, an official said on Friday. However, no casualties have been reported so far.
According to the Thane Municipal Corporation, the gas leak was stopped by the fire brigade around midnight.

Four patients died after a fire broke out at a private hospital near Thane in Maharashtra on Wednesday, a civic official said. Fire broke out at the Prime Criticare Hospital at Kausa-Mumbra locality at 3.40 am, the official said and added that there were no coronavirus patients in the hospital. The patients died while being shifted to other hospitals after the blaze and not due to burns, the official further said. The incident has happened five days after 15 coronavirus patients died in a blaze in the intensive care unit of a private hospital at Virar in the adjoining Palghar district.

The Maharashtra govt has declared a lockdown between March 13 and 31 in 11 hotspots of the Thane city, officials said. The order, issued by municipal officials, said the decision was taken due to rise in Covid-19 cases in these areas in the past few days. It said all restrictions that were in place during the nationwide lockdown declared earlier would be in force during this time as well. As on Monday morning, the caseload of Thane district was close 2.7 lakh, including 6,302 deaths.

A blackout of over 2 hours was reported in Mumbai on Monday with residents taking to Twitter to report power cut across the city, Navi Mumbai and Thane.
Multiple tripping of lines and transformers affected 360 MW supply in the city and suburbs. As the city came to a standstill, Mumbai University announced that it has deferred Monday's exam to Sunday, October 18.
The local trains under Western Railway &mdash; between Church Gate to Vasai railway station &mdash; have come to a standstill due to grid failure. The Central Railway (CR) that runs between CSMT and Kalyan has also been stopped.
However, both National Stock Exchange (NSE) and Bombay Stock Exchange (BSE) said that there is no stoppage in trading despite power failure. Amid the blackout, shares of Tata Power crashed by two percent.
